Although outdoor furnaces may provide an economical alternative to conventional heating systems, concerns have been raised regarding the safety and environmental impacts of these heating devices, particularly in relation to the production of offensive odors and the potential health effects of pollutants and uncontrolled emissions. This chapter is intended to establish and impose restrictions upon the construction and operation of outdoor wood-burning furnaces within the limits of the Village of Shortsville for the purpose of securing and promoting the public health, comfort, convenience, safety, welfare and prosperity of the Village and its inhabitants.
As used in this chapter, the following terms shall have the meanings indicated:
OUTDOOR WOOD-BURNING FURNACE
A wood-fired or solid-fuel-fired boiler in a small insulated shed with a smoke stack used to heat water carried into a building through underground or above-ground pipes for the purpose of heating a home, building, domestic hot water use, swimming pool, Jacuzzi or hot tub.
The construction and operation of outdoor wood-burning furnaces are hereby prohibited within the Village of Shortsville.
An offense against the provisions of this chapter shall be deemed a violation, and the person convicted of such violation shall be subject to a fine of not more than $100. Each week's continued violation shall be, for this purpose, a separate and distinct violation subject to said fine.
