Whenever snow shall fall to a depth greater
than one inch it shall be the duty of the owner or occupier of any
real estate abutting on any street or highway within the Borough of
Prospect Park to cause the sidewalks in front of said property to
be cleared, in no event any less than 36 inches wide, and to cause
all snow and ice to be removed therefrom within 24 hours after the
snow has ceased to fall.

It is hereby declared to be a public nuisance for the owner or occupier of any property within the Borough of Prospect Park or the owner of any unoccupied premises therein to permit snow or ice exceeding one inch in depth to remain on the sidewalks in front of their premises, in no event any less than 36 inches wide, for a period of more than 24 hours after the snow has ceased to fall, and any owner or occupier permitting such a nuisance to exist shall be liable to a fine as provided for in §
142-4, to be recovered for the use of the Borough in the manner provided by law.
In the event any owner or occupier shall fail
to comply with the provisions of this chapter, the Borough shall have
the authority to clear the said sidewalks and to collect the costs
thereof in a manner provided by law.

A. Any person or persons violating any of the provisions of this chapter, §§
142-1,
142-2 and
142-3 hereof, shall be subject to a fine of not less than $15 and not more than $300 for each offense and costs of such proceedings, and each daily occurrence of the same offense shall be considered as a new offense and fined as such.
B. In cases where a notice is first given of any violation of this chapter, §§
142-1,
142-2 and
142-3 hereof, by either hand delivery or service by mail to the owner or occupier of any property in the Borough of Prospect Park that is in violation of this chapter, and any sections hereof, or by affixing to the building or premises in violation of this chapter, and any sections hereof, a ticket, citation or notice on which there has been noted the time and place of and nature of the offense or violation charged, no prosecution shall be instituted for 48 hours thereafter, and if during said period the offender shall voluntarily enter a plea of guilty and pay a fine of $15 to the Borough and correct and abate the violation(s), no prosecution for said offense shall thereafter be brought. If the offender fails to pay within 48 hours as referred above, the offender shall be subject to fine(s) and costs enumerated in §
142-4A.
