This article shall be known as the "Conewago Township Dog Barking Ordinance."
The following are definitions:
OWNER
Every person having a right of property in a dog or dogs, and every person who keeps or harbors a dog or dogs, or has it in his or her care, and every person who permits a dog or dogs to remain on or about the premises occupied by that person.
It shall be unlawful for the owner of any dog to cause or permit a dog or dogs to bark or otherwise make any noise or disturbance which results in a nuisance as hereinafter defined.
A. 
The nuisance as contemplated by this article shall be the unreasonable barking or making of noise by dogs, which noise interferes with or deprives any person of the peace, quiet, rest, sleep or legitimate enjoyment of his or her property within the Township.
B. 
Any unreasonable barking or other noise made by dogs shall be presumed by the proof of the continuous barking or making of such noise for two periods of time, each of which is in excess of 15 minutes, and both of which periods occur within the same twenty-four-hour period.

Any person found in violation of any of the provisions of this article shall, upon conviction thereof by a Magisterial District Judge, be ordered to pay a penalty, which shall be a minimum of $50 to a maximum of $300. Each day a violation of any of the provisions of this article occurs shall constitute a separate violation and shall be subject to distinct penalties.
