As used in this chapter, the following terms shall have the meanings indicated:
FULLY ENCLOSED STRUCTURE
A permanent or temporary structure that contains four complete sides and a complete roof that conceals personal property from being seen from a public right-of-way.
STRUCTURE
Any man-made object, including buildings having an ascertainable stationary location on or in land or water, whether or not affixed to the land.
A. 
Any motor vehicle, when such motor vehicle or vehicle, either by reason of its old and dilapidated, disassembled, nonoperable, nonregistered, wrecked, ruined and/or dismantled condition, encompasses flat or lack of tires, the removal of parts from damage by wreck or otherwise, or the failure to be properly inspected, or for any reason whatsoever cannot be self-propelled or moved or operated under its own power upon a public highway within the Township of Conewago, or is incapable of being utilized for its intended purpose, when upon private property, shall be stored within a fully enclosed structure.
B. 
A motor vehicle which has remained on such private property for a period in excess of 30 days under any of the conditions set forth in this section shall be prima facie evidence of abandonment of the motor vehicle.
C. 
This chapter shall also include all vehicles subject to licensing and/or registration under the Pennsylvania Vehicle Code,[1] all tow-behind trailers and pull-behind campers.

No person, firm or corporation shall place, leave, abandon or park or permit to be placed, left, abandoned or parked on private property in the Township of Conewago, Adams County, Pennsylvania, a motor vehicle in the condition or conditions set forth in § 144-2 of this chapter.
The provisions of this chapter shall not apply to the placing, leaving, abandoning or parking of a motor vehicle in a fully enclosed structure.
A. 
Any person who violates or permits a violation of this chapter shall, upon being found liable therefor in a civil enforcement proceeding commenced by the Township before a Magisterial District Judge, pay a fine of not more than $600, plus all court costs, including reasonable attorneys' fees, incurred by the Township in the enforcement of this chapter. Each period of 10 days during which a violation exists shall constitute a separate offense. Further, the appropriate officers or agents of the Township are hereby authorized to enforce compliance by filing an action in equity in lieu of a civil action filed before a Magisterial District Judge.
B. 
In addition to the foregoing penalty, the Township may require the owner or occupier of the property to remove any abandoned vehicle, and, should said person fail to remove the same within 10 days of written notice, the Township may cause the same to be done and collect the costs thereof, together with a penalty of 10% of such costs, in the manner provided by law for the collection of municipal claims or by action in assumpsit or may seek relief by bill in equity and may also seek imposition of a fine and expenses set forth above.
