Unless otherwise stated, the following terms shall have, for the purpose of this article, the meaning indicated in this section:
OCCUPIER OF REAL ESTATE
Any person who owns or has control of a residence in the Borough of East Petersburg, Lancaster County, Pennsylvania.
PERSON
Includes any natural person, firm, association, copartnership or corporation.
RESIDENCE
Any private dwelling, individual apartment units and any other building used for human habitation for residential purposes in the Borough of East Petersburg.
There is hereby levied, assessed and imposed a service charge for Borough purposes on occupiers of residential real estate in the Borough of East Petersburg a rate to be set annually by resolution of Borough Council and for the initial six-month period beginning January 1, 1990, the rate shall be $50 semiannually or fractional part thereof for the collection and removal of recyclable materials, garbage, ashes, refuse, paper, and other debris from premises situate in the Borough of East Petersburg, Lancaster County, Pennsylvania. All persons who are residents within the Borough of East Petersburg shall be liable for said service charge. Occupiers of real estate, including owners of and tenants living in apartments, shall be jointly and severally liable for said service charge, each apartment being considered one unit of real estate, but no one occupier of real estate shall pay more than one service charge per residential unit.
All occupiers of real estate in the Borough, by virtue of this service charge, hereby shall be entitled to receive collection of garbage services subject to regulations and resolutions of the Borough for collection of up to two containers of garbage, with each container not exceeding the lesser of either 30 pounds in weight or 30 gallons. The type of container shall be regulated by resolution by Borough Council. However, the municipal services charge shall apply regardless of whether the occupiers of real estate utilize the garbage collection services offered by the Borough.
From and after January 1, 1990, the municipal service charge levied shall be collected in the same manner as other municipal bills, and said service charge shall be submitted to the Treasurer of the Borough of East Petersburg not later than the first day of the month following the month in which said service charge is levied.
If any service charge levied and assessed pursuant to this article shall not be paid when due, a penalty of 10% of the amount of the service charge due and unpaid shall be added thereto and collected.
This article and the municipal service charge imposed shall become effective January 1, 1990.
