The purpose of this chapter is to protect the public health and to provide for the comfort of all parties by regulating and controlling smoking in certain municipal places and at municipal meetings.
As used in this chapter, the following words shall have the following meanings:
MUNICIPAL MEETINGS
All meetings held by Borough officials, employees, agents or appointees that are open to the public pursuant to the Act of July 3, 1986 (P.L. 388, No. 84), known as the "Sunshine Act."[1]
MUNICIPAL PLACES
Any areas owned by the Borough of Freedom or operated by its employees, agents or appointees and used by the general public or serving as a place of work for municipal employees, including police officers and fire fighters, or any meeting place for a municipal body.
SMOKING
The carrying, by a person, of a lighted cigar, cigarette, pipe or other lighted smoking device.

A. 
No person shall smoke, in a municipal place or during a municipal meeting in an area designated "nonsmoking" in accordance with the terms of this chapter or by subsequent resolution by the Council for the Borough of Freedom.
B. 
The Borough shall provide acceptable areas for smoking.
A. 
Designated smoking areas:
(1) 
Nineth Street side of municipal building.
(2) 
Tenth Street side of municipal building.
B. 
Designated nonsmoking areas:
(1) 
All other areas not designated as smoking areas.
Any person who violates the provisions of this chapter shall, upon conviction at a Magistrate's office, be subject to a fine or penalty of not more than $50 plus costs.
