As used in this article, the following terms shall have the
meanings indicated:
ANIMAL CONTROL AUTHORITY
Any person or agency designated or certified by the State
of New Jersey to enforce the provisions of this article.
CAT
Any member of the domestic feline species, male, female or
altered.
CAT OF LICENSING AGE
Any cat which has attained the age of seven months or which
possesses a set of permanent teeth.
CATTERY
Any room or group of rooms, cage or exhibition pen, not part
of a kennel, wherein cats for sale are kept or displayed.
KEEP or HARBOR
The terms "keep" or "harbor" shall mean the habitually permitting
to remain or to be lodged or to be fed within the house, store, yard,
enclosure or other place.
LICENSING AUTHORITY
The agency or department of the Borough of Lodi or any designated
representative thereof charged with administering the issuance and/or
revocation of permits and licenses under the provisions of this article.
NEUTERED
Rendered permanently incapable of reproduction, as certified
by a licensed veterinarian.
OWNER
When applied to the proprietorship of a cat, shall include
every person having a right of property (or custody) in such cat and
every person who has such cat in his/her keeping or who harbors or
maintains a cat or knowingly permits a cat which can intermingle with
wild animals to remain on or about any premises occupied by that person.
PERSON
Any individual, corporation, partnership, organization or
institution commonly recognized by law as a unit.
The Police Department of the Borough of Lodi shall annually
cause a canvass of all cats owned, kept or harbored within the limits
of the Borough and shall report on or before May of each year to the
Borough Clerk or other official designated and the Health Officer
(if required by law) the result thereof, setting forth the names and
addresses of persons owning, keeping or harboring such cats, the number
of licensed cats owned, kept or harbored by each of said persons,
together with the license numbers of each of said cats, and also setting
forth the names and addresses of persons owning, keeping or harboring
unlicensed cats, the number of unlicensed cats owned, kept or harbored
by each said person, together with a complete description for each
unlicensed cat or cats.
Except as otherwise provided in this article, any person who
violates or who fails or refuses to comply with this article shall,
upon conviction thereof, be liable to a fine not exceeding $2,000,
imprisonment for a period not exceeding 90 days and/or a period of
community service not exceeding 90 days, to be recovered by and in
the name of the Health Officer or by and in the name of the municipality.
Each day a particular violation continues shall constitute a separate
offense.
