It shall be unlawful for any person to be or remain upon the public land or supporting public buildings of the municipality of the Borough of Lodi after 9:00 p.m. and/or at all times on Saturdays, Sundays and holidays, unless such person is in the performance of duty directed by an officer or an authorized agent of the Borough of Lodi, or unless such person is in lawful employment making it necessary to be in such place at such times, or unless such person is participating in an organized program directed by an officer or authorized agent of the Borough of Lodi or is at a meeting or activities authorized by the Borough of Lodi or its agents.
It shall be unlawful for anyone having legal care and custody of any person to allow or permit such person to go or be upon said lands and supporting buildings of the Borough of Lodi at the times as restricted in the preceding section, except for the reasons as set forth in said section.
Every member of the police force is hereby authorized to detain any such person willfully violating the provisions of this article. In the event that the detainee is a minor, the detention will continue until the parent or the guardian of said minor shall take him or her into custody, but such officer shall immediately, upon taking custody of such minor, communicate with the parent or guardian.
If it shall appear that any minor taken into custody for violation of this article is growing up in mendicancy or vagrancy or is incorrigible for lack of proper parental care or has no home, proper proceedings shall be taken to have such minor placed in the care of a state institution as provided by statute.
Any person who violates any provision of this article shall, upon conviction thereof, be punished by a fine not exceeding $2,000, imprisonment for a period not exceeding 90 days and/or a period of community service not exceeding 90 days, within the discretion of the Municipal Judge. A separate offense shall be deemed committed in each day during or on which a violation occurs or continues.
