The office of the Borough Deputy Clerk is hereby created in
and for the Borough of Raritan, pursuant to N.J.S.A. 40A:9-135.
Subject to recall by ordinance by the Borough Council, the powers
and duties of the Borough Deputy Clerk shall include the following,
which shall be performed during the absence or disability of the Municipal
Clerk, or at the direction of the Municipal Clerk:
A. As Secretary to the governing body, he shall:
(1) Record official minutes of the governing body.
(2) Handle municipal correspondence, both incoming and outgoing.
(4) Process, record, file and advertise ordinances.
(5) Process, record, file and, when required by law, advertise resolutions.
(6) Process, record, file and advertise the municipal budget.
(7) Process, record, file and advertise bids for municipal equipment
and supplies.
(8) Handle liaison work between the public and governing body.
(9) Administer and record oaths of office.
(10) Maintain custody of all official records not specifically handled
by other departments.
B. As Secretary of the municipal corporation, he shall:
(1) Maintain custody of the Municipal Seal.
(2) Sign the majority of official documents and attest signatures of
municipal officers and officials.
(3) Maintain receipts of service of legal documents.
C. As election official, he shall:
(2) Certify vacancies on the local level.
(3) Maintain receipts of nominating petitions and certifications to the
County Clerk of local candidates nominated by petition.
(4) Exercise quasi-judicial authority in determining the validity of
petitions.
(5) Conduct the drawing for position of candidates on the local ballot
(primary and municipal).
(6) Furnish material for local elections.
(8) Maintain receipts of election results.
(9) Certify to the County Clerk persons elected to partisan county committee
offices in each election district.
(10) Canvass the votes for and certify election of candidates for local
office at the primary, general and municipal elections.
D. As administrative official, he shall:
(1) Issue licenses (dog, kennel, marriage in first-class cities, liquor,
bingo, raffles, peddlers, taxi and many others).
(2) Issue assessment search certificates.
(3) Handle complaints of all types.
(4) Furnish data to public information media.
(5) Purchase supplies and equipment when required.
(6) Receive and file bonds and insurance policies.
(7) Direct correspondence and inquiries for action to various municipal
departments.
(8) Handle personnel records when required.
(9) Provide for records management.
(10) Conduct business with other municipal departments as directed by
the governing body.
Notwithstanding anything in §
40-2 above contained to the contrary, the Deputy Municipal Clerk shall not exercise any powers or perform any duties required by law to be exercised or performed by the Mayor, Borough Council or any other Borough ward, body or officer.
