[Added 11-10-1981 by Ord. No. 81-9; amended 8-19-2003 by Ord. No. 03-06]
A.
Any person, company or entity shall not park any vehicle or otherwise obstruct any of the areas set forth in Schedule I, attached hereto and made a part of this Part 1, as designated fire zones.[1]
[1]
Editor's Note: See § 82-33.
B.
The owner(s) of any property designated in Schedule I shall mark the fire lane(s) described in that schedule by providing signs constructed of metal with raised red letters a minimum of two inches in size on a white background with the words NO STANDING OR STOPPING — FIRE LANES. Spacing of the signs shall be a minimum of one sign for every 100 feet of fire lane or part thereof. The area of the fire lane shall be delineated with yellow lines four inches in width which contain the marking indicating NO STANDING OR STOPPING — FIRE LANE in yellow letters at least 18 inches in height. The inside of the fire lane shall be further marked with diagonal-striped yellow lines four inches in width spaced at intervals of five feet. If a designated fire lane abuts a curb, such curbing shall be yellow in color as to designate it as part of the fire lane. The costs associated with performing the above-mentioned work to comply with this section shall be the responsibility of the property owner or business owner.
C.
It shall be unlawful for any person to obscure from view, damage, obstruct or restrict access within 10 feet of any fire hydrant or any Fire Department connection for the pressurization of Fire Department suppression systems, including fire hydrants and Fire Department connections located on public, private or other streets and access lanes or on private property.
D.
The Raritan Fire Official, Fire Inspectors, Fire Chief and Assistant Chief, or any police officer may enforce Subsections A through D by issuing a summons. If the Fire Official or duly appointed representatives or police officer deems necessary, or any obstructions or encroachments are not removed, the Fire Official, representative or police officer shall be empowered to remove the same. Costs incurred in the performance of the necessary work shall be paid by the owner of the obstruction or his/her representative. Any individual engaging in official action such as the Fire Official, Fire Chief or police officer shall not be responsible or liable for any damages done to any obstruction during the removal process performed as part of an official duty.
E.
Unless another penalty is expressly provided by New Jersey statute, every person convicted of a violation of a provision of this section or any of its supplements or amendments shall be liable to a fine of not more than $50 or imprisonment for a term not to exceed 15 days, or both.
F.
All penalty money collected by the Raritan Bureau of Fire Prevention and/or the Raritan Fire Department through this section shall be placed in the Raritan Bureau of Fire Prevention's dedicated trust account as required per the New Jersey Uniform Fire Code, N.J.A.C. 5:70-2.12(f)2; furthermore, all monies collected through the Raritan Borough Police Department shall be placed into the Borough's general fund.
