[Adopted 10-27-1970 (Ch. 82, Part 2, Art. XIII, of the 1966 Code)]
For the purposes of this article, the following terms shall have the meanings indicated:
DAILY FEE
The charge levied through a daily payment registration system; for example, a coin machine.

PARKING AREA
Any lot or area in the Borough of Raritan herein designated as a parking area for the off-street parking of vehicles.
PARKING SPACE
Any space within any parking area which is duly designated for the parking of a single vehicle by means of lines painted or otherwise visibly marked on the surface of the parking area or upon curbs, islands or other installations therein.
PARK or PARKING
The standing of a vehicle, whether occupied or not, upon or in any parking area otherwise than temporarily for the purpose of and while actually engaged in receiving or discharging passengers or in obedience to traffic regulations, signs or signals or an involuntary stopping of the vehicle by reason of causes beyond the control of the operator of the vehicle.
PERMIT
A Borough-issued sticker placed on the inside and right side of the rear window of the vehicle to indicate payment to the Borough to park for a designated period in spaces other than those specifically designated for daily parking only.

PERSON
Includes any individual, firm, copartnership, association or corporation.
VEHICLE
Any device in, upon or by which any person or property is or may be transported upon a highway, except a device which is operated upon rails or tracks.
A. 
Tract No. 1. Beginning at the southwest corner of the intersection of Railroad Avenue with Thompson Street, and running thence as follows:
(1) 
In a southwesterly direction 293.00 feet, more or less, along the southerly sideline of Railroad Avenue; thence
(2) 
In a southeasterly direction along the railroad property line 17.00 feet, more or less; thence
(3) 
Along land of the Central Railroad of New Jersey in a northeasterly direction 293.00 feet, more or less, to a point in the westerly sideline of Thompson Street; thence and
(4) 
Along Thompson Street in a northwesterly direction 17.00 feet, more or less, to the point and place of beginning.
B. 
Tract No. 2. Beginning at a point in the westerly sideline of Thompson Street 13.00 feet, more or less, southerly from the southernmost tract of the Central Railroad of New Jersey; and running thence as follows:
(1) 
By land of the Central Railroad of New Jersey in a southwesterly direction 151.00 feet, more or less; thence
(2) 
Still by land of the Central Railroad of New Jersey 30.00 feet, more or less, in a southeasterly direction; thence
(3) 
Still by land of the Central Railroad of New Jersey 82.00 feet, more or less, in a southwesterly direction; thence
(4) 
Still by land of the Central Railroad of New Jersey 30.00 feet, more or less, in a northwesterly direction to a point 30.00 feet, more or less, off the southernmost track of the Central Railroad of New Jersey; thence
(5) 
Still by land of the Central Railroad of New Jersey 80.00 feet, more or less, in a southwesterly direction to a point 30.00 feet, more or less, off the southernmost track of the Central Railroad of New Jersey; thence
(6) 
Still by land of the Central Railroad of New Jersey 20.00 feet, more or less, in a southerly direction to the northerly edge of a spur track; thence
(7) 
Running along said spur track 93.00 feet, more or less, in a southeasterly direction; thence
(8) 
Along land of the Central Railroad of New Jersey 84.00 feet, more or less, in a southeasterly direction; thence
(9) 
Still along land of the Central Railroad of New Jersey 96.00 feet, more or less, in a northeasterly direction; thence
(10) 
Still along land of the Central Railroad of New Jersey 70.00 feet, more or less, in a northeasterly direction, to a point in the westerly sideline of Thompson Street; thence
(11) 
Along the sideline of Thompson Street in a northwesterly direction 75.00 feet, more or less, to the point and place of beginning.
C. 
Tract No. 3. Consists of the area contained within the dedicated right-of-way of Railroad Avenue from Thompson Street easterly to Victoria Street.
D. 
Tract No. 4. Beginning at a point formed by the intersection of the westerly line of Anderson Street and northeast corner of Lot 20, Block 83, and running as follows:

Westerly along the northerly line of Lot 20, Block 83, to the northwest corner of said lot the distance of approximately 119 feet; thence
(2) 
Northerly along the westerly line of Lot 1, Block 83, and across lands of formerly Central Railroad of New Jersey to a point 10 feet off of the most southerly rail; thence
(3) 
Westerly along a line 10 feet off the most southerly rail and parallel to said rail to a point intersecting with the westerly line of Anderson Street; thence
(4) 
Southerly along the westerly line of Anderson Street to the point or place of beginning.
E. 
Tract No. 5. Beginning at a point in the easterly sideline of Thompson Street 13.00 feet, more or less, southerly from the southernmost tract of the New Jersey Transit Railroad and running thence as follows:

F.

The Chief of Police of the Borough of Raritan is hereby directed and authorized to set aside and to designate individual parking spaces in the parking area described in § 82-51 of this article. All individual parking spaces shall be designated by means of lines painted or otherwise visibly marked on the surface of said parking area.

In order to provide safe and sufficient facilities, the parking areas designated and described in § 82-51 of this article shall be limited to the parking of motor vehicles by persons who shall obtain and maintain a permit or pay a daily fee for said parking as herein provided. Motorists must park their vehicles head-on in the parking areas. The Borough Clerk shall cause to be issued a special designated permit or require the payment of a daily fee for the parking areas by persons as may apply for the same, provided that in no event shall permits be issued in a number exceeding that which may be safely and properly parked within said facility.

The Borough Clerk is hereby authorized to issue to persons applying therefor, on payment of the required fees, permits for the parking of motor vehicles in said parking areas. Said permits shall be issued on an annual basis for a period of one year commencing January 1 of such year and terminating December 31 of the same year, upon a semiannual basis for the six-month periods commencing January 1 and July 1 of each year, or upon a quarterly basis for the three-month periods commencing January 1, April 1, July 1 and October 1 of each year or upon a monthly basis commencing the first day of any month, and each permit shall authorize the person to whom it has been issued to park a designated motor vehicle, or one of a designated number of motor vehicles, in a parking area during the days and hours set forth in § 82-57 of this article.

A. 
The fee for obtaining one commuter parking permit at the Raritan Railroad Station shall be $40 per month.
B. 
The fee for parking in any space specifically designated for daily parking only, that is, spaces numbered one through 29 in Tract No. 1 and all spaces located in Tract No. 4, as described in § 82-51 hereof, shall be $3 per day.

At the time of the issuance of each permit, the Borough Clerk shall also issue to the person to whom the permit is granted a sticker containing the expiration date of said permit Each such person to whom a parking permit or card is issued shall display the same in the lower right-hand corner of the inside of the rear window of a motor vehicle for which the permit has been issued.

It shall be unlawful for any person to cause, allow, permit or suffer any vehicle registered in the name of or operated by such person to be parked in any parking area designated and described in § 82-51 of this article between the hours of 5:00 a.m. and 8:00 p.m., Monday through Friday, inclusive, except legal holidays, without a permit affixed to said motor vehicle or payment of a daily fee.
It shall be unlawful and a violation of the provisions of this article for any person:
A.

B. 
To park any vehicle at or in any place within said parking area other than a duly marked parking space therein.
C. 
To obstruct, impede or interfere with, in any manner whatsoever, the free and orderly passage of traffic in the spaces designated or reserved for the movement of traffic within, to or from any parking area.
D. 
To drive a vehicle within said parking area on any part or parts thereof other than the spaces designated or reserved for the movement of traffic within, to or from such parking area, or to drive a vehicle within the parking area in any direction other than as indicated by signs or as directed by a police officer or other duly designated attendant directing the movement of traffic therein.
E. 
To engage in any commercial or business activity within said parking area, other than to render any emergency service or make emergency repairs to any vehicle which has been lawfully parked therein.
F. 
To enter or leave the parking area at any place other than the designated entrances and exits, either with a vehicle or as a pedestrian.
G. 
To use any portion of the parking area in such manner as to endanger the person or property of another.
H. 
To distribute literature or throw handbills in the parking area or into any vehicle while parked therein.[2]

Any person who shall violate or fail to comply with any of the provisions of this article, or who shall counsel, aid or abet any such violation or failure to comply, shall be deemed guilty of an offense against the provisions of this article and shall be punished by a fine not to exceed $100 or by imprisonment not to exceed 10 days for each offense of which he shall be found guilty, either or both penalties to be imposed at the discretion of the court.
All ordinances and parts of ordinances inconsistent with the provisions of this article are hereby repealed; provided, however, that such repeal shall be only to the extent of such inconsistency, and in all other respects this article shall be cumulative of other ordinances regulating and governing the subject matter covered by this article.
If any section or provision, or parts thereof, of this article shall be adjudged invalid or unconstitutional, such invalidity or unconstitutionality shall not affect the validity of the article as a whole or of any other section, provision or part thereof.
This entire article shall be deemed and construed to be an exercise of the police power of the Borough of Raritan, in the County of Somerset, for the preservation and protection of public safety, and all of its provisions shall be liberally construed with a view to the effectuation of such purpose.
This article shall be in full force and effect from and after its passage and publication as required by law.
