Upon declaration of an emergency, there shall be no parking
upon streets or sections of streets where temporary emergency no-parking
signs are displayed. The Chief of Police, or in his absence, the ranking
police officer, is authorized to declare and to direct the posting
of said emergency no-parking sign when weather conditions, accidents,
fires or public celebrations dictate or require the avoidance of hazards
or other conditions which interfere with the free flow of traffic.
Notification that the emergency no-parking signs are being or will
be posted shall, as reasonably possible, be given to the operator
or owner of any vehicle which has been parked prior to the posting
of the signs.
Any unoccupied vehicle parked or standing after emergency no-parking
signs have been posted or the operator or owner of any motor vehicle
parked prior to the posting of emergency no-parking sign, after being
notified that said signs are or will be posted, will be in violation
of this Part 6 and shall be deemed a nuisance and a menace to the
safe and proper regulation of traffic, and any police officer may
take whatever actions necessary for the removal of such vehicle. The
owner shall be responsible to pay any reasonable costs associated
with the removal and storage of the vehicle which may result from
such removal before regaining possession of the vehicle.
Advanced notice may also be given by newspaper publication in
the Somerset Messenger Gazette and/or Courier News, and said publication,
which advises residents, owners and operators of the date(s), street
names and/or location combined with the position of emergency no-parking
signs, shall be deemed proper advance notice under this Part 6.
As used in this Part 6, the following terms shall have the meanings
indicated:
VEHICLE
Any device in, upon or by which any person or property is
or may be transported upon a roadway or highway, except a device which
is operated upon rails or tracks. For the purposes of this article,
"vehicle" shall also include any trailer (boat, house, utility, etc.)
which can be towed by any vehicle permitted by the laws of this state.
The effectiveness of this Part 6 is contingent on signs being
erected as required by law.
Unless another penalty is expressly provided by New Jersey statute,
every person convicted of a violation of the provisions of this Part
6, or any supplement thereto, shall be liable to a penalty of $150
for each violation.
This Part 6 shall take effect immediately upon final adoption
and publication according to law.
