No person shall operate or cause to be operated a motor-driven vehicle over any curbing constructed and existing within the Borough of Raritan, except where such curbing has been reduced in height for the express purpose of allowing travel across it, in areas commonly known as "cutaways" or "cutouts," without the express written permission of the Borough. "Motor-driven vehicles" include any truck, car, motorcycle, moped and/or any other motorized vehicle designed primarily for over-the-road use. Emergency vehicles operated by police, fire and rescue departments shall be exempt.
Whenever any person desires to travel over any curbing in contravention of any of the provisions herein, such person must make written application for such permission to the Property Maintenance Officer of the Borough of Raritan, which application shall include the date or dates such travel is necessary, the purpose for such travel, and the type or types of vehicles that will be proceeding over the curbing. The Property Maintenance Officer may require further information as deemed necessary. All applications will be forwarded by the Property Maintenance Officer to the Borough Engineer for review by the Borough Engineer. The Property Maintenance Officer shall have the authority to issue or deny permission for travel over curbing.
Any person violating any provision of this article shall, upon conviction, be punished by a fine of not more than $200 for each such violation.
