[Adopted by the Board of Health 3-8-1967, amended in its entirety 3-13-1985 (Ch. 84, Art. II, of the 1966 Code)]
It shall be unlawful for any person, whether as principal or agent, clerk or employee, either for himself or any other person or for any other corporation or otherwise, to:
A. 
Engage in the operation of one or more machines or self-service devices which, upon insertion of a coin, coins, paper currency, token, card or key, dispense unit servings of food or beverages, either in bulk or package, without the necessity of replenishing the devices between each vending operation, without first having applied to and procured a license from the Board of Health of this Borough to do so, or without complying with any and all of the applicable provisions of the most current revision of Chapter XII of the New Jersey State Sanitary Code, as enforced by said Board of Health.
B. 
Maintain or permit to be maintained on or in any location in this Borough one or more machines or self-service devices which, upon insertion of a coin, coins, paper currency, token, card or key, dispense unit servings of food or beverages, either in bulk or package, without the necessity of replenishing the devices between each vending operation, without first having applied to and procured a permit for each such machine or device from the Board of Health of this Borough or without complying with any and all applicable provisions of the most current revision of Chapter XII of the New Jersey State Sanitary Code, as enforced by said Board of Health.
A. 
The fees for licenses and permits as required by § 356-5 above, for the purpose of raising revenue for regulation and control, to be paid annually to this Borough, are hereby fixed as follows:
(1) 
License fee: $20 per year.
(2) 
Permit fees:
(a) 
For vending machines dispensing potentially hazardous foods or which provide an increased potential for food contamination: $10 per unit per year.
(b) 
For limited-service vending machines, as defined in N.J.A.C. 8:24-11.1: $5 per unit per year.
B. 
All licenses and permits issued under the authority of this article shall expire on the 31st day of August of each year.
C. 
License and permit fees herein shall be paid to the Raritan Board of Health.
A. 
Application for and issuance of such licenses and permits as referred to in this article shall be made on forms approved by the Board of Health and be in conformity with the provisions of Chapter XII of the New Jersey State Sanitary Code, as enforced by the Raritan Board of Health.
B. 
Such permits and licenses are not transferable.
Permits and licenses issued under authority of this article may be suspended, revoked or reinstated by the Board of Health of this Borough pursuant to the provisions of all applicable state laws and local ordinances.
Any person, firm or corporation who shall violate any of the provisions of this article shall, upon conviction, be punished by a fine not to exceed $200 or by imprisonment in the county jail for a period not to exceed 90 days, or by both such fine and imprisonment; and each violation of any of the provisions of this article and each day the same is violated shall be deemed and taken to be a separate and distinct offense.
