Every application for action by the Board shall be submitted
on the official form adopted by the Board for that purpose. Forms
and instructions shall be furnished by the Town Clerk upon request.
Any communication purporting to be an application shall be treated
as mere notice of intention to seek relief, until such time as it
is made on the approved form and filed with the Town Clerk.
Any appeal under MGL c. 40A, § 8, shall be filed with
the Town Clerk within 30 days from the date of refusal of a permit
or the date of the order, ruling, decision or determination that is
being appealed.
A list of abutters shall be attached to the application form.
The names and addresses of abutters, owners of land directly opposite
the property on any public or private street or way and the owners
of land within 300 feet of the property line shall be provided. All
names and addresses shall be obtained from the most recent applicable
tax list maintained by the Board of Assessors; the Assessors shall
certify the list accompanying the application.
A filing fee of $100 shall accompany each application. If paid
by check, said check shall be made payable to the Town of Great Barrington.
Notwithstanding the foregoing, the Board may, in its sole discretion, waive any of the provisions of §§
245-6 through
245-10, inclusive, of this Article
II and may require additional information as it deems necessary.
