On and after the enactment of this article all applications by persons, corporations or otherwise for taps into the mains or pipes of the public sewers owned and operated by the City of DuBois, whether within or without the limits thereof, shall be made in writing and have attached thereto a plan and statement showing the location of the taps in said sewer line, the size of such taps and distance thereof from the applicant's property to the said sewers; and said application and plan shall be filed in the office of the City Clerk.

Said application shall be submitted by the City Engineer to the Council of the City of DuBois, who shall grant or refuse the same under and in accordance with all ordinances, conditions, regulations and resolutions heretofore and hereafter enacted by the Council of the City of DuBois in respect to the tapping of sewers.

A. 
The fee for tapping or connecting into any sewer or line flowing into or intersecting with the collection system owned and operated by the City of DuBois shall be $3,397, which fee shall be paid to the City Treasurer upon the filing of any application or the making of any request for such tap.

All such applicants shall bear the entire expense and cost of laying any service line, necessary or required, to use the said tap and shall hold the City of DuBois free, clear and discharged of any and all claims for costs, expense and materials, labor and otherwise in laying such service line; provided, however, that the said service line shall be laid under the surface and at the direction of the City Engineer of the City of DuBois and in accordance with the laws of the Commonwealth of Pennsylvania in respect to laying of sewers and the ordinances of the City of DuBois.
There shall not be permitted on any sewer line more than one tap for each building or dwelling house, nor shall such applicant permit any person or persons to tap into or connect with the sewer extending from their building or dwelling house to the City sewer line upon which their tap is made.

No permit to tap shall be granted to any applicant except by a direct connection from the building to the City sewer line, and the City shall reserve the right to disconnect any tap by any applicant on which the applicant or his successors in title shall have permitted any other persons to connect or tap into said connecting sewer line between the building applied for and the City sewer line, and upon the said disconnection, the City shall have the right to retain and keep the amount of the fee paid for said privilege as liquidated damages for the violation hereof.
Any person or persons, as herein described, applying for and obtaining the right to connect with the City sewer line, as herein specified, shall keep said connecting sewer line between the building and the City sewer line open and in a state of repair at his own expense, and it shall be an incident of the privilege granted to said applicants for the tapping that the City shall have no burden, duty or obligation, in any manner whatsoever, to maintain, keep or keep in repair the connecting sewer line between the City sewer line and the building, but the applicant or the applicant's successors in title and possession shall maintain the said sewer line at their own expense and without any obligation on the part of the City.
All persons as herein described receiving permits as herein set forth to tap into or connect with the City sewer lines covenant and agree by virtue of said application and the issuance of a permit therefor to abide by and obey all general regulations of the City of DuBois in respect to sewers and the laws of the Commonwealth of Pennsylvania in respect thereto and shall agree to any additional cost, assessments or charges that may be added to or imposed upon any and all persons using the said sewer line, irrespective of whether the applicants are residents within or without the City of DuBois, and by virtue of said permit, covenant and agree to the same for themselves or their heirs, successors or assigns.
No permit shall be issued by the City Clerk until the fee hereinbefore provided has been paid over the City as hereinabove set forth.
