Upon presentation of proper credentials, duly authorized representatives of the City may enter at reasonable times upon any property within the City to investigate or ascertain the condition of the subject property in regard to any aspect regulated by this chapter.
In the event that a person fails to comply with the requirements of this chapter, or fails to conform to the requirements of any permit issued hereunder, the City shall provide written notification of the violation. Such notification shall set forth the nature of the violation(s) and establish a time limit, usually 16 days, for correction of these violation(s). Failure to comply within the time specified shall subject such person to the penalty provisions of this chapter. All such penalties shall be deemed cumulative and shall not prevent the City from pursuing any and all other remedies. It shall be responsibility of the owner of the real property on which any regulated activity is proposed to occur, is occurring or has occurred to comply with the term and conditions of this chapter.
A. 
Any violation of any provisions of this chapter is deemed a public nuisance.
B. 
Each day that a violation of any provision continues constitutes a separate violation.
A. 
Any person who or which has violated any provisions of this chapter shall, upon a judicial determination thereof, be subject to civil judgment for each such violation of not more than $1,000 nor less than $300, plus costs of suit or, in default of payment thereof, shall be subject to imprisonment for a term not to exceed 90 days. Each day that a violation occurs shall constitute a separate offense. All fines shall be paid to the City Manager of the City of DuBois for its general purposes.

In addition, the City may institute injunctive, mandamus or any other appropriate action or proceeding at law or in equity for the enforcement of this chapter. Any court of competent jurisdiction shall have the right to issue restraining orders, temporary or permanent injunctions, mandamus or other appropriate forms of remedy or relief.
A. 
Any person aggrieved by any action of the City of DuBois or its designee may appeal to the City Council of DuBois within 30 days of that action.
B. 
Any person aggrieved by any decision of the DuBois City Council may appeal to the County Court of Common Pleas within 30 days of that decision.
