There is hereby created a Zoning Board of Appeals to be composed of five electors of the Town of Bethany who are not members of the Planning and Zoning Commission.

At each regular Town election there shall be elected such number of members of said Zoning Board of Appeals as there are members whose terms expire the first Saturday of December succeeding such election, and those so elected shall serve for four years from the first Saturday of December succeeding such election.

If there shall be a vacancy on said Zoning Board of Appeals, the Board of Selectmen shall appoint an elector of the Town to serve until the first Saturday of December succeeding the next regular Town election following the creation of said vacancy, and at said election a member shall be elected to fill the balance of said unexpired term from the first Saturday of December succeeding said election.

At any election, if the number of members of the Zoning Board of Appeals to be elected for the same term is odd, no elector shall vote for more than a simple majority of said number, and if the number of members to be elected is even, no elector shall vote for more than 1/2 of said number.

The Board of Selectmen shall, pursuant to statute, promptly name three alternate members of the Zoning Board of Appeals, no more than two of which persons so named shall be of the same political party. All of said persons shall serve until the first of July 1961.

At the next biennial Town election, two alternate members shall be elected to a four-year term and one alternate member shall be elected to a two-year term. The alternate member elected to a two-year term shall be elected to serve a four-year term commencing with the election of May 2021. Members will be elected in November of odd-numbered years from 2023 onward.
