The accumulation, collection, removal and disposal of refuse
must be controlled by this municipality for the protection of the
public health, safety and welfare. It is consequently found and declared
that:
A. This municipality is authorized by law to regulate the disposition
of refuse generated within its boundaries, to collect a charge therefor
and to license refuse collectors.
B. This municipality is also authorized by C.G.S. § 22a-220a
to designate the area where refuse generated within its boundaries
shall be disposed.
C. This municipality has executed the municipal contract requiring it
to cause all processible solid waste, except for recyclable materials,
OBW and SHW, generated within its boundaries to be delivered to the
Bridgeport System.
D. The public health, safety and welfare of this municipality will be
best served by requiring the delivery of processible solid waste directly
to the Bridgeport Resource Recovery System or a transfer station,
as the Board of Selectmen may determine, for processing by the Bridgeport
Resource Recovery System into products which have an economic value.
E. The enactment of this chapter is in furtherance of this municipality's
approved regional Solid Waste Management Plan.
The following terms shall have the following meanings:
AUTHORITY
The Connecticut Resources Recovery Authority established
pursuant to Chapter 361b of the Connecticut General Statutes, Revision
of 1958, as amended.
BRIDGEPORT SYSTEM
The system for the processing of solid waste and the recovery
of products therefrom constructed by the Authority pursuant to the
municipal contract.
COMMERCIAL REFUSE
Includes waste from the preparation, cooking and consumption
of food, condemned food products and all refuse from the handling,
storage, preparation and sale of produce originating primarily in
commercial kitchens, stores, restaurants, food markets and factories.
DIRECTOR
The Director of Public Works of this municipality.
DISPOSAL CHARGE
That amount of money to be charged for each ton of processible
solid waste delivered to the Bridgeport System as established by the
terms of the municipal contract.
HAZARDOUS WASTES
Solid and liquid wastes in the following classifications:
B.
Pathogenic or pathological wastes.
D.
Cleaning fluids, acids, poisons or other chemical wastes which
either create an immediate safety hazard to persons disposing of the
waste or which, by virtue of their chemistry and/or the method of
disposal, present a threat to the quality of ground- or surface waters.
E.
Hospital operating-room wastes.
HOUSEHOLD GARBAGE
Includes waste from the preparation, cooking and consumption
of products used primarily in private homes.
INDUSTRIAL REFUSE
Includes putrescible and nonputrescible matter from the manufacture,
fabrication or processing of any product.
MUNICIPAL COLLECTOR
The firm which has contracted with the Town of Bethany to
collect residential processible solid waste and/or recyclable materials
and/or hazardous waste.
MUNICIPAL CONTRACT
The Municipal Solid Waste Management Services Contract between
this municipality and the Authority, dated as of November 1, 1991.
OVERSIZED BULKY WASTE or OBW
White goods and other unwanted or discarded materials which:
A.
Cannot be processed in the facility because of size or noncombustibility;
B.
Would not constitute special handling waste;
C.
May be disposed of in a landfill holding a permit issued by
the Connecticut Department of Environmental Protection under C.G.S.
§ 22a-209 et seq. of its regulations or any successor provision;
and
D.
Are not too large to be deposited and stored at a transfer station,
or transported to a landfill, in the manner contemplated in the station
plan of operations.
RECYCLABLE CONTAINER
The container required by the Director to be used into which
all recyclable materials must be placed.
RECYCLABLE MATERIALS
Materials suitable for recycling as provided under Public
Act 87-544, including glass and metal food containers, office paper,
lead acid batteries, scrap metal, corrugated cardboard, newspaper,
used motor oil and leaves and other materials identified by this municipality
as suitable for recycling.
RECYCLING
A method of reducing the volume of wastes which results in
the separation, extraction, refinement or utilization of materials,
including but not limited to aluminum or other metal cans and products,
glass, high-grade paper, newsprint and cardboard, which may then be
marketed or delivered for reuse in manufacturing or other processes.
REFUSE
All putrescible and nonputrescible solid wastes, including
household garbage, rubbish, ashes, bulky wastes and solid commercial
and industrial refuse. It shall not include hazardous wastes.
REFUSE COLLECTORS
Includes any person, firm or corporation engaged in the business
of collecting and transporting commercial, household or industrial
refuse for hire within this municipality.
SPECIAL HANDLING WASTE or SHW
B.
Dirt, concrete and other nonburnable construction material and
demolition debris.
C.
Large items of machinery and equipment, such as motor vehicles
and major components thereof (transmissions, rear ends, springs and
fenders), agricultural equipment, trailers and marine vessels and
any other item of waste exceeding six feet in any one of its dimensions
or being in whole or in part a solid mass, the solid mass portion
of which has dimensions such that a sphere with a diameter of eight
inches could be contained within such solid mass portion, including,
in the context of direct deliveries of the facility, OBW.
D.
Explosives, ordnance materials, oil, sludges, highly inflammable
substances, hazardous chemicals, tires and other materials the acceptance
of which, in the judgment of Resco, reasonably exercised, is likely
to cause damage to or adversely affect the operation of the system,
constitute a threat to health or safety or violate or cause the violation
of any applicable federal, state or local law, regulation or judicial
or administrative decision or order.
TRANSFER STATION
That waste transfer facility designated by the Board of Selectmen.
The Board of Selectmen may, by resolution, establish and from
time to time revise a schedule of fees and/or disposal charges for
use of the Bridgeport System (and any other system for waste disposal,
such as for recyclable material, OBW or SHW) and registration and
licensing of refuse collectors. Said fees or charges shall become
effective when they are approved and a copy of such schedule has been
filed with the Town Clerk.
The Board of Selectmen may establish by resolution a mandatory
or voluntary recycling program for residential, commercial and industrial
producers of solid waste. Such program shall, at a minimum, specify
material to be segregated from other solid waste, methods of segregation,
methods of collection and the delivery point of segregated materials
for recycling.
