It shall be unlawful for any person or persons to sell or offer
for sale by hawking, peddling or door-to-door soliciting any merchandise
or other thing of value, within the Borough of Towanda without first
obtaining a license so to do from the Borough authorities.
All persons desiring to obtain a license for such purposes shall
file, with the Borough Secretary, an application for such license
which shall set forth as follows:
A. Name and address of the applicant and his employees, if any.
B. A brief description of articles and the prices therefor proposed
to be sold.
C. The name and address of the employers, if any, of the applicant.
D. The name and address of the manufacturers of the articles proposed
to be sold.
E. References of the standing of the applicant and of the quality of
the goods proposed to be sold.
On receipt of such application, the Borough Secretary shall
fix a time for hearing upon said application before the Mayor which
shall be at least 10 days thereafter, and the applicant shall thereupon
give notice of such hearing by advertisement in a newspaper of general
circulation within the Borough, which notice shall contain the circumstances
of the application and give the day and hour fixed for a hearing.

The hearing shall be held at the time and place fixed before
the Mayor or some Borough official or member of the Borough Council
designated by the Mayor for that purpose, and if the application shall
be found in order, the facts contained therein proven to the satisfaction
of the Mayor or his representative, then a license to sell or solicit
within the Borough limits shall be issued by the Borough Secretary
on the following terms:
A. There shall be a fee for the license to sell or solicit within the
Borough of Towanda, Pennsylvania, and said fee shall be established
from time to time by resolution of the Council of the Borough of Towanda,
Pennsylvania.
In cases where the requirements of this chapter will work an
unreasonable hardship, or where it is apparent that no injury to the
public will occur, the Mayor, with the approval of the Chief of Police,
may waive the requirements of this chapter.
Any person found guilty of selling, offering for sale or soliciting
from house to house within the Borough without first having obtained
a license in accordance with this chapter shall, on conviction before
the Mayor or any Magisterial District Judge in and for the Borough,
be liable to a fine up to $600 for each incident of sale, offer for
sale or solicitation proven, and in default of payment thereof shall
be sentenced to imprisonment in the county jail for a period of up
to 30 days, and in addition, shall pay the costs.
