Pursuant to Section 11 of the Uniform Fire Safety
Act (P.L. 1983 c. 383), the New Jersey Uniform Fire Code (N.J.A.C.
5:70-1 et seq.) shall be locally enforced in the Borough of Ramsey.
The local enforcing agency shall be the Fire
Prevention Bureau of the Borough of Ramsey, which is hereby created
therein. The Bureau of Fire Prevention shall hereinafter be known
as the "local enforcing agency."
a. The local enforcing agency shall enforce the Uniform
Fire Code in all buildings, structures and premises within the established
boundaries of the Borough of Ramsey other than one- and two-unit owner-occupied
dwellings used exclusively for dwelling purposes and buildings, structures,
and premises owned or operated by the federal government, interstate
agencies or the state.
b. The local enforcing agency shall faithfully comply
with all the pertinent requirements of the Uniform Fire Safety Act
and the Uniform Fire Code.
a. The Bureau of Fire Prevention established by Subsection
14-1.2 of this section shall be under the direct supervision and control of a fire official who shall report to the Borough Administrator.
b. The Bureau of Fire Prevention shall have at least
one paid inspector.
The Fire Official shall be certified by the
state and appointed by the Mayor with the advice and consent of the
governing body.
The Fire Official shall serve for a term of
three years. Any vacancy shall be filled for the unexpired term.
Such inspectors and other employees of the local
enforcing agency shall be appointed by the Mayor with the advice and
consent of the governing body after consideration of the written recommendation
of the Fire Official. Such inspectors and other employees shall be
appointed for terms of one year. Any vacancy shall be filled for the
unexpired term.
The governing body shall specifically appoint
legal counsel to assist the agency in enforcing the Uniform Fire Code.
The Fire Official, inspectors and other employees
of the agency shall be subject to removal by the governing body for
just cause. Before removal from office, all persons shall be afforded
an opportunity to be heard by the governing body or a hearing officer
designated by the same.

a. The Bureau of Fire Prevention established by Subsection
14-1.2 of this section shall carry out the periodic inspections of life hazard uses required by the Uniform Fire Code on behalf of the Commissioner of the New Jersey Department of Community Affairs.

Pursuant to Sections 15 and 17 of the Uniform Fire Safety Act,
any person aggrieved by any action of the local enforcing agency shall
have the right to appeal to the local Construction Board of Appeals.
(If no such body exists, appeals shall be made to the County Construction
Board of Appeals.)

Enforcement, violations and penalties shall be managed in conformity
with the Uniform Fire Safety Act, the Uniform Fire Code and all other
laws of the State of New Jersey.

a. The following fees shall be required for each business use within
the Borough of Ramsey. All fees shall be invoiced annually. New businesses
will be invoiced upon receipt of application.

1. Business
(any building, structure or premises or part thereof used for business):
(a) R1 Use Group: one square foot to 1,499 square feet: $60.
(b) R2 Use Group: 1,500 square feet to 2,999 square feet: $80.
(c) R3 Use Group: 3,000 square feet to 5,999 square feet: $160.
(d) R4 Use Group: 6,000 square feet to 11,999 square feet: $200.
(e) R5 Use Group: 12,000 square feet to 23,999 square feet: $300.
(f) R6 Use Group: 24,000 square feet to 49,999 square feet: $320.
(g) R7 Use Group: 50,000 square feet to 99,999 square feet: $340.
(h) R8 Use Group: Over 100,000 square feet: $420.
2. Residential/multifamily
(any building or portion thereof withy three dwelling units or more).
(a) Three units to 10 units: $100.
(b) Eleven units to 20 units: $200.
(c) Twenty-one or more units: $300.

c. Buildings owned by the Board of Education and operated solely for
Board of Education services, municipal libraries and buildings owned
by the Borough of Ramsey are exempt from fees imposed by this section,
but are subject to all required inspections and regulations pursuant
to the Uniform Fire Safety Act.

a. The permit fees established by type group as defined in the New Jersey
Uniform Fire Code, N.J.A.C. 5:70-2.9 (c), and shall be as follows:

b. Fees for all single event individual permits shall be paid at the
time of application.
c. Notwithstanding anything to the contrary stated herein, there shall
be no fee for Type 4 permits for storage or activity at a premises
registered as a life hazard use.

A permit is required for any manufacturing, storage or handling
of any explosives, hazardous materials and flammable liquids or gases.
There is no fee required for this permit. No permit shall be issued
for a life hazard use.

a. Prohibited acts. It shall be a violation of this section
for any person, firm or corporation to:
1. Obstruct, hinder, delay, or interfere by force or
otherwise with the Fire Prevention Bureau in the exercise of any power
or the discharge of any function or duty under the provisions of this
section.
2. Prepare, utter, or render any false statement, pertaining
to reports, documents, plans or specification permitted or required
under the provisions of this section.
3. Render ineffective or inoperative or fail to properly
maintain any protective equipment or system installed, or intended
to be installed, in a building or structure.
4. Refuse or fail to comply with a lawful ruling, action,
order, or notice of the Fire Prevention Bureau.
5. Violate, or cause to be violated, any of the provisions
of this section.
6. Refuse to provide identification and/or vehicle registration
information.
b. Complaints. The Fire Official and/or Fire Inspector(s)
shall be empowered to issue a Municipal Court complaint for violations
of this section. No complaint shall be issued except upon issuance
of a written order requiring abatement and the allowance of a reasonable
specified period in which to comply, unless clear notice of the violation
otherwise exists.
c. Violations and penalties. Any person, firm, or corporation
found guilty in the Municipal Court for a violation of the provisions
of this subsection shall be subject to a fine of not less than $25
nor more than $1,000 or imprisonment for a period not exceeding 90
days, or both. Each and every day a violation continues shall be separate
offense. Such penalty shall not relieve the violator of the duty to
take corrective actions.

a. The penalty for failure to file a registration application for a
new business or the expansion of an existing business after having
been ordered to do so shall be an amount equal to double the application
registration fee, but not less than $200 nor more than $1,000 for
each registration.
b. The penalty for failure to pay the required annual registration fee
when due shall be an amount equal to the unpaid registration fee.

a. The maximum penalty for failure to obtain a required permit prior
to commencing the operation, process or activity for which a permit
was required shall be a maximum of double the amount of the applicable
permit fee.
b. Failure to obtain a required permit after being ordered to do so
while continuing the operation, process or activity shall be a maximum
of $5,000 per day during which the operation, process or activity
continues.

Preamble: This section shall apply to all fire lane/fire safety zones designated in Subsection
14-2.1 entitled "Fire Safety Zones" as well as all fire lane/zones as may be subsequently designated pursuant to Subsection
14-2.6 below.
The following driveways, rights-of-way, and
private roadways or areas which provide a means of entrance or exit
from multiple dwelling units or business property are hereby designated
as "fire zones":
a. Interstate Shopping Center. An area of 25 feet in
width along the entire length of the curb of the promenade, the curb
shall constitute the westerly and southerly boundary line while the
easterly and northerly boundary line is hereby established as beginning
at a point which is distant 25 feet in an easterly direction from
the northerly terminus of and perpendicular to the curb and running
in southerly and easterly directions parallel with the curb to a point
which is distant 25 feet in a northerly direction from the easterly
terminus of and perpendicular to the curb; together with a similar
twenty-five-foot strip immediately adjacent to the entire rear and
sides of all structures fronting upon the promenade.
b. Village Square. (Northeasterly corner of Main Street
and North Central Avenue) An area 25 feet in width along the entire
length of the curb of the promenade, the curb shall constitute the
northerly and easterly boundary line thereof while the southerly and
westerly boundary line is hereby established as beginning at a point
which the distance is 25 feet in a southerly direction from the westerly
terminus of and perpendicular to the curb and running in easterly
and southerly directions parallel to the curb to a point which the
distance is 25 feet in a westerly direction from the southerly terminus
of and perpendicular to the curb; together with a similar twenty-five-foot
strip immediately adjacent to the entire rear and sides of all structures
fronting upon the promenade.
c. School Street School. An area of 25 feet in width
immediately adjacent to and parallel with the rear line of the school
building.
d. Regency Park Garden Apartments (northeasterly corner
of Addison Place and Island Avenue). All driveway areas including
a twelve-foot gravel drive north of the northeast building complex,
except such areas approved by the proper municipal authorities and
specifically designated for parking; together with four eight-foot
concrete pedestrian access walks leading to the center of each apartment
complex.
e. Shop Rite Shopping Center. An area 25 feet in width
adjacent to and along the entire length of the promenade curbline.
This curbline shall constitute the westerly and northerly boundary
lines of the fire safety zone, and this zone shall extend from the
easterly to the southerly terminal points of the curbline. Also, the
entire area between the northerly side of the shopping center building
and the southerly curbline of Carol Street.
f. Washington Drive (Franklin Square Apartments area).
The northerly and easterly side of Washington Drive from Franklin
Turnpike to Island Road.
g. Christopher Street (Franklin Square Apartments area).
The west side of Christopher Street from Poplar Street to Washington
Drive.
h. Ramsey Square Shopping Center. An area 25 feet in
width adjacent to and along the entire length of the promenade curb.
i. Lot 19-3, Block 3 as shown on the Borough of Ramsey
Tax Map.
1. An area 15 feet in width around the existing building
measured from the asphalt curb;
2. In those areas adjacent to the existing building which
are paved but without curbing, an area 15 feet in width measured from
such building;
3. Beginning at a point on the northerly side of East
Crescent Avenue, the point being distant 164 feet easterly from the
intersection of the easterly curbline of Route 17 with the northerly
curbline of East Crescent Avenue and proceeding thence northerly from
the beginning point a fire lane 15 feet in width extending from East
Crescent Avenue to the canopy and main entrance of the existing building.
j. Interstate Shopping Center Theater and Bowling Alley
Complex.
1. An area 25 feet in width around the existing building
measured from the curb;
2. In those areas adjacent to the existing building which
are paved but without curbing, an area 25 feet in width measured from
such building.
k. Ramsey High School — Prospect Street Parking
Lot.
1. An area at the loading platform 25 feet in width and
25 feet in depth.
2. An area at the gymnasium entrance doors 30 feet in
width and 30 feet in depth.
3. An area 19 feet in width and 140 feet in length parallel
to Prospect Street having its northerly side distant 59 feet from
the southerly face of the building.
4. An area 19 feet in width and 104 feet in length parallel,
to Prospect Street having its northerly side distant 39 feet from
the southerly face of the building.
5. An area 24 feet in width and 88 feet in length, perpendicular
to Prospect Street, running from the northerly curbline to the vicinity
of the loading platform.
l. 10 South Franklin Turnpike.
1. An area 25 feet in width around the existing building,
measured from the curb;
2. In those areas adjacent to the existing building which
are paved but without curbing, an area 25 feet in width, measured
from such building.
m. 1100 State Highway 17 (Lot 16, Block 4301).
1. The entire perimeter of the existing building for
a distance of 10 feet from the exterior wall of the existing building.
2. The northerly entrance/exit roadway on both sides
of the existing building for its entire length from the Franklin Turnpike
Ramp road to the parking lot on the northerly side of the existing
building.
3. On the southerly entrance/exit roadway on both sides
for its entire length to the parking lot on the south side.
4. On both sides of the roadway adjacent to the easterly
side of the existing building (rear) for its entire length.
n. 1136 State Highway 17 (Lot 17, Block 4301).
1. On the north and south side of the existing building
for a distance of 10 feet from the exterior wall of the existing building.
2. On the easterly side of the existing building for
a distance of 25 feet from the existing building.
3. On the westerly side of the existing building for
a distance of 25 feet from the existing building, with the exception
of vehicles being stopped while persons are loading or unloading,
and for handicapped parking.
o. Crescent Avenue Access Road. The entire length and
both sides of the access roadway from East Crescent Avenue to the
parking areas at the rear of the following properties: Lot 6, Block
5101 (commonly known as "Skinner's Nuts"); Lots 7 and 8, Block 5101
(commonly known as "Lawrence Motors"); Lot 10, Block 5101 (commonly
known as "Laub Warehouse").
p. Williams Drive. The entire length and both sides of
the driveway leading from Williams Drive to the parking area at the
south side of the building located on Lots 3 and 9, Block 3901 (commonly
known as "Colorforms").
q. 606 State Highway 17 (Lot 1, Block 5102).
1. An area 25 feet in width around the existing building
measured from the curb.
2. In those areas adjacent to the existing building which
are paved but without curbing, an area 25 feet in width around the
existing building measured from the exterior wall of such building.
r. 900 State Highway 17 (Lot 1, Block 4702). The northeasterly
entrance/exit roadway on both sides for its entire length from State
Highway 17 to the parking lot on the northeasterly side.
s. Spruce Run. Spruce Run for its entire length on the
south side of the street.
t. 150 Hilltop Road (Lot 11, Block 3702). The entire
length and both sides of the entrance/exit driveway on the property
commonly known as the "Goddard School," which property is designated
as 150 Hilltop Road (Lot 11, Block 3702).
u. 815 Route 17 South (Lot 10, Block 4701). An area five
feet in width along the entire length of the driveway adjacent to
the south side of the building on the premises.
v. 475 Route 17 South (Lot 9, Block 5150).
1. An area five feet in width along the entire length
of the driveway adjacent to the retaining wall on the west side of
the parking lot.
2. An area five feet in width along the entire length
of the driveway adjacent to the curb and island on the north side
of the building on the premises.
w. 706 Route 17 North (Lot 7, Block 4702).
1. An area five feet in width along the entire length
of the driveway adjacent to the curb on the northeast corner, extending
to the main entrance of the building on the premises.
2. An area five feet in width along the entire length
of the driveway adjacent to the curb on the north side of the building
on the premises.
3. An area five feet in width along the entire length
of the driveway adjacent to the building on the premises on the northwest
side, ending at the loading zone.
4. An area five feet in width along the entire length
of the driveway adjacent to the curb on the northwest side of the
building on the premises (including all islands).
x. 150 Triangle Plaza (Lots 5, 5.1, 8 and 9 Block 4702.)
The entire thirty-foot by forty-foot paved area adjacent to the main
entrance of the building on the premises.
y. 900A and 900B Route 17 North (Lot 1, Block 4702).
1. An area five feet in width along the entire length
of the parking are adjacent to the curbing parallel to Route 17 North.
2. An area five feet in width along the entire length
of the access road from Route 17 North to the parking areas.
3. An area five feet in width on the northeast side,
rear of the building on the premises, along the entire length of the
paved area adjacent to the curb from Airmount Avenue to the loading
zone (including all islands).
z. Cambridge Heights West Condominiums (Lot 12, Block
4001). An area five feet in width along the entire length of the paved
area adjacent to the retaining wall on the northwest side of Roanoke
Court.
aa. Shop Rite Interstate Shopping Center (Lot 4, Block
4203).
1. An area five feet in width along the entire length
of the paved area, adjacent to the building on the north and south
sides of the premises.
2. An area five feet in width along the entire length
of sidewalk, adjacent to the west side of the building.
3. An area 25 feet in width along the entire length of
the driveway, adjacent to the east side of the building.
bb. Inn at Ramsey (rear parking lot) 315 Route 17 South
(Lot 3, Block 3802).
1. An area five feet in width along the entire length
of the parking area, adjacent to the curbs on the north, south, and
east sides of the building.
2. An area 35 feet in length, by an area of 15 feet in
width, adjacent to the curb at break away gate.
cc. St. Paul's School 187 Wyckoff Avenue (Lot 4, Block
2701). An area 10 feet in width along the entire length of the building,
adjacent to the east side of the parking lot.
dd. Briarwood Court Units 1-17 Briarwood Court (Lot 38,
Block 4601). An area 16 feet in width along the entire length of the
driveway, adjacent to the curbs on the north and south sides on the
premises.
ee. N.J.D.O.T./Park and Ride 26 North Central Avenue (Lot
10, Block 2306).
1. An area 19 feet in width, along the entire length
of the driveway, adjacent to the curb on the north side turnaround.
2. An area 19 feet in width along the entire length island,
adjacent to the curb on the west side turnaround.
3. An area 19 feet in width along the entire length of
island adjacent to the curb on the east side turnaround.
ff. Prestige Lexus, 955 Route 17 South (Lot 11, Block
5101).
1. An area five feet in width along the entire length
of the east side of the building, extending around the north side
of the building to the rear parking lot.
2. An area 25 feet in width along the entire west side
of the building.
3. An area five feet in width along the entire length
of both access road islands, adjacent to Route 17 South.
gg. Prestige BMW, 985 Route 17 South (Lots 45, Block 4603).
1. An area five feet in width along the entire length
of curb from the main entrance extending north to the showroom driveway.
2. An area five feet in width along the entire curbline
on the west side of the building.
3. An area 24 feet in width along the entire length of
the north side of the building (service area).
hh. Access driveway Airmount Avenue, behind auto dealers,
(Lots 45, 46, 47, 48, Block 4603). Entire length of roadway from Airmount
Avenue to the main roadway on the southeast side of the building.
ii. Cambridge Heights, upper parking lot for tenants of
Buildings 19, 20 and 21 (Lot 22, Block 4401). An area 24 feet in width
along the entire roadway on the south side of the parking lot.
jj. Timber Valley Condominiums (Block 3701, Lots 5, 5.1,
5.2).
1. An area 22 feet in width along the entire length of
Cypress Court.
2. An area 25 feet in width along the entire length of
Evergreen Road; Mulberry Road; Redwood Court; Magnolia Road; Oakland
Court.
kk. Chelsea Court (Block 4603, Lot 8) An area 23 feet
in width along the entire length of Chelsea Court.
ll. 1005 Route 17 South (Block 4603, Lot 43). The entire
length of the driveway from the gate to Route 17 South.
mm. Don
Bosco Preparatory High School (Block 3901, Lot 15).
1. An
area five feet in width along the entire front of the DeSales Building
beginning at the furthest corner of the parking lot near the lake
and continuing along the southerly side of the entire roadway from
the corner of the DeSales Building and ending at the end of the roadway
at the top of the hill approaching the football field with the exception
of eight existing parking spaces halfway up the hill.
2. An
area five feet in width along the northerly side of the roadway descending
from the football field beginning at the end of the mid-level student
parking lot and continuing along the entire front of the Immaculata
Building and continuing along the west side of the building, up the
roadway and wrapping behind the Immaculata Building to the edge of
the paved parking lot behind the gymnasium. Seven existing parking
spaces in the rear of Immaculata Hall are exempt and shall remain.
3. An
area five feet in width commencing at the edge of the main driveway
from North Franklin Turnpike where it adjoins the roadway up the hill
to the rear of the Immaculata Building and ending where the roadway
begins its descent to Franklin Turnpike.
4. An
area five feet in width along the entire curbline in front of and
on the same side as the St. John Building.
No person shall at any time park a motor vehicle in, or otherwise obstruct in any way, any fire zone as designated in Subsection
14-2.1.
It shall be unlawful for any person to park or leave standing
any vehicle or place any obstruction on lands, whether publicly or
privately owned, in the Borough of Ramsey after notice has been posted,
as hereinafter provided, by the owner, occupant, lessee or licensee
prohibiting such parking.
As used in this section, the following terms shall have the
meanings indicated:
FIRE LANE/ZONE
Areas designated by the Fire Official and properly posted
and marked in accordance with this section. The terms "fire zone"
and "fire lane" shall be interchangeable.
FIRE OFFICIAL
Is appointed by the Mayor and Council of the Borough of Ramsey,
and shall enforce the New Jersey Uniform Fire Code as defined in N.J.A.C.
5:71-3.3.
OWNER
A person who owns, purports to own, manages, rents, leases
or exercises control over a building, structure, premises or use or
a portion thereof.
PERSON
Any natural person or individual or any firm, partnership,
association, limited partnership, sole proprietorship, corporation
or any other business entity or any government agency or entity.
The Fire Prevention Bureau of the Borough of Ramsey shall enforce
this section.
a. The Fire Official shall designate fire lane/zone on both private
and public property in the Borough of Ramsey as deemed necessary for
public safety. He shall notify, in writing, the owner of said property,
specifically describing the designated areas and the Borough of Ramsey
standard for posting and marking.
b. The marking of fire lane/zone shall be the responsibility of and
at the expense of the owner and shall be accomplished within 30 days
of the receipt of the notification.
c. Suitable signs and/or markings bearing the words "No Parking or Standing
Fire Lane" shall be posted and marked and striped in accordance with
standards established by the Fire Prevention Bureau and shall be properly
maintained on said lands by the owner, occupant, lessee or licensee
thereof where this section is effective and as are approved by the
Fire Official. Defacing, tampering with or damaging such signs or
allowing them to deteriorate so as to reduce their effectiveness to
notify when posted shall constitute a violation of this section.
The Fire Official or his designated representative shall have
the authority to remove or have removed such obstructions or vehicles
as may violate this section at the expense of the owner of the premises
in the case of obstructions or at the expense of the owner of the
vehicle.
a. Any person who violates Subsection
14-2.3 of the section shall, upon conviction in Municipal Court thereof, be punished by a mandatory fine of $100. Each violation shall constitute a separate offense.
b. An owner who fails to comply with the regulations specified in Subsection
14-2.6b or c shall result in a penalty of $500. Penalties shall be assessed by the Fire Official in accordance with N.J.A.C. 5:70, the Uniform Fire Code.

The term "Fire Official" as used herein shall
mean the Chief, the Assistant Chief and other officers and members
of the Ramsey Fire Department.

The Fire Official or his duly authorized representatives,
as may be in charge at the scene of a fire or other emergency involving
the protection of life and/or property, is empowered to direct such
operations as may be necessary to extinguish or control any suspected
or reported fires, gas leaks, or other hazardous conditions or situation
or of taking any other action necessary in the reasonable performance
of their duty. The Fire Official may prohibit any person, vehicle
or object from approaching the scene and may remove or cause to be
removed from the scene any person, vehicle or object which may impede
or interfere with the operations of the Fire Department. The Fire
Official may remove or cause to be removed any persons, vehicle or
object from hazardous areas. All persons ordered to leave a hazardous
area shall do so immediately and shall not reenter the area until
authorized to do so by the Fire Official.

It shall be unlawful to interfere with, attempt
to interfere with, conspire to interfere with, obstruct or restrict
the mobility of, or block the path of travel of any Fire Department
emergency vehicle in any way, or to interfere with, conspire to interfere
with, obstruct or hamper any Fire Department operation.

A person shall not willfully fail or refuse
to comply with any lawful order or direction of the Fire Official
or to interfere with the compliance attempts of another individual.

A vehicle shall not be driven or propelled over
any unprotected fire hose of the Fire Department when laid down on
any street, alleyway, private driveway or any other vehicular roadway
without the consent of the Fire Official in command of the operation.

Authorized emergency vehicles shall be restricted
to those which are defined and authorized under the laws of the State
of New Jersey.

Upon the approach of any authorized emergency
vehicle, giving audible and visual signal, the operator of every other
vehicle shall immediately drive the same to a position as near as
possible and parallel to the right-hand edge or curb of the street
or roadway, clear of any intersection, and shall stop and remain in
such position until the authorized emergency vehicle or vehicles shall
have passed unless otherwise directed by the Fire Official or a Police
Officer.

It shall be unlawful for the operator of any
vehicle, other than one on official business, to follow closer than
300 feet from any fire apparatus traveling in response to a fire alarm
or returning from an alarm of fire or emergency or to drive any vehicle
within the block or immediate area where fire apparatus has stopped
in answer to a fire alarm.

A person shall not, without proper authorization
from the Fire Official in charge of the Fire Department emergency
equipment, cling to, attach himself to, climb upon or into, board
or swing upon any Fire Department emergency vehicle, whether the same
is in motion or at rest, or sound the siren, horn, bell or other sound-producing
device thereon, or to manipulate or tamper with, or attempt to manipulate
or tamper with any levers, valves, switches, starting devices, brakes,
pumps, or any equipment or protective clothing, on, or a part of,
any Fire Department emergency vehicle.

It shall be unlawful for any person to damage
or deface, or attempt or conspire to damage or deface any Fire Department
emergency vehicle at any time, or to injure, or attempt to injure
or conspire to injure Fire Department personnel while performing departmental
duties.

It shall be unlawful to obscure from view, damage,
deface, obstruct or restrict the access to any fire hydrant or any
Fire Department connection for the pressurization of fire suppression
systems, including fire hydrants and Fire Department connections that
are located on public or private streets and access lanes, or on private
property. No person shall park any vehicle or otherwise cause any
obstruction within 10 feet on either side of a fire hydrant.
If upon expiration of the time mentioned in
a notice of violation obstructions or encroachments are not removed,
the Fire Official shall proceed to remove the same. Cost incurred
in the performance of necessary work shall be paid from the Borough
treasury on certificate of the Fire Official and with the approval
of the Chief Administrative Official and the legal authority of the
municipality shall institute appropriate action for the recovery of
such costs.

All new and existing oil storage plants, lumber
yards, amusement or exhibition parks and educational or institutional
complexes and similar occupancies and uses involving high fire, or
life hazards, and which are located more than 150 feet from a public
street or which require quantities of water beyond the capabilities
of the public water distribution system shall be provided with properly
placed fire hydrants. Such fire hydrants shall be capable of supplying
fire flows as required by the Fire Official and shall be connected
to a water system in accordance with accepted engineering practices.
The Fire Official shall designate and approve
the number and location of fire hydrants. The Fire Official may require
the installation of sufficient fire hose and equipment housed in accordance
with the approved rules and may require the establishment of a trained
fire brigade when the hazard involved requires such measures. Private
hydrants shall not be placed into or removed from service until approved
by the Fire Official.

A person shall not obstruct, remove, tamper
with or otherwise disturb any fire hydrant or fire appliance required
to be installed or maintained under the provisions of the Fire Prevention
Code except for the purpose of extinguishing fire, training or testing
purposes, recharging, or making necessary repairs, or when permitted
by the Fire Official. Whenever a fire appliance is removed as herein
permitted, it shall be replaced or reinstalled as soon as the purpose
for which it was removed has been accomplished. Defective and nonapproved
fire appliances or equipment shall be replaced or repaired as directed
by the Fire Official.

A person shall not sell, trade, loan or give
away any form, type or kind of fire extinguisher which is not approved
by the fire underwriters, or which is not in proper working order,
or the contents of which do not meet the requirements of the fire
underwriters. The requirements of this section, shall not apply to
the sale, trade or exchange of obsolete or damaged equipment for junk
and the units are permanently disfigured or marked with permanent
sign identifying the unit as junk.

A person or persons shall not erect, construct,
place or maintain any bumps, fences, gates, chains, bars, pipes, wood
or metal horses or any other type of obstruction in or on any street,
within the boundaries of the municipality. The word "street" as used
in this section, shall mean any roadway accessible to the public for
vehicular traffic, including, but not limited to, private streets
or access lanes, as well as public streets and highways within the
boundaries of the Borough.

Any vehicle parked in a fire safety zone as
hereinbefore set forth shall be towed away at the vehicle owner's
expense if the Borough Police Department determines that the parking
of such vehicle in the fire safety zone is detrimental to public safety.

In all structures served by an internal automatic
fire detection or suppression system, where access within the structure
or an area is unduly difficult because of secured openings, or where
immediate access is necessary for lifesaving or for fire fighting
purposes, the Fire Official may require a key box to be installed
in an accessible location. The key box shall be a type approved by
the Fire Official, so that all key access of this type within the
Borough of Ramsey may be accomplished with one system. The key box
shall contain keys to gain necessary access as required by the Fire
Department.

Installation of the key box shall be in accordance

required. The Fire Official shall have the authority to implement
a uniform system throughout the Borough, so that access to the designated

Pursuant to the Uniform Fire Safety Act, P.L.
1983, c. 383 (N.J.S.A. 52:27D-192 et seq.) and Ramsey Ordinances 970E
and 1153 states: Before any Use Group R-3 or R-4 structure is sold,
leased or otherwise made subject to a change of occupancy for residential
purposes, the owner shall obtain a certificate of smoke detector and
carbon monoxide alarm compliance (CSDCMAC) evidencing compliance with
N.J.A.C. 5:70-4.19.

For existing one- and two-family dwellings,
battery-operated and/or hard-wired smoke detectors and battery-operated-,
hard-wired-, or plug-in-type carbon monoxide alarms that have been
listed and labeled in accordance with UL (Underwriters Laboratories)
shall be accepted as meeting the requirements.

shall be subject to a fine of not more than $500, which may be collected
by the local enforcing agency.

Smoke detectors and carbon monoxide detectors
shall be installed and maintained as per manufacturer's instructions.
All smoke detectors shall be in accordance with the National Fire
Prevention Association Standard 72-1993. All smoke and carbon monoxide
detectors shall be maintained in working order at all times.
a. Smoke detectors shall be installed at the base of
each stairway on each level of the structure (including basement)
and outside each separate sleeping area in the immediate vicinity
of the bedrooms (within 10 feet of each bedroom door) and not closer
than three feet to five feet to any air register or bathroom door.
b. Carbon monoxide detectors shall be installed within
10 feet of every bedroom, and as required by the manufacturer's recommendations.
All carbon monoxide detectors shall meet the requirements of UL Standard
2034.

The application fee for a certification of smoke
detector and carbon monoxide alarm compliance (CSDCMAC), as required
by N.J.A.C. 5:70-2.3 shall be based upon the amount of time remaining
before the change of ownership or occupant is expected as follows:
a. Requests for a CSDCMAC received more than 10 business
days: $50.
b. Requests for a CSDCMAC received four to 10 business
days: $70.
c. Requests for a CSDCMAC received fewer than four business
days: $125.

properly upon initial inspection, a fee of $35 shall be charged for
a reinspection; all fees shall be paid prior to the reinspection.

premises unless accompanied by an occupant, owner, tenant, agent,
etc.

The purpose of this section is to mandate the exterior identification
of all structures within the Borough of Ramsey, Bergen County, New
Jersey, that utilize lightweight wood, wood truss, steel truss, composite
truss, laminated wood, wood I-beams, or any other premanufactured
lumber as a method to construct, renovate, or alter any section of
an individual structure or dwelling unit. The identification of these
buildings will provide fire-suppression crews with critical strategic
and tactical information to be utilized during fire-fighting operations
and significantly enhance the safety of fire-suppression personnel.
This section shall apply to all structures consisting of truss or
premanufactured building components not currently regulated for identification
within the New Jersey Edition of the Uniform Commercial Code and International
Fire Code.
a. As used in this section, the following words and phrases shall be
defined as is hereinafter indicated:
ALTERATION
The rearrangement of any space by the construction of walls,
partitions, the addition or elimination of any door or window, the
extension or rearrangement of any system, the installation of any
additional equipment or fixtures and any work which affects a primary
structural component.
BUILDING PREPLAN INSPECTION
Any preoccupancy site visit conducted by Fire Department
personnel utilized to gather building information, develop strategic
and tactical incident action plans, review construction type(s), and
familiarize personnel with the individual construction site or renovation
project.
CODE ENFORCEMENT
The department responsible for all Construction Code and
Housing/Property Maintenance Code inspections, Zoning Regulations
and inspections, and all construction plan reviews within the Borough
of Ramsey.
CODE ENFORCEMENT INSPECTOR
Any employee assigned to the Code Enforcement office responsible
to conduct code enforcement inspections and plan reviews.
COMPANY OFFICER
Any officer (Lieutenant, Captain, Deputy Chief, Chief) assigned
to the fire suppression division of the Ramsey Fire Department.
COMPOSITE TRUSS
Any truss building component comprised of a mixture of wood
and steel truss components.
CT
The insignia utilized to identify the use of a composite
truss support system within the building.
ENGINEERED LUMBER
Prefabricated I-joists, truss joists, truss rafters, and
laminated beams and studs and any other materials that may fit within
this category.

The insignia utilized to identify the use of the structural components identified in Subsection
14-6.1, Purpose, as a floor support system.
FIRE CHIEF
The individual responsible for the daily operations of the
Ramsey Fire Department.
FIRE DEPARTMENT INSPECTION
A complimentary inspection conducted by Fire Department personnel
at the request of the property owner to assist in determining the
type of floor and/or roof support system present within an individual
building or dwelling unit.
FIRE INSPECTION
An inspection of an individual building and/or property designed
to determine if any violations of local fire code ordinances or the
New Jersey Uniform Commercial Fire Code are in existence.
FIRE OFFICIAL
The individual responsible for the daily operations of the
Fire Prevention Bureau.
LIGHTWEIGHT WOOD TRUSS
A collection of lightweight structural components (two inches
by four inches or less) joined in a triangular unit that can be used
to support either floors or roofs.
LOCAL ENFORCING AGENCY (LEA)
A municipal entity charged with the administration and enforcement
of the regulations consisting of the construction official, subcode
officials, fire official, and assistants in accordance with N.J.S.A.
52:27D-126 and the New Jersey Uniform Fire Code.
LW
The insignia that is used to identify the use of laminated
wooden beams in the support system within the building.
PLAN REVIEW
Any review of required building plans conducted by Code Enforcement
personnel, subcode officials, fire official, or Fire Chief.
PREMANUFACTURED LUMBER
Any assembly of materials or products that is intended to
comprise all or part of a building or structure and that is assembled
off-site by a repetitive process under circumstances intended to insure
uniformity of quality and material content. The term shall include,
but not be limited to, manufactured homes and industrialized modular
buildings.
PROGRAM ADMINISTRATOR
The Fire Chief (or his designee), who is responsible for
administering and supervising the provisions of this section.
PROPERTY OWNER
The owner in fee of the property or a lesser estate therein,
a mortgagee or vendee in possession, an assignee of rents received,
executor, trustee, lessee or any other person, firm or corporation
directly or indirectly in control of a building, structure, or real
property and shall include any subdivision thereof the state.
REFLECTIVE SYMBOL
An emblem made of reflective material, in the shape and form
as described by the Uniform Construction Code (UCC), the Uniform Fire
Code (UFC) and the International Fire Code, New Jersey Edition (IFC),
with the mentioned modifications, in order to maintain continuity
throughout the state identifying a structure as containing engineered
lumber.
RENOVATION
The removal and replacement or covering of existing interior
or exterior finish, trim, doors, windows, or other materials with
new materials that serve the same purpose and do not change the configuration
of space. "Renovation" shall include the replacement of equipment
or fixtures.
STRUCTURE
A combination of materials to form a construction for occupancy,
use or ornamentation, whether installed on, above or below the surface
of a parcel of land.
b. All definitions in the UCC, the UFC, and the IFC shall be the same
for this section.
The Borough Construction Official shall determine if a structure
contains engineered lumber. All structures containing engineered lumber
shall have a reflective symbol affixed as follows: primary location
will be the electrical meter. In the event the electrical meter is
inside the structure, the secondary location will be the area of the
gas meter plainly visible. In the event the gas meter is inside the
building, the third and final location will be the garage door.
The relective symbol shall be an emblem made of reflective material,
in the shape and form as described by the UCC. Dimensions shall be
five inches by 2.5 inches. This shape and design shall be used in
order to maintain continuity throughout the state identifying a structure
as containing engineered lumber. This reflective symbol will be supplied
by the Borough at no expense to the owner.
This section shall apply to all structures, whether residential,
commercial or otherwise, including structures existing at the time
of the effective date of this section. Existing structures shall be
posted according to these guidelines with the owner's consent.
This section shall be enforced by the Construction Official,
Zoning Officer and the Fire Official of the Borough of Ramsey.
Any person violating this section by refusing to use the reflective
symbol or by removing or tampering with the reflective symbol shall
be subject to a fine in an amount of $250 per violation. Each day
that a violation continues shall be deemed to be a separate and distinct
offense.
