The purpose of this article is to calculate and set sewer system
tapping fees in accordance with Act 57 of 2003, 53 Pa.C.S.A. § 5607(d),
(P.L 404) ("Act 57"), based upon a Sewer System Capital Charges Study
pursuant to Act 57 of 2003, prepared by Glace Associates, Inc., dated
November 2009 ("Study"). The study is marked and attached hereto as
Attachment A and incorporated herein by reference as if set forth
in its entirety and made a part of this article.
This article shall apply to the entire sewer system owned and
operated by the Borough.
As used in this article, the following terms shall have the
meanings indicated:
EQUIVALENT DWELLING UNIT or EDU
Any room, group of rooms, house, trailer or other structure
or enclosure occupied or intended for occupancy as separate living
quarters by a family or by persons living together or by persons living
alone. For a nonresidential use, the sewer flows for such use, divided
by 216 gallons per day, shall be the number of EDUs for such nonresidential
use.
TAPPING FEE
The fee authorized by Act 203 of 1990, as amended by Act
57, and which is required to be paid upon application to connect any
improved property to the sewer system operated by the Borough.
All other ordinances, resolutions, rules and regulations of
the Borough relating to the provision of sewer service to the extent
not specifically amended or modified hereby shall remain in full force
and effect, it being the specific intent of this article to establish
sewer system tapping fees in accordance with the Act, as amended by
Act 57.
