Any person who keeps or operates or proposes to establish a
kennel, pet shop, shelter or pound in the Township of Upper Deerfield
shall apply to the Municipal Clerk or other official designated by
the Township for a license entitling him to keep or operate such establishment
in accordance with N.J.S.A. 4:19-15.8.
The application shall describe the premises where the establishment
is located or is proposed to be located and the purpose or purposes
for which it is to be maintained and shall be accompanied by the written
approval of the local municipal and health authorities showing compliance
with the local and state rules and regulations governing the location
of and sanitation at such establishments.
All licenses issued for kennels, pet shops, shelters or pounds
shall state the purpose for which the establishment is maintained,
and all such licenses shall expire on the last day of June of each
year and be subject to revocation by the municipality on recommendation
of the State Department of Health and Senior Services or the County
Department of Health for failure to comply with the rules and regulations
of the state department or county department governing the same after
the owner has been afforded a hearing by either the state department
or county department. Any person holding such license shall not be
required to secure individual licenses for dogs owned by such licensee
and kept at such establishments; such licenses shall not be transferable
to another owner or different premises.

The annual license fee for a kennel providing for not less than
six dogs nor more than 10 dogs shall be $10 and, for more than 10
dogs, $25. The annual license fee for a pet shop shall be $10. No
fee shall be charged for a shelter or pound. In the event that N.J.S.A.
4:19-15.9 is amended to provide for fees other than herein stated,
then the statutory fees shall be charged.
Operation of the above facilities shall be in conformity with
rules and regulations governing the sanitary conduct and operation
of kennels, pet shops, shelters or pounds, N.J.A.C. 8:23-3.1 et seq.,
and with other applicable state laws and regulations.
Any person found guilty of violating any of the provisions of the article or the statute referred to herein or the rules and regulations referred to herein shall, upon conviction, be liable as set forth in §
125-9.
