The Fire Marshal shall survey each building, lot, structure or business, except the interior of single-family dwellings, and shall specify what fire-detecting devices or -extinguishing appliances shall be provided therein. In special hazardous processes or storage, appliances of more than one type or special systems may be required.
A. 
Sprinkler systems.
(1) 
Every new building or structure exceeding 10,000 square feet in area within fire areas, fire walls notwithstanding, shall be protected throughout by an approved automatic fire sprinkler system.
(2) 
Every existing building or structure that is altered, modified or added to so that, when such alteration, modification or addition is completed, it will create a building or structure exceeding 10,000 square feet in area within fire areas, fire walls notwithstanding, shall be protected throughout by an approved automatic fire sprinkler system.
(3) 
The requirements of Subsection A(1) and (2) of this section, above, may be in addition to other fire-detecting, -extinguishing or control systems that may be required pursuant to applicable laws, rules or regulations.
B. 
Every building or structure that is not within the scope of Subsection A above shall be protected throughout by an approved fire-detection device or systems as specified by the Fire Marshal, in accordance with applicable laws, rules and regulations.
C. 
Emergency responder radio coverage system (ERRCS). New buildings shall have approved radio coverage for emergency responders within the building based on the existing coverage levels of the public safety communication systems utilized by the jurisdiction, measured at the exterior of the building. This section shall not require improvement of the existing public safety communication systems. Exceptions:

(1) 
Where approved by the Building Official and the Fire Code Official, a wired communication system in accordance with Section 907.2.12.2 of the Fire Code of New York State shall be permitted to be installed or maintained instead of an approved radio coverage system.
(2) 
Where it is determined by the Fire Code Official that the radio coverage system is not needed.
(3) 
In facilities where emergency responder radio coverage is required, and such systems, components, or equipment required could have a negative impact on the normal operations of that facility, the Fire Code Official shall have the authority to accept an automatically activated emergency responder radio coverage system.
Every hospital, nursing home, adult home, convalescent home, old-age home and other building or structure used for the inpatient care of or occupied by the sick, invalid, infirmed, disabled or convalescent persons shall be equipped with an approved automatic fire sprinkler system. This requirement shall be in addition to any other fire-detection or -extinguishing system required by law.

A permit shall be obtained from the Fire Prevention Division for the installation of any fire alarm, sprinkler or water-spray systems, emergency responder radio coverage system, or any other special fire-extinguishing or -detection systems that may be required under this article.

No fire alarm or -detection system, sprinkler or water-spray system, emergency responder radio coverage system, or any other special fire-extinguishing system installed pursuant to this section shall be deemed acceptable or approved for operation until an inspection of the same has been conducted by the Fire Prevention Division and an appropriate certificate of compliance of the same has been issued.
A. 
Sprinklers, standpipes, fire alarms, emergency responder radio coverage system, and other fire-protection or -extinguishing systems or appliances which have been installed pursuant to and in compliance with any permit or order or because of any law or ordinance shall be maintained in operative condition at all times.

B. 
It shall be unlawful for any owner or occupant to reduce the effectiveness of the protection so required, except that this shall not prohibit the owner or occupant from temporarily reducing or disconnecting the protection where necessary to make tests, repairs, alterations or additions. The Fire Prevention Division and Fire Department shall be notified before any tests, repairs, alterations or additions are started or the system is temporarily reduced of power or effectiveness.

All signs, accessways, exits, aisles, enclosures, stairways and all components thereof shall be marked, illuminated and maintained at all times in accordance with the appropriate standards of the NFPA.
Any building or structure or portion thereof occupied or used by persons for whom sleeping accommodations are provided therein, including single- and multiple-family dwellings, shall be protected by an approved automatic smoke-detection and alarm device located in or adjacent to all sleeping quarters or where otherwise specified by the Fire Marshal in accordance with applicable laws, rules and regulations.
A. 
Standard elevator key for Fire Department emergency services systems.
(1) 
All elevators in buildings more than 30 feet in height shall be equipped with a fire department emergency service system as required by 9 NYCRR § 1067.7(b).
(2) 
Any elevator equipped with a Fire Department emergency system shall be controlled with a key and lock cylinder which is to be designated by the Fire Prevention Division.

B. 
Standard key for Fire Department emergency access. All access gates to shopping centers, multiple-residential dwellings, places of public assembly and rights-of-way shall be controlled with a key and lock cylinder which is to be designated by the Fire Prevention Division.

C. 
The owner of any building or property covered by this section shall supply the fire district in which said building or property is located with a key as described in Subsections A and B above. In addition, said owner shall maintain the same key in an accessible location on or in said premises and shall notify, in writing, the local fire district of the location of said key.
D. 
The owner of any building or property covered by this section shall file with the Fire Prevention Division written proof of compliance with the requirements set forth above. Said proof shall be filed with the Fire Prevention Division no later than six months from the adoption of this chapter, and such owner shall file annual statements of compliance with the Fire Prevention Division on a form prescribed by the Fire Prevention Division.

E. 
This section of the chapter shall be effective upon adoption, but enforcement of this section's provisions shall be commenced six months from the effective date of adoption.
