For the purpose of this chapter, flammable liquids are classified
as follows:
A. Class I: liquids having a flash point below 25° F., closed-cup
tester. Examples of such are ether, gasoline, naphtha and benzol,
etc.
B. Class II: liquids having a flash point above that for Class I and
below 70° F., closed-cup tester. Examples of such are alcohol
and amyl acetate, etc.
C. Class III: liquids having a flash point above that for Class I and
Class II and below 200° F., closed-cup tester. Examples of such
are fuel oils and kerosene.
This article shall apply to all liquids with a flash point below
200° F. and to liquids with flash points above 200° F. which,
when heated, assume the characteristics of liquids with flash points
below 200° F.
Before any flammable liquid tank or piping is covered from sight,
the installation shall be inspected and approved by the Town of Smithtown.

The Fire Prevention Division shall prohibit the sale or use
of any heating, lighting or cooking appliance using flammable liquids
which have not been tested by Underwriters' Laboratories, Inc., or
some other competent authority, and found to have proper safeguard
protections against fire hazards.
A permit shall be obtained for storing, handling or using any
flammable liquid in excess of one gallon where such storage, handling
or use is for the purpose of sale or use in a business or commercial
activity, except that no permit shall be required for the storage
or use of flammable liquids in the fuel tank of a motor vehicle, aircraft,
motorboat, mobile power plant or mobile heating plant.
The storing, handling, using or dispensing of flammable and combustible liquids within the scope of Articles
X and
XI shall be in accordance with the appropriate standards of the NFPA.
The installation or use of coin-operated dispensing devices
for Class I flammable liquids is prohibited.
No delivery of any Class I or Class II flammable liquids shall
be made into portable containers unless the container is of sound
construction, has a tight closure with screwed or spring cover and
is fitted with a spout or so designed that the contents can be poured
without spilling and is Underwriters' Laboratories, Inc. listed for
the use it is actually used for.
