All permits issued by the Smithtown and St. James Water Districts for the consumption or use of water and the use of the facilities of the district are subject to cancellation, revocation or suspension by the Board of Commissioners without notice. In the event of such cancellation, revocation or suspension, the district may enter upon any premises whereon any of its facilities or property shall be located and, in its discretion, remove the same therefrom.

A. 
No person shall connect to, open or interfere with any fire hydrant or draw water therefrom without the written consent and approval of the Board of Water Commissioners or its designee, as provided herein, except that a Chief of the Fire Department or his authorized assistants may open or direct the opening of any fire hydrant in the event of a fire or for fire drill or tournament purposes. Whenever a hydrant has been so used, the Fire Department shall promptly notify the district of that fact.
B. 
Any violation of this section shall be punishable by a fine of $250 or 15 days in jail, or both.
C. 
Procedures and regulations.
(1) 
A permit is required for each vehicle to be connected to a hydrant.
(2) 
Application. An application shall be submitted for each vehicle to the water district, with the following information:
(a) 
The applicant's name.
(b) 
The address.
(c) 
The telephone number.
(d) 
The truck year and make.
(e) 
The truck license plate number.
(f) 
A description of the backflow prevention device.
(3) 
Connection to the hydrant must be by means of an approved adaptor and reducer fitting with a one-and-one-half-inch gate valve and followed by a double check valve (or other backflow-prevention device, as required) to which the hose will be connected. Hydrants are to be opened to their full capacity by use of a hydrant wrench on the operating nut, and the flow started and controlled by the one-and-one-half-inch valve. In no case shall a hydrant be used to fill a tank vehicle which may contain chemicals (such as tree sprayers or lawn fertilizers) without the use of a reduced pressure backflow preventer or permanently attaching piping with an air gap. Any evidence of damage arising out of the hydrant use authorized by this permit is to be reported to the Water District Foreman immediately.
(4) 
Check. A check in the amount of $62.50 for the first vehicle and $50 for each additional vehicle, made payable to the water district, must be submitted with each application.
(5) 
Inspection. Each vehicle must be inspected by the District Foreman or his delegated assistant.
(6) 
Permits will be issued to only those vehicles in compliance with the rules and regulations of the water district and other applicable rules and at the sole discretion of the Water District Foreman.
D. 
Permit in driver's possession. The driver of the vehicle must have the original hydrant permit in his or her possession at all times and present it to the water district personnel, Suffolk County police or New York State Department of Environmental Conservation Inspectors, village police and other authorized individuals upon demand.
E. 
Designated hydrant. The water district will designate on the hydrant permit the location of the hydrants permitted to be used. No other hydrants will be used.
F. 
Expiration dates of permits.
(1) 
Tree sprayers. All tree sprayers shall be issued seasonal hydrant permits for the time period from February 15 to November 30 in a given year.
(2) 
Other permits. All other hydrant permits shall be issued for a maximum period of 30 days.
(3) 
Permit fees shall not be prorated.
In the event that the supply of water to any premises shall be turned off for any reason, it shall not be turned on thereafter without the consent and approval of the Board or its authorized representative. In such event, the water may be turned on only by a duly authorized representative of the district after all charges, fees and penalties have been paid.
A. 
In the event of an emergency or whenever, in the opinion of the Chairman or Deputy Chairman of the Board of Commissioners, the water pressure or the supply of the water shall be reduced or is likely to be reduced so that the general welfare, health or safety is affected or is likely to be affected, the Chairman or Deputy Chairman of the Board of Commissioners may order and direct such curtailment of the use of water or facilities of the district as they may deem necessary. Notice of such order or direction curtailing the use of water may be given personally by any officer or employee of the district or by mail. Publication of such order or direction in the official newspaper of the district on one occasion shall be deemed due notice to all consumers of the district.
B. 
In the event that any consumer shall fail or refuse to comply with such order or direction after any of the notices heretofore provided shall have been given, he shall be subject to a civil penalty not to exceed the sum of $50 for each violation, payable to the district, and the water supply furnished to any such violating consumer may be discontinued until such penalty, together with all other charges, fees and deposits, shall have been paid.
In the event that any person shall violate the terms and provisions of this chapter or rules and regulations or amendments thereto or of the directions or requirements of the Board relating to the use of the supply of water, he may be liable to the district for a civil penalty not to exceed the sum of $50 for each violation. In the event that such person shall be a consumer, all service to him may be cut off and discontinued and shall not be restored until such penalty, together with all other costs, charges and deposits, shall have been paid.
A. 
No attachments shall be made to any facility connected to the water mains of the Smithtown and St. James Water Districts until such attachment and other accessory facilities have been approved by the Board of Commissioners or its duly authorized representative. In all cases where there is a possibility of back siphonage, an approved vacuum breaker and check valve shall be installed in such manner as prescribed by the district.
B. 
No water shall be introduced into any such attachments until an inspection by the district shall have been made.
