The Township of Marple and the Township of Newtown hereby establish
a joint recreation commission which shall be known as the "Marple-Newtown
Leisure Services Commission" (hereinafter referred to as the "Commission").
A. Said Commission shall consist of nine members, with three to be appointed
by the Commissioners of Marple Township, three to be appointed by
the Supervisors of the Township of Newtown and three to be appointed
by the Board of Directors of the Marple-Newtown School District. The
Township of Marple shall appoint to the Commission one of the Township
Commissioners, and two persons shall be selected at large. The Township
of Newtown shall appoint to the Commission one of the members of the
Board of Supervisors of the Township and shall appoint two persons
at large. The Marple-Newtown School District shall appoint to the
Commission one of its members and one person each from the Township
of Marple and the Township of Newtown. Initially each of the parties
hereto and the Marple-Newtown School District will each appoint one
member to serve on the Commission for one year, one member to serve
for two years and one member to serve three years, with all successive
appointments to be made for a three-year term.
B. No compensation shall be paid to the appointed members of the Recreation
Commission, but such members shall be entitled to receive traveling
and other necessary expenses actually incurred in the performance
of their duties.
The Leisure Services Commission herein established will be subject
to the following rules and regulations:
A. The members of the Commission shall annually elect their own Chairman
and select all other necessary officers, who shall serve for a period
of one year from January 1 to December 31.
B. The Commission shall meet monthly at a time and place established
by it and at such other times as the Chairman may elect to call a
meeting.
C. All meetings of the Commission shall be open to the public, and all
records kept shall be public records.
D. The Commission shall have the power and authority to adopt rules
and regulations for the conduct of all business within its jurisdiction.
E. Any Recreation Director employed by the Commission shall automatically
serve as the Secretary thereof.
F. All decisions of the Commission shall be by a majority vote of those
present. A quorum shall exist when six members are present.
The nature and scope of activities of the Commission hereby
established is the planning, administration, supervision, regulation
and operation of cooperative recreation service and programs within
the Townships of Marple and Newtown for the use and benefit of the
residents thereof of all ages.
It shall be the duty of the Commission and its Director to submit
an annual report to the Commissioners and Supervisors of the participating
townships, including an analysis of the community recreation areas,
facilities and leadership, with particular reference to the extent
and adequacy of the program and its effectiveness in view of the public
expenditure involved and the public needs to be met.
The Commission shall establish standards, qualifications, classifications
and salary schedules of recreation employees.
The Leisure Services Commission, subject to the conditions herein
expressed, shall have jurisdiction and power to:
A. Select, employ and discharge a Recreation Director, whose appointment
and discharge shall further be subject to the approval of the Commissioners
of the Township of Marple and the Board of Supervisors of the Township
of Newtown.
B. Select, employ and discharge recreation personnel and such other
personnel as may be required for its operation.
C. Purchase personal property and materials, subject to applicable public
bidding requirements, as may be required for the efficient functioning
of its activities.
The Recreation Commission shall, no later than October 15 of
each and every year, recommend an annual budget governing expenditures
for the following fiscal year for salaries of personnel, materials,
supplies, insurance and purchased services, for submission to and
approval by each of the parties hereto. Thereafter, no budget item
may be exceeded by the Commission without approval of both parties
hereto.
The use of land, buildings and/or other facilities owned by
a party to the agreement creating the joint Commission for a program
approved by it shall not result in a fee charge to the Commission
except for an agreed upon rental or service charge which has been
agreed to by both parties to the agreement.
Either Marple or Newtown may provide payroll and bookkeeping
services for the Commission and may maintain all funds of said Commission,
which shall be subject to the control of the Treasurer of the Township
of Marple. Either Township may, in its discretion, charge a reasonable
sum of money for such payroll and bookkeeping services as may be agreed
by both townships, which charge shall be set forth in the annual budget
of the Leisure Services Commission.
All expenses of the Commission incurred by the administration,
supervision, regulation and operation of parks, recreation areas and
facilities and for the programs thereof shall be shared by the Townships
of Marple and Newtown each calendar year on the basis of the ratio
of assessed valuation of real property of each municipality to the
combined total of both.
The Leisure Services Commission shall be eligible to receive,
on behalf of the participating townships, any gifts or contributions
and will be responsible for carrying out the terms of any agreement
between the participating townships and the Marple-Newtown School
District that may be in effect from time to time with regard to contribution
of its funds and use of school property.
The Commission will recommend insurance necessary to protect
the participating townships and owners of any property not owned by
the townships from liability for personal injury or property damage
or vandalism and malicious mischief to such property arising out of
use of property by the Commission.

Pursuant to the Pennsylvania Second Class Township Code, 53
P.S. § 67204, there is hereby created a Parks and Recreation
Board for the Township of Newtown, Delaware County, Pennsylvania.
The Parks and Recreation Board shall consist of seven members,
to be appointed by the Board of Supervisors as hereinafter provided,
all of whom shall be residents of The Township of Newtown, Delaware
County, Pennsylvania.
Members of the Parks and Recreation Board shall serve a term
of five years or until their successors are appointed; provided, however,
that members of the Parks and Recreation Board first appointed shall
be appointed such that the terms of not more than two members shall
expire annually thereafter in accordance with the following appointment
schedule. Each term of each appointment listed below shall be effective
January 1, 2012, and each member shall remain on the Board until his/her
successor is appointed.
A. Two members shall be initially appointed for a term of two years;
and
B. Two members shall be initially appointed for a term of three years;
and
C. Two members shall be initially appointed for a term of four years;
and
D. One member shall be initially appointed for a term of five years.
All members of the Parks and Recreation Board shall serve without
pay but shall be eligible for reimbursement of any necessary expenses
incurred with the prior approval of the Township Manager.
All members of the Parks and Recreation Board shall serve their
full terms except in the event of death, voluntary resignation or
removal by the Board of Supervisors for dereliction or neglect of
duty. Vacancies occurring in the membership of the Parks and Recreation
Board other than by expiration of the term shall be for the unexpired
term and shall be filled in the same manner as original appointments.
The Parks and Recreation Board shall regularly evaluate all
parks and recreation programs and facilities within the Township and
make recommendations to the Township Manager and Board of Supervisors
regarding regulating, equipping, operating and maintaining the parks,
recreation areas and facilities of the Township as well as the purchase
of land for parks and recreation use.
The members of the Parks and Recreation Board shall elect their
own Chairman, Vice Chairman and Secretary, and they shall select all
other necessary officers to serve for a period of one year. The annual
reorganization of the Parks and Recreation Board shall occur promptly
after the annual reorganization of the Township Board of Supervisors.
The Parks and Recreation Board may adopt rules and regulations for
the conduct of its own business within its jurisdiction.
The Parks and Recreation Board shall submit an annual report
to the Township Board of Supervisors annually, including an analysis
of community recreation programs, areas, facilities and leadership,
with particular reference to the extent and adequacy of programs and
their effectiveness in view of the public expenditures involved and
the public needs to be met.
The Parks and Recreation Board is not be authorized to make
purchases or otherwise expend money to implement the provisions of
this article and any other applicable laws and regulations unless
expressly authorized by the Township Board of Supervisors.
