Pursuant to the provisions of Article 8 of the Environmental
Conservation Law of the State of New York, the Town of Smithtown hereby
adopts the following fee schedule to be paid by applicants to the
Town of Smithtown for determination of significance review and the
preparation and/or review of environmental impact statements when
the same are required pursuant to the provisions of SEQRA (State Environmental
Quality Review Act). Such fees shall be required in addition to any
other fee due and payable to the Town of Smithtown in regard to such
applications or petitions. The fees under this chapter may be changed
from time to time by resolution of the Town Board.

The following fee schedule shall be adhered to and such payment
shall be made by applicants to the Town of Smithtown for preliminary
environmental assessments and review of applications, and the preparation
or review of environmental impact statements pursuant to the provisions
of SEQRA:
A. Preliminary environmental assessments and review of applications.
(1) Residentially zoned land subdivision applications.
(a)
Applications involving up to but less than one acre: $1,675.
(b)
Applications involving one or more acres, but less than four
acres: $2,300.
(c)
Applications involving four or more acres, but less than seven
acres: $2,850.
(d)
Applications involving seven or more acres, but less than 10
acres: $4,400.
(e)
Applications involving 10 or more acres: $6,250.
(2) Commercially or industrially zoned land subdivision applications.
(a)
Applications involving up to but less than two acres: $2,300.
(b)
Applications involving two or more acres, but less than five
acres: $2,850.
(c)
Applications involving five or more acres, but less than 10
acres: $4,400.
(d)
Applications involving 10 or more acres: $6,250.
(3) Site plan approval applications.
(a)
Applications involving modifications to existing facilities
which will result in the addition of less than 1,000 square feet of
floor space or paved area: $1,675.
(b)
Applications involving up to but less than one acre: $1,675.
(c)
Applications involving one or more acres, but less than two
acres: $2,300.
(d)
Applications involving two or more acres, but less than five
acres: $2,900.
(e)
Applications involving five or more acres, but less than 10
acres: $4,400.
(f)
Applications involving 10 or more acres but less than 25 acres:
$6,250.
(g)
Applications involving 25 acres or more: $10,250.
(4) Site
plan exemptions.
(a) Any site plan exemption: $800.
(5) Change of zone and special exception petitions.
(a)
Petitions involving up to but less than one acre: $1,700.
(b)
Petitions involving one or more acres, but less than two acres:
$2,300.
(c)
Petitions involving two or more acres, but less than five acres:
$2,900.
(d)
Petitions involving five or more acres, but less than 10 acres:
$4,400.
(e)
Petitions involving 10 or more acres, but less than 25 acres:
$6,250.
(f)
Petitions involving 25 acres or more: $10,250.
(6) All other petitions and/or applications involving land use.
(a)
Petitions and/or applications involving up to but less than
two acres of residentially zoned land: $110.
(b)
Petitions and/or applications involving two or more acres of
residentially zoned land: $175.
(c)
Petitions and/or applications involving up to but less than
one acre of nonresidentially zoned land: $110.
(d)
Petitions and/or applications involving one or more acres, but
less than two acres, of nonresidentially zoned land: $175.
(e)
Petitions and/or applications involving two or more acres, but
less than five acres, of nonresidentially zoned land: $375.
(f)
Petitions and/or applications involving five or more acres of
nonresidentially zoned land: $800.
B. Environmental impact statement review, in-depth review and SEQRA
coordination:
(1) Residentially zoned land subdivisions:
(a)
Proposals involving less than 10 acres: $32,000.
(b)
Proposals involving 10 or more acres, but less than 20 acres:
$42,000.
(c)
Proposals involving 20 or more acres: $47,000 plus $2,100 per
acre for each acre or fraction thereof over 20 acres.
(2) Commercial and industrially zoned land subdivisions, applications
for site plan approval, change of zone and special exception petitions:
(a)
Proposals involving less than 10 acres: $32,000.
(b)
Proposals involving 10 or more acres, but less than 15 acres:
$42,000.
(c)
Proposals involving 15 or more acres: $47,000 plus $2,100 per
acre for each acre or fraction thereof over 15 acres.
