When the Municipal Clerk, as custodian of records under the
statute, anticipates that the reproduction costs associated with the
government records request will cost in excess of $5 to reproduce,
the Municipal Clerk may require a deposit against the costs for reproducing
such documents sought through an anonymous request.
Under special circumstances, when reproduction of the government
record(s) requested involves an extraordinary expenditure of time
and effort to accommodate the request, the Municipal Clerk may, in
addition to the actual cost of duplicating the record, impose a special
service charge in the amount of $20/hour that any municipal official
or employee must dedicate to fulfill the record request. The Municipal
Clerk shall estimate the special service charge in advance of reproduction
and notify the requestor, in writing, before completing the request.
