The following rules and regulations are hereby established to govern the proper use of the recreational area of the City of Port Republic, and it shall be unlawful for any person to violate any such rule or regulation:
A. 
No person shall consume any alcoholic beverages nor shall any person have in his possession an open bottle, can, container or receptacle which contains or recently contained alcoholic beverages in the recreational area of the City of Port Republic.
B. 
No camping shall be permitted in the recreational area at any time.
C. 
No person shall build, start or maintain a fire within the recreational area.
D. 
No person shall discharge any firearm or pistol, or discharge any fireworks or weapon, nor shall any person discharge any bow and arrow within the recreational area.
E. 
No person shall place or use any boats, vessel, surfboard or any fiberglass or wooden object, other than inflatable or floatable boards using muscle power, in the waters designated for use for bathers adjacent to the recreational area.
F. 
No person shall launch any boat of any kind from the beach or from the entrance to the swimming area in the City of Port Republic.
G. 
No person shall take or use any moped, motorized bike, automobile truck or motor vehicle of any description within the recreational area, except in those areas specifically designated as roadways or those areas specifically designated for parking within the recreational area.
H. 
Nude bathing is hereby prohibited in the recreational area.
I. 
No person shall do any flagrantly lewd or offensive act within the recreational area which he knows or reasonably expects is likely to be observed by other persons who would be affronted or alarmed.
J. 
No person shall cause to be made, directly or indirectly, any noise emanating from the recreational area between the hours of 10:00 p.m. and 6:00 a.m., prevailing time, which is plainly audible at a distance of 50 feet from the source of the noise.
K. 
No person shall take upon the recreational area any glass container of any size or description unless said glass container remains inside a motor vehicle.
L. 
No person shall deposit or leave any cans, ashes, paper or other refuse within the recreational area, except in those containers specifically provided and designated for such use.
M. 
No person shall pick, cut, break, dig up or in any way mutilate, injure or damage any of the trees, shrubs, grass, plants, railings, seats, fences, structures or any other object within the recreational area.
N. 
No person owning or having custody, possession or control of any dog or animal, at anytime, shall take, allow or permit said dog or animal in or on the beach of the City of Port Republic.
O. 
No person shall peddle, solicit, distribute, sell or offer for sale any merchandise, printed material or services within the recreational area, except pursuant to a license or lease issued for such purposes by the City of Port Republic to a nonprofit corporation or association.

P. 
No person shall change clothes, dress, undress or otherwise disrobe, except outer wraps, in any recreational area.
Q. 
No person shall fail to obey any order, direction, whistle or other signals used by the lifeguards or authorized beach attendants.
R. 
No person shall fish or crab from the beach area or in the waters designated for bathing and swimming.
S. 
No person shall swim or bathe in any area other than the designated beach area. No person shall swim or bathe in the designated beach area between the hours of 10:00 p.m. and 6:00 a.m., prevailing time.

T. 
No person shall enter upon any of the municipal docks except with the permission of the lessee or a person authorized by the City of Port Republic to extend permission to enter upon said docks.
U. 
No person shall knowingly have in his possession any sharp object under circumstances not manifestly appropriate for its lawful use.
V. 
No person shall enter onto the bulkhead located off Mill Street in Tax Block 29, Lot 7. Violation of this regulation will result in a minimum fine of $2,000.

No persons shall be permitted in those public recreational areas, which areas are particularly described in the Municipal Code, City of Port Republic, New Jersey, § 201-1 et seq., between 10:00 p.m. and 5:00 a.m.

A. 
A paid beach and recreational facilities are hereby established in the City of Port Republic for the public health, recreation and entertainment.
B. 
Such beach shall be designated as all City property located fronting on the Nacote Creek and from Park Avenue on the east to Mill Street on the west.
C. 
Such recreational facilities shall be designated as the tennis courts and boat ramp located adjacent to Park Avenue.
D. 
In order to assist in providing the necessary funds to improve and maintain the beaches and recreational facilities, the following fees shall be charged for such beach:

(1) 
No fees shall be charged to or collected from any person under the age of 12 years.
(2) 
Five dollars per person per season, provided that application is made to the proper authorities on or before the last Friday before Memorial Day of each year.
(3) 
Twenty-five dollars per person per season, in the event that application is made to the proper authorities subsequent to the last Friday before Memorial Day of each year.
(4) 
Ten dollars per person per week for any week or fractional part thereof. Weekly badges shall be valid from 12:00 noon, Saturday, until the following Sunday.
(5) 
Three dollars per person per day for any day or fractional part thereof. Daily badges shall be valid from 10:00 a.m. to 6:00 p.m.
E. 
No person over the age of 12 years shall bathe at or otherwise use the beaches or recreational facilities set forth in Subsections A and C without having first acquired and then having in his or her possession a proper and effective badge, license or permit to use the beach and recreational facilities, which shall be worn conspicuously by such person during said use so that it shall be visible at all times and which shall be exhibited on demand to the beach attendant or other duly authorized representative of the City of Port Republic.
F. 
The City Council is hereby authorized and empowered to:
(1) 
Adopt by resolution, in addition to the rules and regulations herein enumerated, such other rules and regulations as may be necessary for the proper control and regulation of the recreational facilities, beachfront and the waters adjacent thereto.
(2) 
Determine and establish by resolution the period during each year and day when the paid bathing beach and recreational facilities shall be opened and closed.
(3) 
Employ attendants, lifeguards and such other employees as may be necessary to carry out and enforce the provisions of this chapter and all rules and regulations established herein or subsequently adopted by resolution.
(4) 
Purchase badges, checks or other insignia and such other supplies, materials and equipment as may be necessary.
G. 
The City of Port Republic reserves the right to revoke any beach and recreation facility privileges granted under this chapter for any violations of its provisions or other rules and regulations, and to retake and impound any identification badge or permit which has been improperly used or obtained. Such revocation shall not preclude the imposition of any other penalties provided for such violation.
H. 
Senior citizens, nonresidents and military persons.

(1) 
Definitions. As used in this section, the following terms shall have the meanings indicated:
IMMEDIATE FAMILY
Spouse and children.
SENIOR CITIZEN
A person who is 65 years old or more.
VALID IDENTIFICATION
A current driver's license, current passport or any similar county-, state- or federal-issued identification card that provides the person's date of birth and residence.
(2) 
Residents of the City of Port Republic who are senior citizens shall not be charged a fee. Resident senior citizens may obtain a badge by providing valid identification to the City Clerk.
(3) 
For nonresident senior citizens 65 years and older, the usage fee shall be $10 per nonresident senior citizen per season from May 1 until Friday before Memorial Day and $15 per nonresident senior citizen per season after the Friday before Memorial Day. The badges shall be valid from 10:00 a.m. to 6:00 p.m. Nonresident senior citizens may obtain a badge by providing valid identification to the City Clerk.

(4) 
An active-duty military service person and his or her immediate family shall not be charged a fee. A person may obtain a badge by providing valid identification that either he or she is an active-duty military service person or is an immediate family member of an active-duty military service person.

The following fees shall be deposited by any person desiring to use any recreation area maintained by the City of Port Republic for a designated period of time, including, but not limited to, the Harry Bowen Ball Field Gazebo, Harry Bowen Ball Field Pavilion, Preservation Park Gazebo, City Beach, or any other recreational facility:
A. 
Event usage fee:
(1) 
Up to 50 people: $100.
(2) 
Up to 150 people: $200.
B. 
Deposit fee (to be submitted in check form only and to be returned if the area is left in its original state):
(1) 
Up to 50 people: $50.
(2) 
For 51 to 150 people: $75.
As used in this article, the following terms shall have the meanings indicated:
RECREATIONAL AREA
Includes the beach, parking lots, Mill Pond, Firemen's Pond, tennis court, basketball court, volleyball court, baseball diamond, boat launch area, fishing-crabbing-bulkhead area, Revolutionary War Cemetery and any other areas which may be identified as recreational areas by resolution of the governing body of the City of Port Republic.
The City Council of Port Republic is hereby authorized to waive by resolution any requirement of this article, but any such resolution shall specifically designate those sections of this chapter which are intended to be waived by said resolution.

Any person violating any of the provisions of this article shall, upon conviction, at the discretion of the court, be subject to:
A. 
A fine of not more than $2,500;
B. 
Imprisonment for not more than 90 days;
C. 
Payment of restitution in an amount in the discretion of the court; and/or
D. 
Community service in the discretion of the court.

There is hereby established a dog exercise area within the City of Port Republic on Block 33, Lot(s) 1.
The Council for the City of Port Republic is hereby authorized and empowered to adopt by resolution rules and regulations as may be necessary for the proper control and regulation of the dog exercise area and the lands adjacent thereto.
A yearly fee of a paid dog license from the City of Port Republic per dog must be paid prior to the issuance of a dog park permit.
Any person who violates any section of this article or any rules or regulations promulgated hereunder may be subject to a fine of up to $1,000, imprisonment up to 90 days, the loss of the privilege to use the dog exercise area and/or community service up to 90 days in the discretion of the Municipal Court Judge.
