Any in-ground swimming pool located in the Town of Hopedale shall be enclosed by a fence or other suitable barrier, at least five feet high, and entrance to the pool shall be through doors or gates capable of being locked when the pool is not in use. "Suitable" shall mean in the opinion of the Building Commissioner.
Any aboveground swimming pool located in the Town of Hopedale which is not fenced in shall provide a means, approved by the Building Commissioner, whereby the ladders, stairs or other means of entrance are raised, removed or locked when the pool is not in use.
This bylaw shall apply to all swimming pools in the Town of Hopedale whether or not they were installed prior to the date of this bylaw. This bylaw shall be enforced by the Building Commissioner. No permit shall be issued for the installation of a swimming pool unless it complies with this bylaw.
The owner of the real estate in which the pool is located shall be responsible for compliance with this bylaw, and subject to the penalties for any violation.
