The Council shall appoint a Borough Manager for an indefinite
term and shall fix his compensation. The Borough Manager shall be
appointed solely on the basis of his executive and administrative
qualifications. He need not be a resident of the Borough at the time
of his appointment. He must become a Borough resident within one year.

The Council may remove the Borough Manager at any time with
cause.
During the period of any vacancy in the office of Borough Manager
or during the period of his absence or incapacity, the Council may
appoint any one of its own members or any other officer or employee
of the Borough as Acting Borough Manager. The Acting Borough Manager
shall then exercise the powers and perform the duties of the Borough
Manager and receive compensation at a rate to be set by Council.
The Borough Manager shall be the chief administrative officer
of the Borough. He shall be responsible to the Council for the administration
of all Borough affairs placed in his charge by order under this Charter.
A. He shall supervise and be responsible for the activities of all municipal
departments.
B. He shall have full charge and control of the Police Department and
all police activities both inside and outside the Borough.
C. He shall have the power to recommend for appointment, promotion or
discharge all police officers of the Borough as well as all auxiliary,
temporary police and school crossing guards.
D. He shall have the authority to suspend for cause any police officer
subject to § C-73 of this Charter.
E. He shall have the authority to recommend for appointment the Chief
of Police, but Council shall have sole authority to appoint the Chief
of Police, who shall serve at the pleasure of Council.
F. He shall hire, suspend or discharge all other employees under his
supervision, and he shall report at the next meeting of the Council
any action taken by authority of this subsection.
G. He shall prepare and submit to the Council a budget for the next
fiscal year and an explanatory budget message. In preparing the budget,
the Borough Manager or an officer designated by him shall obtain from
the head of each department, agency, board or officer estimates of
revenues and expenditures and other supporting data as he requests.
The Borough Manager shall review such estimates and may revise them
before submitting the budget to the Council.
H. He shall be responsible for the administration of the budget after
its adoption by the Council.
I. He shall perform the duties of the Secretary of the Borough in causing
appropriate records to be made, preserved and certified, as required
by law or action of the Council. He shall attest the execution of
all documents and record all ordinances and resolutions, and he shall
have custody of the Municipal and Corporate Seal. He shall, where
required, acknowledge and execute documents as Secretary of the Borough.
J. He shall attend all meetings of the Council and may attend meetings
of committees thereof. He shall have the right to take part in the
discussions, but shall have no vote.
K. He shall prepare the agenda for each meeting of the Council and supply
the facts pertinent thereto and shall see that the agenda is available
in the Borough offices at least 24 hours before the meeting.
L. He shall keep the Council informed as to the conduct of the Borough
affairs, submit periodic reports on the condition of the Borough finances
and such other reports as the Council requests and make such recommendations
to the Council as he deems necessary.
M. He shall submit to the Council, as soon as possible after the close
of the fiscal year, a complete report on the financial and administrative
activities of the Borough for the preceding year.
N. He shall see that the provisions of all franchises, leases, permits
and privileges granted by the Borough are observed and report any
violation thereof to the Council.
O. He may employ, by and with approval of the Council, experts and consultants
to perform work and to advise in connection with any of the functions
of the Borough.
P. He shall attend to the letting of contracts in due form of law and
shall supervise the performance and faithful execution of the same,
except insofar as such duties are expressly imposed upon some other
Borough officer.
Q. He shall see that all money owed the Borough is promptly paid and
the proper proceedings are taken for the security and collection of
all the Borough's claims.
R. He shall be the purchasing officer of the Borough, and he shall purchase
all supplies and equipment for the various agencies, boards, departments
and other offices of the Borough. He shall keep an account of all
purchases and shall, from time to time or when directed by the Council,
make a full written report thereof. He shall also issue rules and
regulations, subject to the approval of the Council, governing the
requisition and purchasing of all municipal supplies and equipment.
S. He shall be responsible for investigating and handling all complaints
regarding services or personnel of the Borough and shall report thereon
to the Council. All complaints concerning the Police Department shall
be referred to the Chief of Police.
T. He may collect and shall receive, account for and deposit into the
Borough account all taxes, fees, assessments or charges that are levied
or established by the Borough for general or special purposes. Such
deposits shall be made not later than the first business day following
the day in which they are received. If a school district or any other
taxing body empowered to collect taxes within the Borough enters into
an agreement with the Borough for the collection of said taxes, he
shall be responsible for collecting these taxes; however, all fees
for such collection shall be paid to the Borough accounts.
U. He shall administer and enforce all laws and ordinances of the Borough,
except as otherwise provided by this Charter or by law, and shall
be responsible to the Council for carrying out all policies established
by it for the proper administration of all affairs of the Borough
within the jurisdiction of the Council.
V. He shall not be entitled to any compensation in addition to his stated
compensation for exercising any power or duty conferred upon him by
this Charter or by law.
W. He shall perform such other duties as are specified in this Charter
or may be required by the Council.
