The number of Council members, their terms, election and qualifications and the filling of the Council vacancies shall be as provided in the Charter.
A. 
The day, time and place of the organization meeting of the Council shall be as provided in the Charter.
B. 
The first order of business shall be the election of a Vice President of the Council and such other officers required by the Charter or as the Council may deem appropriate.
C. 
In the absence of the President, the Vice President shall exercise the duties of the President. In the absence of both the President and the Vice President at any meeting, the Council shall appoint a President Pro Tem who shall have all the powers of the President for that meeting.
A. 
Public notice. Provisions governing public notice of meetings shall be as provided by the Charter.
B. 
Regular meetings. It shall be the duty of the Council to meet statedly at least once a month at 7:30 p.m. on the second Monday of each month at the municipal building or at such other time and place as the Council may, from time to time, designate.
C. 
Special meetings. Special meetings may be called by the President of the Council at any time, and a meeting must be called upon the written request of at least three members of the Council. A written or telephone notice shall be delivered to each Council member at least 24 hours before a special meeting is held. Such notice shall specify the time and place of the special meeting and the business to be transacted.
D. 
Emergency meetings. The Council may hold and take action at an emergency meeting at any time. Such emergency meetings may be called by the Mayor, Borough Manager or by any member of Council, provided that a quorum five is present, as provided in the Charter, and that a majority of the Council five determines that the holding of such meeting and the taking of emergency action at that time is necessary to protect or promote the public health and safety.
E. 
Executive sessions. The Council may hold executive sessions, as permitted by § C-19 of the Charter. Executive sessions will always be in conjunction with a regular, special or emergency meeting. No official action shall be taken by the Council on any matter in executive session.
F. 
Workshops. The President of the Council or Borough Manager may call a workshop at any time to provide information or to review draft plans, ordinance codes, etc. No official action can be taken at these sessions.
G. 
Special provisions. At any regular, adjourned or special meeting of the Council at which a quorum is not present, those members present shall instruct the Borough Manager to notify, in writing, those members absent from said meeting and not previously excused of the time and place of the next scheduled meeting of the Council. Any member absent from said next scheduled meeting shall, unless excused by resolution enacted by those present, pay to the municipality the sum of $75, which shall be collected by the Borough by deduction from the next salary payment to said absent member. The Borough Manager shall notify the Payroll Section of such absence and instruct the Clerk to make such deduction.
All meetings of the Council shall be open to the public as provided by law.
A. 
The proposed agenda for any meeting of the Council shall be prepared by the Borough Manager in consultation with the President.
B. 
The proposed agenda for any stated meeting shall be forwarded to all members of the Council and be available to the public at least 24 hours prior to the stated monthly meeting. In addition, the agenda for the stated monthly meetings, adjourned monthly meetings, special meetings and, where possible, emergency meetings shall be posted in the municipal building.
C. 
The title of any ordinance or resolution to be considered shall be published as part of the agenda.
D. 
The published agenda may be amended at the meeting by a majority of the members present, plus one. No matters other than those on the agenda as amended shall be acted upon by the Council.
E. 
Supporting materials, including the full text of any ordinances or resolutions to be considered, will be provided to members of the Council and will be available in the office of the Borough Manager to the public. The materials are to be available at least 24 hours prior to the regular meeting, and upon request, copies can be reproduced at a reasonable fee.
A. 
At the time appointed for any meeting of the Council, the President shall take the Chair and call the meeting to order. If a quorum is present, as provided in the Charter, the President shall proceed with the order of business prescribed for the meeting. If, upon the call of the roll, a quorum is not present, the President shall order a recess for a period of 30 minutes, and if a quorum has not developed by that time, the President shall declare the meeting adjourned.
B. 
Unless a majority of the Council votes otherwise, the order of business for each regular meeting shall be as follows:
(1) 
Call to order.
(2) 
Roll call.
(3) 
Approval of the minutes of the previous meeting.
(4) 
Reports of municipal officials, committees or special advisory groups.
(5) 
Unfinished business.
(6) 
New business.
(7) 
Public participation.
(8) 
Adjournment.
C. 
If the Mayor or the Borough Manager shall request to address the Council, this shall be permitted immediately following the approval of the minutes of the previous meeting. If a delegation of residents has given due notice, the President of the Council may invite them to present their business to the Council immediately following the roll call or the approval of the minutes. If there is an item of obvious controversy or of wide public concern that has brought an overflow crowd to the meeting, the presiding officer has the authority to enter that item as the first item of new business (or unfinished business) on the agenda.
A. 
The presiding officer shall be responsible for the orderly conduct of business at each Council meeting and shall preserve order and decorum at such meetings.
B. 
The Council, at its organization meeting, shall adopt rules governing its procedure. The presiding officer shall announce all decisions of the Council and shall decide all questions of order without debate; subject, however, to an appeal by any Council member. Any ruling by the presiding officer may be overruled by a majority of the members present.
C. 
Every member of the Council desiring to speak shall address the Chair and, upon recognition by the presiding officer, shall confine remarks to the question under debate, avoiding all indecorous language or reference to personalities. A member of the Council, once recognized, shall not be interrupted when speaking, unless it be for the purpose of calling such person to order. If a member of the Council, while speaking, is called to order, that person shall cease speaking until the question of order is determined. When two or more members request the floor at the same time, the presiding officer shall name that one entitled to the floor.
D. 
The roll of members shall be called by rotating the order, except that the President shall be called last.
E. 
No member of Council shall speak more than 10 minutes upon the same motion in the same meeting nor for more than five minutes at a time without the consent of the majority of the Council members present.
A. 
Residents of the Borough of Tyrone desiring to place an item on the agenda at its stated meetings may do so by providing written notice to the Borough Manager on the subject matter to be discussed at least three days prior to the day of the meeting.
B. 
A resident shall be provided the opportunity to address the Council on any agenda item without written notice. The presiding officer shall limit the time each person shall speak, giving equal time to all. Such discussion shall occur prior to the vote on the agenda item.
C. 
When a group or person wishes to address the Council on the same subject matter, it shall be proper for the presiding officer to request that a spokesperson be chosen by the group to address the Council and to limit the number of persons addressing the Council on the same matter so as to avoid unnecessary repetition.
D. 
Any citizen may provide comments to the Council during the allotted public participation segment of the meeting.
E. 
Any person who makes offensive, insulting, threatening, insolent, slanderous or obscene remarks or who becomes boisterous or who makes threats against any person or against public order and security while in the Council chamber shall be forthwith barred by the presiding officer from further audience at the meeting, unless permission to continue is granted by the majority vote of the Council members present.
The Council may, at any time, provide for standing and ad hoc committees to assist with the carrying out of its function. The presiding officer shall appoint the Chairperson for each such committee. Each committee so designated by the Council shall provide for written rules governing its procedure. Any such committee appointed by the Council shall, thereafter, report to the Council at the regular stated meetings of that body.
Official actions of the Council shall be taken by ordinance, resolution or motion, as provided in the Charter.
A. 
Action requiring an ordinance. Each of the 14 requirements provided in § C-25 of the Charter shall be by ordinance.
B. 
Ordinance form and procedure.
(1) 
Every proposed ordinance shall be introduced in writing and in the form required for final adoption. No ordinance shall contain more than one subject which shall be clearly expressed in its title. The enacting clause of all ordinances shall be: "The Borough of Tyrone hereby ordains:." Any ordinance which repeals or amends an existing ordinance shall set out in full the ordinance, sections or subsections to be repealed or amended and shall indicate matter to be omitted by enclosing it in brackets or by strike-out type and shall indicate new matter by underscoring or by italics.
(2) 
An ordinance may be introduced by any member of the Council at any stated monthly or special meeting of the Council. Upon introduction of any ordinance, a copy shall be distributed to each Council member and to the Borough Manager, and a reasonable number of copies shall be filed in such other public places as the Council may designate.
C. 
Ordinance requiring prior public notice and hearing. No final action shall be taken on the types of ordinances and amendments set forth in § C-29 of the Charter without public hearing thereon and at least 14 days' published public notice.
D. 
Copies of ordinances. Copies of ordinances shall be available to all persons requesting them upon payment of a reasonable reproduction charge.
E. 
Emergency ordinances shall be as prescribed in § C-36 of the Charter.
F. 
Codes of technical regulations shall be as prescribed in § C-37 of the Charter.
G. 
Veto; authentication and recording.
(1) 
Veto. The Mayor may veto any ordinance passed by Council. To override a veto, the Council must have a 2/3 majority [five votes].
(2) 
Authentication. Ordinances duly approved and signed by the President of the Council shall be attested to by the Borough Manager.
(3) 
Recording. Recording and indexing all ordinances and resolutions adopted by the Council shall be in accordance with § C-34 of the Charter.
A. 
The Council shall provide for an independent postaudit as provided for in § C-89 of the Charter. The Council may designate such accountant or firm annually or for a period not exceeding three years, provided that the designation for any particular fiscal year shall be made no longer than 30 days after the beginning of such fiscal year.
B. 
The Council shall, within 45 days after presentation of the audit at a Council meeting, publish a statement setting forth the municipality's financial condition and the date the independent auditor's report was filed with the Council.
Provisions as to salary and expense reimbursement shall be as provided in the Charter and by ordinance. Members of the Council shall receive no other compensation, direct or indirect, for the performance of their duties. However, nothing in this section shall preclude the right of the municipality to provide accident or liability insurance coverage for members of the Council when on municipal business or when in the performance of their official duties, limited to the duration of their term. Members of the Council shall be entitled to reimbursement for actual expenses incurred, provided that the expenditure:
A. 
Is related to the performance of official duties;
B. 
Was authorized in advance by the Council at a public meeting; and/or
C. 
Is included in an itemized list presented prior to payment.
The appointment, supervision, tenure and duties of the Borough Manager shall be as provided in the Charter and/or an appropriate employment agreement. Under special circumstances, to be determined by resolution, the Council may employ the services of legal counsel and such other staff as it deems appropriate.
