In order to facilitate the movement of traffic and to combat the hazards of snow and ice on the snow emergency routes named in § 190-39 of this article, the Mayor, in his or her discretion, may declare a snow and ice emergency (designated in this article as a "snow emergency"). Information on the existence of a snow emergency may be given by the Borough through radio, newspaper or other available media, and information on the termination of the emergency may be given by use of the same media.
A. 
During a snow emergency which is hereby defined as being a snowfall of three inches in depth or more, occurring between the first day of November and the first day of May of the following year, parking of vehicles on any snow emergency routes named in § 190-39 of this article shall be prohibited. The parking regulations are for the purpose of traffic movement and snow plowing and shall remain in full force after each snow until public notice is given through press and radio release. It shall be unlawful for any person to deposit snow in the street area.
B. 
Any vehicle parked on any snow emergency route named in § 190-39 of this article shall be towed, at the owner's expense, to a compound and such vehicle will not be released to the owner until the cost of towing, fine and storage have been paid and, in addition the same shall be subject to the penalty set forth in § 190-40 of this article.
After any snow emergency is declared pursuant to § 190-36 and/or as defined in § 190-37 of this article, it shall be unlawful, at any time during the continuance of the emergency, for any person:
A. 
To park a motor vehicle or to allow that vehicle to remain parked anywhere on any snow emergency route designated in § 190-37 of this article; or
B. 
To drive any motor vehicle on any such snow emergency route, unless that vehicle is equipped with snow tires or chains.
The following are designated as snow emergency routes:

Tenth Street from Bald Eagle Avenue to Washington Avenue
Pennsylvania Avenue (SR 4027) from Tenth Street to Eleventh Street
Pennsylvania Avenue (SR 4027) from Eleventh Street to Fourteenth Street
Pennsylvania Avenue (SR 4027) from Fourteenth Street to Sixteenth Street
Fourteenth Street (SR 451) from Pennsylvania Avenue to Lincoln Avenue
Lincoln Avenue (SR 453) from Fourteenth Street to Fifteenth Street
Fifteenth Street (SR 453) from Lincoln Avenue to the reservoir

A. 
If at any time during a period of snow emergency declared under § 190-36 and/or a snow accumulation of three or more inches as set forth under § 190-37 of this article, a person shall park a motor vehicle or allow a motor vehicle to remain parked anywhere upon a snow emergency route, and/or is in violation of § 190-37, that person shall be guilty of a violation of this article, and, upon conviction, shall be sentenced to pay a fine of not less than $50 nor more than $100 plus costs.
B. 
If, at any time during a period of snow emergency declared under § 190-36 of this article, a person shall drive a motor vehicle upon a snow emergency route, without having that vehicle equipped with snow tires or chains, that person shall be guilty of a violation of this article, and, upon conviction, shall be sentenced to pay a fine of not less than $50, nor more than $100, plus costs.
