In the event that the Borough of Tyrone deems it necessary to reconstruct any street within the Borough or to resurface any street within the Borough and the reconstruction or resurfacing of any street affects any individual property owner's driveway by changing the elevation thereof in relation to the reconstructed or resurfaced street, the Borough will assume the cost of properly reconstructing the curb, if necessary, by making any curb cuts or by replacing the entire curb if, in the opinion of the Borough, it is necessary.

The Borough of Tyrone will also assume the cost of any sidewalk or driveway apron work necessary to provide access from the Borough street to the property by motor vehicle.

In the event that the Borough of Tyrone reconstructs any street, the Borough will assume the cost of properly reconstructing the curb if necessary, in the opinion of the Borough, by making any curb cuts or by replacing the entire curb in compliance with handicapped-access specifications. In the event that this reconstruction affects an individual property owner by necessitating a change in the elevation of his sidewalk relative to the reconstructed curbing, the Borough will assume responsibility for any sidewalk repair/replacement work required to provide transition from the existing sidewalk.

In the event that the Borough of Tyrone reconstructs any street, the Borough will assume the cost of removing any trees if, in the opinion of the Borough, the trees interfere with the safe use of said street. After any tree is removed by the Borough of Tyrone, the Borough will provide an area approximately three feet square where a new tree may be planted by the property owner if he so desires.
