The Township Board of Commissioners finds that the Township
is largely residential and that there are significant numbers of families
residing within the Township. The prevailing sense and attitude in
the Township is that nonemergency nocturnal and weekend outdoor work
activity should be restricted or reduced for the health, safety and
welfare of the residents of the community.
It is hereby ordained that no contractor, builder, paver or
other entity performing public or private work in the Township shall
conduct nonemergency outdoor work on any day prior to 7:00 a.m. or
after dusk.
It is further ordained that no contractor, builder, paver or
other entity performing public work on behalf of the Township shall
conduct nonemergency outdoor work on Sundays unless given written
permission by the Township Code Enforcement Officer in advance of
such work. The granting of such permission shall be solely within
the discretion of the Code Enforcement Officer, but the following
factors shall be utilized as guidelines:
A. The urgency of the need to complete the work;
B. The contractor's dependence on weather conditions in completing
the work;
C. The nature of the work to be completed as related to its potential
to disrupt and interfere with the residents of the Township;
D. Such other factors as may be relevant.
In the event of emergency, an agent and/or contractor may conduct
outdoor construction work during the periods prohibited by this chapter,
but shall make a reasonable attempt to obtain the permission of the
Township Code Enforcement Officer in advance of conducting such work.
If such contractor is unable to contact the Code Enforcement Officer,
he shall report the nature of the emergency and provide a description
of the work necessitated by such emergency, including the dates and
times thereof, within 24 hours of performing the same.
The Code Enforcement Officer is empowered to prepare, publish
and distribute rules and regulations to carry out the provisions of
this chapter.
A violation of this chapter shall be deemed to be a civil summary
offense. Any such person or entity found guilty shall be subject to
a fine of $100 and costs for each offense.
