There is hereby established a Water and Sewer Utility Department within the Township of Stafford for the operation of water and sewer services and the charging of rates and establishing rules and regulations governing the providing of water and sewer service in the Township of Stafford.
As used in this article, unless a different meaning clearly appears in the context, the following terms shall have the meanings indicated:
BUILDING
Any building or structure heretofore or hereafter constructed, designed or used for use or occupancy by persons, be it temporary or permanent.
CONNECTION DATE

A. 
Where used with respect to a building constructed prior to the date of initial operation of any water pipeline or sanitary sewer line available to service said building, the 90th day next ensuing the date of initial operation of such waterline or sanitary sewer line as part of the water and/or sanitary sewer system to be owned or operated by the Stafford Water and Sewer Utility Department.
B. 
When used with respect to a building constructed subsequent to the date of such initial operation, the 90th day next ensuing the date of completion of construction or date or occupancy of such building, whichever date shall first occur.
WATER PIPELINE
Any water pipeline or main designated or used for the distribution of potable water and located in any public street in the Township.
A. 
The owner of any building adjoining any public street in the Township of Stafford in which a water pipeline and/or sanitary sewer line is now or may hereafter be constructed shall connect such building and all water and/or sewer facilities therein to said waterline and/or sanitary sewer line by the connection date, except as provided in Subsection E of this section.

(1) 
If the property is at a distance greater than 250 feet from the municipal connection point for water and/or sewer, the property owner shall be exempt from the mandatory connection subject to the following provisions:
(a) 
All connection fees will be assessed and payable to the Township in a manner consistent with the current Township policies, rules, and regulations.
(b) 
All surcharges assessed to water and/or sewer users will be assessed and levied from the time the water and sewer connection became available.
(c) 
All property owners granted a waiver under this section shall be required to connect to the water and/or sewer system upon the sale of the subject property.
(d) 
All property owners granted a waiver under this section shall be required to connect to the water and/or sewer system in the event that a new well or septic system is required.
(2) 
If a notice of connection has been sent and the property is in the process of being transferred within the 90 days required for connection to the utility systems, the Director will examine each situation on a case-by-case basis and, at his discretion, may authorize one of the following actions:
(a) 
Require connection to the utility systems and payment of all connection fees prior to the transfer of the ownership of the property.
(b) 
If it is impractical to connect to the utility systems prior to the transfer of the property ownership, require payment of connection fees prior to the transfer of the properties and require the buyer’s attorney to provide a notarized certification stating that sufficient funds (based on a written estimate from a licensed contractor) have been placed in escrow with the buyer’s attorney to complete the connection to the utility systems and that the physical connection to the utility systems will be made within 90 days of the transfer of the property; the buyer acknowledges that failure to connect will result in the issuance of a summons; if the connection fees payable to the Township have increased since the original notice of connection, the buyer acknowledges that he/she will be responsible for the payment of the balance due at the time of physical connection to the system.
B. 
On lots where there are two buildings, each building shall be separately connected to the waterline and/or sanitary sewer line with its own water and/or sewer service line.

C. 
All new buildings adjoining any public street in the Township of Stafford in which a waterline and/or sanitary sewer line is now or may hereafter be constructed shall be required to connect to the waterline and/or sanitary sewer line by the connection date regardless of the distance between the building and the waterline and/or sanitary sewer line.

D. 
Appeals for hardship exemptions may be made, in writing, to the Stafford Water and Sewer Utility Director and shall be supported by engineering and/or technical data. After a review of the appeal request, the Stafford Water and Sewer Utility Director shall render a decision to grant or deny the request for an exemption.

E. 
Any buildings or other structures located on the blocks and lots set forth in Subsection E(4) hereof shall be subject to the following requirements:
(1) 
After connection to the waterline, each owner of property connected thereto may continue to use any private well for nonpotable water uses such as irrigation, car washing and outside use. The private well must be sealed only in the case of contamination.
(2) 
In the event a water well is contaminated, the following procedures shall be implemented to seal said well. A notice shall be addressed to the owners of said property as names of said owners shall appear on the last tax duplicate of the Township of Stafford; shall describe the property by lot and block designation as the same appears on the Tax Map of the Township of Stafford and by the street address, if a street address exists; and shall state that, by order of the Stafford Water and Sewer Utility Department, the owner is required to disconnect and seal any water wells located on his or her property within 30 days of service of such notice as hereinafter provided, and said notice shall also describe the penalty which may be imposed hereunder for failure to comply with said notice and order in accordance with the terms of this article. Said notice may be served on the owner personally or by leaving it at his usual place of abode with a member of his family above the age of 18 years. Said notice may also be served within or without the limits of the Township of Stafford by mailing the same by certified mail to the last known post office address of said owner as the same appears on the last tax duplicate of the Township of Stafford.
(3) 
Upon connection to the waterline and receipt of the notice under § 47-3E(1) and (2), the property owner must discontinue and disconnect any water service from a water well located on his or her property or adjacent thereto. The property owner shall also be required to seal the well. The Township, or its designated agent, shall make the necessary inspections to ensure compliance with the requirement that any water well shall be disconnected and sealed.

(4) 
The property subject to the provisions of Subsection E(1), (2) and (3) are as follows.[1]

(5) 
All wells which are required to be sealed by the provisions of this article or as a result of an order by the County Board of Health or the New Jersey Department of Environmental Protection shall be sealed in compliance with the requirements of the Department of Environmental Protection, Division of Water Resources, and in accordance with the standard specifications for sealing abandoned wells which have been adopted by that agency.
F. 
In the event that an owner of property has installed a new or replacement well prior to the receipt of notice, that individual may apply to the Stafford Township Water and Sewer Utility Department for a one-time extension as to his or her connection date. The application for this extension may be granted for a period of five years from the date of the installation of the new or replacement well. The application for extension shall also be supported by documented proof that the applicant has invested a substantial sum for installing a new or replacement well. After review of the application for extension, the Director of the Stafford Township Water and Sewer Utility Department shall render a decision to grant or deny the request for extension. The owner of the property shall assume the cost of the connection fee being charged at the time of connection. In the event that the property in question is sold prior to the expiration of the five-year extension period, the connection must be completed and all connection fees must be paid prior to the issuance of a certificate of occupancy for the new owner.

G. 
The installation of a bypass line around a water meter shall be strictly prohibited unless prior written approval by the Stafford Township Water and Sewer Utility Department has been granted. All permitted bypass lines must meet the design specifications of the Stafford Township Water and Sewer Utility Department. Under no circumstances may any type of interconnection occur between any private well system and the connection to the public water system.
When public water is available, all new habitable structures or buildings shall be required to supply and install a meter pit, a water meter and assembly in accordance with the rules and regulations of the Stafford Township Water and Sewer Utility Department.[1]

A. 
Meters required. All water taps made and services installed must be metered.
B. 
No person, other than an employee or agent of the Stafford Township Water and Sewer Utility Department, shall remove, replace or, in any manner, interfere or tamper with a meter attached to a water pipe used or intended to be used to supply water to any buildings. This applies whether the meter is set within or without a building. Any plumbing configuration intended to bypass the meter is prohibited and shall be considered theft of service, as well as a violation of this section.
C. 
Any meters of two inches or greater in size shall be tested by a certified testing firm at five-year intervals beginning with the fifth year from the date of original installation and every five years thereafter. The owner of the property serviced by the meter shall be responsible for the testing of the meter as required herein. The owner shall provide a copy of the results of the meter test to the Superintendent of the Water and Sewer Utility Department. Failure to test the meter as required herein or to provide a copy of the test results shall be deemed a violation of the subsection and subject to the penalties set forth in § 47-13, together with termination of service.

Every connection required by this article shall be made in accordance with the ordinances of the Township, as well as the rules and regulations of the Stafford Township Water and Sewer Utility Department and the State Uniform Construction Code. The size of the waterline connecting the building with the water distribution line shall be in accordance with the requirements of the Stafford Township Water and Sewer Utility Department and the State Uniform Construction Code.

Upon the availability of any waterline and/or sanitary sewer line to serve buildings on any property in the Township, each owner of property affected thereby shall be notified of that fact by the Stafford Township Water and Sewer Utility Department and shall be directed in said notice to connect each building on said property with said waterline and/or sanitary sewer line in accordance with the terms of this article.

All notices shall be addressed to the owners of said property as the names of said owners appear in the last tax duplicate of the Township of Stafford, shall describe the property by lot and block designation as the same appears on the Tax Map of the Township of Stafford and by the street address, if a street address exists, and shall state that, by order of the Stafford Water and Sewer Utility Department, the owner is required to connect each building on said property to the waterline and/or sanitary sewer line, in accordance with the terms of this article, on or before the connection date with respect to such building or, if such connection date shall have passed, within 30 days of service of such notice as hereinafter provided; and said notice shall also describe the penalty which may be imposed hereunder for failure to comply with said notice and order in accordance with the terms of this article. Said notice may be served on the owner personally or by leaving it at his usual place of abode with a member of his family above the age of 18 years. Said notice may also be served within or without the limits of the Township of Stafford by mailing the same, by certified mail, to the last known post office address of said owner as the same appears on the last tax duplicate of the Township of Stafford.
Definitions. Unless a different meaning clearly appears from the context, the following words shall have the following meanings:
APPLICATION
A formal submission of documents and supporting plans and other materials submitted to the Department in accordance with its most recent rules and regulations.

COMMERCIAL DEVELOPMENT
Any building or structure engaged in service, trade, business, traffic or commerce in general, exclusive of industrial development.
DEPARTMENT
The Stafford Water and Sewer Utility Department.
DEVELOPER
The person, persons, company or corporation performing site improvements.
DRY SANITARY SEWER
A sewer which is constructed to carry sewage or wastewater, but not intended to be placed in service until downstream sanitary sewer facilities are completed at some later date.
INDUSTRIAL DEVELOPMENT
Any building or structure engaged in manufacturing or processing operations.
OWNER
The property upon whose behalf the site improvements are to be made.
PLANNING BOARD
The Planning Board of the Township of Stafford.
PREAPPLICATION DETERMINATION
A formal submission of documents and supporting plans and other materials submitted to the Department for a decision on whether a connection to the sanitary sewer shall be required, dry lines installed or a waiver recommended.
SANITARY SEWER
A sewer which carries sewage or wastewater.
SEWER MASTER PLAN
The existing sanitary sewers and future sanitary sewer extensions, to sewer the Township of Stafford, as determined by the Department or as the Department shall determine.
SEWER SYSTEM
All interceptors, trunks, sanitary sewers, service connections and pumping stations owned by the Department in public streets or easements.
TOWNSHIP
The Township of Stafford.

Developers of all residential subdivisions and all commercial and industrial development shall submit to the Department for a preapplication determination. The Department shall determine if the developer shall be required to connect to the sanitary sewer, which may include extending the sewer system or the installation of dry sanitary sewers and on-site septic systems, or the Department may recommend a waiver for such connections or dry sanitary sewer at this time. If the Department determines that a connection to the sewer system shall be required or dry sanitary sewers installed, the developer shall file with the Department such preliminary and final applications in accordance with the Department's rules and regulations and construct the required sanitary sewer facilities. If the Department recommends that the connection to the sewer system or installation of dry sanitary sewers may be waived, the Mayor and Council shall adopt a resolution showing the reasons for recommending the waiver and shall forward a certified copy of the resolution to the developer and the Planning Board.
All Planning Board approvals shall be conditioned on approvals by the Water and Sewer Utility Department. The Planning Board shall not be bound by a recommendation of the Department to waive requiring the developer to connect to the sewer system or to install dry sanitary sewers. The Planning Board may accept or reject said recommendation based upon the facts presented to it.
Continuation of the site improvements may resume at such time when the Planning Board adopts a resolution waiving the connection requirements or upon approval by the Department of a final application and the owner or developer securing all county and state permits necessary in order to make connection to the sanitary sewer system or construction of dry sanitary sewers.
No certificate of occupancy shall be issued to the owner until the owners, who are determined to connect to the sanitary sewer or construct dry sanitary sewers, complete said sanitary sewer facilities in accordance with the Department's rules and regulations and until the Department fully accepts the sanitary sewer facilities in accordance with the procedures defined in said rules and regulations.[1]

No building permit shall be issued by the Township until such time as the developer has received the necessary approvals or waivers from the Department and Planning Board.
A. 
Any person violating or failing to comply with any of the provisions of this article shall, upon conviction thereof, be punishable by a fine of not more than $1,000, by imprisonment for a term not to exceed 90 days or by community service of not more than 90 days, or any combination of fine, imprisonment and community service as determined in the discretion of the Municipal Court Judge. The continuation of such violation for each successive day shall constitute a separate offense, and the person or persons allowing or permitting the continuation of the violation may be punished as provided above for each separate offense.
B. 
The violation of any provision of this article shall be subject to abatement summarily by a restraining order or injunction issued by a court of competent jurisdiction.
In addition to the penalties hereinabove provided if the owner of property in the Township of Stafford shall fail or refuse to make any connections or installation required by this article within the time or times herein provided, the Stafford Township Water and Sewer Utility Department may proceed to make such connection or installation or cause the same to be made and assess the cost or charges against such property in accordance with the delinquency provisions of the rules and regulations of the Stafford Township Water and Sewer Utility Department.[1]

A credit of 15% on the sewer bill shall be granted to car wash facilities, provided the car wash facility does not direct water into the Township sewer system for collection and treatment.

Water charges.

Water connection fee: $3,697 per unit effective December 5, 2016. In the case of affordable housing units, the water connection fee shall be $1,848.50. (3) 
Other charges.

(c) 
Location of service: $45 per water or sewer location.
(d) 
Return check charge: $20 per returned check, and customer must then replace the check with cash, money order or certified check.
(e) 
Water connection reinspection fee: $50 per reinspection of water connection.
(f) 
Sewer connection reinspection fee: $50 per reinspection of sewer connection.
(g) 
Cut and cap inspection: $50.
(4) 
Developer fees.
(a) 
Application fee for preliminary approval (sewer): $75.
(b) 
Engineering review fee for preliminary approval (sewer): $500.
(c) 
Application fee for tentative approval (sewer): $100.
(d) 
Engineering review fee for tentative approval (sewer): 1% of estimated cost of construction, $500 minimum.
(e) 
Application fee for final approval (sewer): $100.

Engineering review fee for final approval (sewer): 2% of estimated cost of construction, $500 minimum.

Attorney review fee for final approval (sewer): $350.
(h)

(5) 
Discount on water charges for qualified senior citizens or disabled. Senior citizen or disabled residents who are directly billed as customers of the Township water system and who qualify in accordance with the provisions of N.J.S.A. 40A:31-10.1 shall be entitled to a discount of 25% of the annual base rate charge upon application to the Department on forms prescribed by the Director. The discount shall be in the form of a credit equal to 25% of the annual base rate charge on the fourth quarter billing statement to qualified senior citizens or disabled customers who have provided proof of eligibility to the Water and Sewer Collector on the prescribed application forms. Application forms must be filled on an annual basis in order to qualify for the discount and must be filled no later than July 15 of each year.
C. 
Billing policies and practices.
(1) 
Meter reading is completed on a quarterly basis for billing purposes.
(2) 
Water and sewer utility bills are sent out by the Department on January 1, April 1, July 1 and October 1, on a quarterly basis for each year.
(3) 
Payments are due by the 15th of the month on which the bill is sent out. Payments which are not received by the 24th of the month are subject to an interest penalty calculated from the 15th of the month, at 8% interest for amounts up to $1,500, and 18% for amounts over $1,500. No interest or penalties shall be charged on delinquent water and sewer utility accounts for governmental entities, including federal, state and local political subdivision accounts, including county government accounts, Board of Education accounts and local government accounts.

(4) 
Water and sewer charges are billed to the current property owner only. The Department will not bill tenants.
(5) 
Only one meter will be installed per property unless approved by the Director of the Water and Sewer Utility Department.
(6) 
All water and sewer usage during the construction of new homes shall be billed to the property owner, and no certificate of occupancy shall be issued unless the Collector for the Water and Sewer Utility Department issues a certification that all charges have been paid.
(7) 
All meters must meet the standards contained in the Department’s rules and regulations.
(8) 
The Department hereby adopts the following guidelines for requests for adjustment to water and sewer utility bills:
(a) 
Policy. The Stafford Water and Sewer Utility Department treats and distributes water to its customers and collects and treats sewage and transports the sewage to the Ocean County Utilities Authority Treatment Plant. There are costs incurred by the Department for these processes. Pursuant to state law, the Township is legally obligated to bill customers for each gallon of water distributed and for each gallon of sewage that is treated. The New Jersey Department of Environmental Protection mandates that the Township attempt to account for each gallon of water and identify each and all sources of legitimate water loss. In light of the above, the Township has established the following policy for customers seeking a billing adjustment. Specifically, the Department, through the Director, will review requests on a case-by-ease basis. Customers must provide the following information:
[1] 
A written explanation of the circumstances pertaining to the water loss (such as location of break or leak, how you discovered it, how long water was leaking, etc.)
[2] 
The date the loss was discovered.
[3] 
Action taken by the customer to correct the problem.
[4] 
Copy of bills paid to plumbers and/or other contractors to correct the problem.
[5] 
All claims must first be submitted to your homeowner’s insurance carrier for reimbursement. A copy of the determination letter from your insurance carrier either approving or denying the claim must be submitted.
[6] 
Any claim for damage and/or water loss which is a direct result of action by the Department or a contractor working for the Township will be investigated immediately by the Department. Every attempt will be made to approve legitimate requests of this type as soon as reasonably possible. The Director is hereby authorized by the governing body to resolve these situations immediately without approval from the governing body. The Director shall issue a written report to the governing body after the adjustment has been made.
[7] 
It is extremely unlikely that the Township will approve the request for any adjustment involving the following:
[a] 
Outdoor garden hoses left on.
[b] 
Crawl spaces and outdoor shower areas that are not properly winterized.
[c] 
Hot-water heaters that are leaking due to age.
[d] 
Leaking or running commodes, showers or sinks.
[e] 
Leaking or underground sprinkler systems that are connected to the public water supply.
[8] 
Property owners who have submitted a claim for a water adjustment and who have satisfied the requirements of § 47-15C(8)(a)[1] through [5] shall be automatically eligible for a one-time abatement of overage charges. Property owners shall have the right to appeal to the Council for abatement of subsequent overage charges. Any overage charges levied against the property shall be calculated as follows:

[a] 
For properties covered by the Flexnet monitoring system, the overage calculation shall be based on the water usage above the daily average of the preceding 30 days. Property owners will be assessed based upon the rate as set forth in § 47-15 for all water usage above that average.
[b] 
For properties not covered by the Flexnet system the calculation shall be based upon the water usage average of the preceding eight quarters. Property owners will be assessed based upon the rate as set forth in § 47-15 for all water usage above that average.

In lieu of adjustment, customers may seek to pay an unusually high bill in installment payments in accordance with the payment plan approved by the Director and the Collector. All outstanding charges must be paid within the existing budget year, however. Applicable interest shall be charged on any unpaid balance.
(9) 
Upon written approval, by the Director of the Water and Sewer Utility Department, payment of water and sewer connection fees may be paid in installments in accordance with the following schedule:

(a) 
Five percent, 10% or 25% of the connection fee shall be paid immediately. The determination of the required down payment shall be based on income verification information supplied to the Water and Sewer Utility Director and Water and Sewer Utility Collector. All applicants requesting a down payment lower than 25% shall be required to apply for and produce letters of determination from all federal, state and county agencies offering grant funding for the purpose of water installation. All property owners requesting a down payment lower than 25% shall also provide the following information:

Copy of federal tax return for previous three years.
[2] 
W-2 for previous three years.
[3] 
Any and all documentation that in the opinion of the Director will support claims of financial obligations that would impair the ability of the applicant to sustain the assessment. In addition, the Director may require applicants to submit signed IRS certifications allowing the Township to independently verify the accuracy of the applicant’s tax documentation.
[4] 
All documentation is strictly for the determination of water and sewer charges and will not be made available to anyone other than the individuals specified herein. All documentation is to be returned to the property owner once a determination is made.
(b) 
The unpaid balance shall be paid in 20 quarterly installments, together with interest at 5%.
(c) 
Any payments not received in a timely manner shall result in the entire unpaid balance, together with interest, being immediately due and payable.
(10) 
An administrative/service fee may be charged to another governmental entity with which the Township has an intergovernmental agreement for the purposes of servicing the account. The actual fee shall be set by resolution.
(11) 
Water and sewer connection fees shall be based on projected water consumption of the property with each equivalent dwelling unit (EDU) comprising of 55,000 gallons of annual water consumption. Non-Leadership in Energy and Environmental Design (LEED) certified residential units shall be calculated at one EDU per unit. The calculation of the connection fees for LEED certified, as designated by the United States Green Building Council, or accredited equivalent, approved by Stafford Township, residential units and all nonresidential properties shall be determined by the Director of the Water and Sewer Utility Department based upon the application and documentation provided by the applicant. Application and documentation provided shall include the projected water consumption data supplied by the applicant's engineer in preparing the water application for approval by the governing body, if applicable, the actual water billing records for a property of like size and character or additional water analysis studies prepared by a licensed engineer on behalf of the property owner/applicant. It shall be within the discretion of the Director to request additional documentation from the applicant as he/she deems appropriate. In all LEED certified or accredited equivalent, approved by Stafford Township, and all nonresidential properties, connection fees shall be reviewed at one-year intervals for a period of two years by the Water and Sewer Utility Collector in conjunction with the Director, who shall have the final authority in determining if additional connection fees are payable by the property owner or if any portion of the connection fees previously paid by the property owner may be refunded based on actual water consumption.

(12) 
The Township finds and declares that it is necessary to increase the overall system capacity by constructing the proposed production Well No. 11 in Ocean Acres and to improve the water system distribution hydraulics by constructing the planned Garden State Parkway directional drill crossing (hereinafter collectively referred to as "capital improvement") and that the preparation and adoption of a fair share cost contribution plan in order to provide a mechanism to assess all future subdivision and site plan development water applications throughout the high-pressure service area that will directly benefit from the improvements is reasonable, and in the long-term best interests of the Township, its ratepayers and the citizens of the Township. The fair share contribution for each equivalent unit (EU) in the high-pressure area shall be calculated by dividing the predesign engineer's estimate for the capital improvement by the total number of EUs. EUs shall be calculated by dividing the permit peak capacity of proposed Well No. 11 by the Township's historic yearly average usage per year per unit of 55,000 gallons. The fair share contribution per EU shall be adjusted annually for cost variations for future water applications during the construction period and shall be established by resolution of the governing body. The high-pressure service area subject to the fair share contribution is set forth in a map entitled "High Pressure Service Area" adopted by resolution of the governing body. The fair share cost contribution shall be made a condition of final approval for all subdivision and site plan development water applications throughout the high-pressure service area. The applicant shall be required as a condition of final approval to execute a developer's agreement as prepared by the Water and Sewer Utility Department Attorney.

(2) 
The water and sewer annual capital surcharge shall become effective October 1, 2009. The annual surcharge for 2009 shall be a separate water and sewer utility bill sent out by the Department on October 1, 2009, and shall be paid in full by November 1, 2009. Any 2009 annual surcharge payment not received by November 10, 2009, shall be subject to an interest penalty calculated from November 1, 2009, at 8% interest for amounts up to $1,500 and 18% for amounts over $1,500. No interest or penalty shall be charged on delinquent water and sewer utility accounts for governmental entities, including federal, state and local political subdivision accounts, including county government accounts, Board of Education accounts and local government accounts.
(3) 
Beginning January 1, 2010, the water and sewer capital surcharge will be billed and payable on a quarterly basis, with bills sent out by the Department on January 1, April 1, July 1 and October 1 of each year, and will be collected in the same manner as water and sewer utility bills in accordance with § 47-15C.

A. 
A credit, applicable to the connection fee to be charged for a reconnection of a disconnected property that was previously connected to the water or sewerage system, shall be given, provided that:
(1) 
The property has been connected to the water or sewerage system for at least 20 years; and
(2) 
Service charges have been paid for the property in at least one of the last five years.
B. 
The credit required under Subsection A shall be calculated as follows:
(1) 
If the reconnection does not require any new physical connection or does not increase the nature or size of the service or the number of units, or does not expand the use of the water or sewerage system, the credit shall be equal in amount to the new connection fee.
(2) 
If the reconnection requires a new physical connection, increases the nature or size of the service or the number of service units, or expands the use of the water or sewerage system, the credit shall be equal in amount to any connection fee previously paid for the property, and the Township shall charge the difference between the credit and the connection fee for the new use.
(3) 
If no connection fee was ever paid for the property, but all service charges due and owing on the property have been paid for at least 20 years, the credit shall be equal in the amount to new connection fee; provided, however, that any charges due and owing pursuant to Subsection B (2) of this subsection shall be paid.
C. 
If no connection fee was ever paid for a disconnected property that is to be reconnected and which was previously connected to the water or sewerage system for at least 20 years, the Township shall charge, in addition to amount due and owing after application of a credit pursuant to this section, a connection fee equal to the lesser of:
(1) 
Twenty percent of the service charges that would have been paid based upon the usage for the last full year that the property was connected to the water or sewerage system for the period from the date of the disconnection from the sewerage system to the date of the new connection; or
(2) 
The new connection fee.
D. 
A credit shall not be allowed under this section for a property that has been disconnected from the water or sewerage system for more than five years.
E. 
As used in this section, "disconnected property" means a property that has been physically disconnected from the water or sewerage system or a property not physically disconnected but to which service has been discontinued without payments being made. A disconnected property shall not include a property that has been temporarily disconnected from the water or sewerage system or to which service has been discontinued without payments being made for less than 12 consecutive months and is being reconnected as it existed, prior to the temporary disconnection of discontinuance of service.
F. 
For a property connected to the water or sewerage system for less than 20 years, the Township may charge an additional connection fee for an addition, alteration, or change in use that materially increases the level of use and imposes a greater demand on the water or sewerage system, but does not involve a new physical connection of the property to the sewerage system.
G. 
The connection fee authorized by Subsection F of this section shall be equal to the amount by which the increased use and demand on the water or sewerage system exceeds the use and demand that existed prior to such addition, alteration or change in use.
H. 
Nothing in this section shall be construed to preclude the Township from charging a new or additional connection fee for any new or additional connections of a property to the water or sewerage system, or for any increase in the size of an existing connection or for any new construction or additional service units connected to the sewerage system that materially increases the level of use or demand on the sewerage system.
I. 
As used in this section, "disconnected property" means a property that has been physically disconnected from the sewerage system or a property not physically disconnected but to which service has been discontinued without payments being made. A disconnected property shall not include a property that has been temporarily disconnected from the sewerage system or to which service has been discontinued without payments being made for less than 12 consecutive months and is being reconnected as it existed, prior to the temporary disconnection or discontinuance of service.
J. 
As used in this section, "materially increases" means any increase in the number of service units; or any other change which increases the level of use or demand on the sewerage system by 15% or more over the highest actual annual use and demand that existed prior to the ten-year period immediately preceding the addition, alteration or change in use; provided, however, that if the property has been connected to the sewerage system for less than 10 years, the average level of use and demand shall be calculated based on the actual period of connection.
A. 
Director of Water and Sewer Utility.
(1) 
Appointment and term of office. Appointed by Mayor with the advice and consent of the Township Council. Term of office to be at the pleasure of the governing body.
(2) 
Qualifications. The Director shall be chosen on the basis of his executive and administrative abilities and qualifications with special regard as to education, training and experience in the management of public water and sewer utility systems. An undergraduate degree in public administration/management is required with a master's degree preferred. Five years' experience in a management capacity of a public water and sewer system is also a preferred qualification.
(3) 
Vacancy. Any vacancy in the position of Director of Water and Sewer Utility shall be filled by appointment by the Mayor, with the advice and consent of the Township Council.
(4) 
Duties and responsibilities. The Director of Water and Sewer Utility shall report directly to the Mayor and have the following duties and responsibilities:
(a) 
To supervise and direct all of the operations and employees of the Township of Stafford's Water and Sewer Utility on a daily basis.
(b) 
To prepare a budget on an annual basis for the Water and Sewer Utility in cooperation with the Chief Financial Officer and to submit the budget to the Mayor and Township Council for consideration.
(c) 
To keep the Mayor and Township Council informed of the financial condition of the Water and Sewer Utility and to make such reports as necessary.
(d) 
To receive and reply to inquiries from the general public and/or Water and Sewer Utility customers and to provide information and assistance in respect thereto.
(e) 
To recommend the nature, location and extent of the public Water and Sewer Utility System improvements and to coordinate the execution of same when authorized by the Mayor and Township Council.
(f) 
To supervise the disbursement of all water and sewer utility funds in conjunction with the Chief Financial Officer and to approve all vouchers and purchase orders before submitting same to the Township Council for final approval.
(g) 
To perform such other duties as may be assigned to him/her from time to time by the Mayor and/or Township Council.
(5) 
Reports to: Mayor.
B. 
Chief Financial Officer for the Water and Sewer Utility.
(1) 
Appointment and term of office. The Chief Financial Officer for Water and Sewer Utility shall be appointed by the Mayor, with the advice and consent of the Township Council, in accordance with N.J.S.A. 40A:9-140.8. The term of office for the Chief Financial Officer for the Water Sewer Utility shall be consistent with his/her term of office as the Chief Financial Officer for the Township.
(2) 
Qualifications. To be appointed to the position of Chief Financial Officer for the Water and Sewer Utility, an individual must meet the qualifications established under N.J.S.A. 40A:9-140.8 et. seq., as amended.
(3) 
Duties. The Chief Financial Officer for the Water and Sewer Utility shall have the duties and responsibilities as set forth in N.J.S.A. 40:69A-129. In addition, the Chief Financial Officer shall assist the Director of the Water and Sewer Utility in the preparation of the annual water and sewer utility budget and shall ensure that the municipality complies with all requirements of the Division of Local Government Services concerning municipal finances.
(4) 
Reports to: Director of Water and Sewer Utility.
C. 
Purchasing Agent for Water and Sewer Utility.
(1) 
Appointment and term of office. The Mayor, with the advice and consent of the Township Council, shall appoint the Purchasing Agent for the Water and Sewer Utility. The term of office for the Purchasing Agent for the Water and Sewer Utility shall be consistent with and run concurrently with his/her term as the Purchasing Agent for the Township.
(2) 
Qualifications. To be appointed as the Purchasing Agent for the Water and Sewer Utility a person must have the following qualifications:
(a) 
The ability to read, write, speak and understand the English language sufficiently to perform the duties of the position.
(b) 
At least five years of work experience involving ordering, receiving, checking, verifying and distributing materials, supplies and equipment.
(c) 
Extensive knowledge and experience concerning the State of New Jersey Local Public Contracts Law found at N.J.S.A. 40A: 11-1 et seq., as amended.
(d) 
The ability to perform work expeditiously under a variety of circumstances. Basic supervisory knowledge and experience.
(e) 
The ability to establish and maintain effective working relationships with vendors, suppliers, contractors, supervisors, department heads, employees and the general public.
(f) 
Successful completion of the purchasing administration courses offered by Rutgers University to meet the criteria required for designation as a qualified purchasing agent pursuant to the Local Public Contracts Law.
(3) 
Duties.
(a) 
The Purchasing Agent shall act as contracting agent for the Water and Sewer Utility and shall have the authority to prepare public advertisements for bids.
(b) 
To receive bids for the purchase of materials, supplies or labor services on behalf of the Water and Sewer Utility.
(c) 
To negotiate and award contracts which do not exceed the bid limit threshold as contained in the Local Public Contracts law.
(d) 
Formulation, administration and supervision of a complete municipal purchasing program.
(e) 
Perform all necessary purchasing functions and implementation of an inventory control system, including inventory distribution and inventory receiving, and implementation and maintenance of a fixed asset management program.
(f) 
In conjunction with the Director, prepare and mail annual consumer confidence reports as required by state and federal regulation.
(g) 
Perform other assignments as directed by the Director of the Water and Sewer Utility.
(4) 
Reports to: Director of Water and Sewer Utility.
D. 
Water and Sewer Utility Collector.
(1) 
Appointment and term of office. The Mayor, with the advice and consent of the Township Council, shall appoint the Water and Sewer Utility Collector. The term of office for the Water and Sewer Utility Collector shall be consistent with and run concurrently with his/her term as the Tax Collector for the Township.
(2) 
Qualifications.
(a) 
A minimum of five years of management/supervisory experience in the field of collection of fees, taxes and/or public funds.
(b) 
Successful completion of course work from Rutgers University for the designation as a certified tax collector.
(c) 
Successful completion of a background check, including credit check, criminal history check, driver's license check and postoffer/preemployment physical, including drug screening.
(d) 
Extensive knowledge and experience with property tax/water and sewer utility collection regulations and techniques in New Jersey.
(3) 
Duties.
(a) 
Supervision, direction and coordination of all Water and Sewer Utility billing functions, including processing of meter reading information, preparation of bills, mailing of bills, receipt of payments and reconciliation of account information as necessary.
(b) 
Supervision and direction of all collection staff.
(c) 
Preparation of reports as necessary.
(d) 
Submittal of recommendations to the Director of Water and Sewer Utility concerning changes or improvements in the collection functions.
(e) 
Responding to billing inquiries from ratepayers and the general public.
(f) 
Maintenance of billing records as required by state statute and regulation.
(g) 
Coordination of work activities as necessary with the Chief Financial Officer and Township Auditor.
(h) 
Maintenance of log for extensions granted for water/sewer hookup.
(i) 
Prepare letters for enforcement of water/sewer hookup.
(j) 
Preparation of Ocean County Sewage Authority Monthly Customer Report and Annual Commercial Consumption Report.
(k) 
Perform other assignments as directed by the Director of the Water and Sewer Utility.
(4) 
Reports to: Director of Water and Sewer Utility.
E. 
Superintendent of Operations for Water and Sewer Utility.
(1) 
Appointment. The Mayor, with the advice and consent of the Township Council shall appoint the Superintendent of Operations for Water and Sewer Utility.
(2) 
Qualifications.
(a) 
At least five years of progressively responsible experience as a superintendent (or equivalent job title) for a water and sewer utility operation (public or private) of similar type and size to the Township of Stafford's system.
(b) 
A high school diploma or general equivalency diploma (GED) equivalent.
(c) 
At the time of appointment, must hold currently valid state New Jersey Department of Environmental Protection (NJDEP) licenses, including a license for water treatment (T-3), water distribution (W-3) and sewer collection (C-3). Failure to maintain the above-cited licenses during employment shall constitute immediate grounds for dismissal.
(d) 
The ability to read, write, speak and understand the English language sufficiently to perform the essential functions of the position.
(e) 
Successful completion of a background check, including credit check, criminal history check, driver's license check and postoffer/preemployment physical including drug screening.
(f) 
Extensive experience in the field of management of water and sewer utility operations and employees, preferably in the State of New Jersey.
(g) 
Any other state and/or federal licenses required for the Township's water and sewer systems.
(h) 
The ability to establish and maintain effective working relationships with vendors, suppliers, contractors, employees and the general public.
(i) 
The ability to perform work expeditiously under a variety of circumstances.
(3) 
Duties and responsibilities.
(a) 
Supervision, coordination and direction of all water and sewer utility operations and employees on a daily basis.
(b) 
Preparation of daily work schedules and job assignments for all operational employees, including approval of leave requests and forwarding of same to the Director for concurrence.
(c) 
Review and approval or denial of overtime by operational employees.
(d) 
Timely filing of all required state and federal reports for the Water and Sewer Utility operation.
(e) 
Supervision, direction and evaluation of all operational employees, including recommendation of disciplinary action to the Director.
(f) 
Preparation of an annual operating budget request for submittal to the Director for consideration.
(g) 
In conjunction with the Engineer, coordination of capital projects as necessary.
(h) 
Representing the Township Water and Sewer Utility at meetings as necessary.
(i) 
Recommendation of operational changes to the Director.
(j) 
Preparation of an annual inventory of equipment and supplies for submittal to the Purchasing Agent.
(k) 
Other duties as assigned by the Director.
(4) 
Reports to: Director of Water and Sewer Utility.
F. 
Assistant Superintendent of Operations for Water and Sewer Utility.
(1) 
Appointment. The Mayor, with the advice and consent of the Township Council, shall appoint the Assistant Superintendent of Operations for Water and Sewer Utility.
(2) 
Qualifications.
(a) 
At least three years of progressively responsible experience as an operator, chief operator or assistant superintendent (or equivalent job title) for a water and sewer utility operation (public or private) of similar type and size to the Township of Stafford's system.
(b) 
At the time of appointment, must hold currently valid state NJDEP licenses, including a license for water treatment (T-3) water distribution (W-3) and sewer collection (C-3). Failure to maintain the above-cited licenses during employment shall constitute immediate grounds for dismissal.
(c) 
The ability to read, write, speak and understand the English language sufficiently to perform the essential functions of the position.
(d) 
A high school diploma or GED equivalent.
(e) 
Successful completion of a background check, including credit check, criminal history check, drivers license check and postoffer/preemployment physical including drug screening.
(f) 
Extensive experience in the field of operation of water and sewer utility operations and employees, preferably in the State of New Jersey.
(g) 
Any other state and/or federal licenses required for the Township's water and sewer systems.
(h) 
The ability to establish and maintain effective working relationships with vendors, suppliers, contractors, employees and the general public.
(i) 
The ability to perform work expeditiously under a variety of circumstances.
(j) 
The ability to take direction and carry out job assignments from the Superintendent or the Director.
(3) 
Duties and responsibilities. Assisting the Superintendent in the day-to-day operations of the Water and Sewer Utility, including the following duties as necessary and/or directed:
(a) 
Acting as the Superintendent in his absence.
(b) 
Preparation and filing of any and all state/federal reports as directed.
(c) 
Supervision, coordination and direction of all Water and Sewer Utility operations and employees.
(d) 
Preparation of daily work schedules and job assignments.
(e) 
Direct supervision of employees.
(f) 
Monitoring of job assignments.
(g) 
Performing fieldwork, as needed, on a daily basis.
(h) 
Inspection of all water and sewer facilities on a daily basis, as necessary.
(i) 
Performance of any daily testing or monitoring analysis, as necessary.
(j) 
Completion of daily logs and reports, as necessary.
(k) 
Prompt reporting of all problems/deficiencies to the Superintendent or the Director (in the absence of the Superintendent).
(l) 
Repair of equipment and pumps, as necessary.
(m) 
Following proper training, operation of equipment.
(n) 
Fulfill on call responsibilities as directed and scheduled on nights, weekends and holidays, as necessary.
(o) 
Other duties as assigned by the Superintendent or the Director.
(4) 
Reports to: Superintendent of Operations for Water and Sewer Utility.
G. 
Licensed Operator for Water and Sewer Utility.
(1) 
Appointment. The Mayor, with the advice and consent of the Township Council, shall appoint the Licensed Operators for Water and Sewer Utility.
(2) 
Qualifications.
(a) 
At least two years of experience as an operator or laborer for a water and sewer utility operation (public or private) of similar type and size to the Township of Stafford's system.
(b) 
The ability to read, write, speak and understand the English language sufficiently to perform the essential functions of the position.
(c) 
At the time of appointment as an operator, must hold currently valid state NJDEP licenses, including licenses at the following minimum levels: for water treatment (T-1), water distribution (W-1) and sewer collection (C-1). The Director, at his/her discretion, may allow an employee up to 18 months from the employee's date of hire to obtain the required licenses. Once the required licenses have been obtained, failure to maintain the above-cited licenses during employment shall constitute immediate grounds for dismissal.
(d) 
Successful completion of a background check, including credit check, criminal history check, driver's license check and postoffer/preemployment physical, including drug screening.
(e) 
Some experience in the field of operation of water and sewer utility operations and employees, preferably in the State of New Jersey.
(f)

A valid New Jersey driver's license is required. A valid commercial license (CDL) is preferred.

Duties and responsibilities.

Daily inspection of all water and sewer facilities.

Performance of any and all required daily monitoring tests.
(c) 
Completion of all daily logs and reports.

Prompt reporting of all problems/deficiencies to the Superintendent or Assistant Superintendent in the absence of the Superintendent.

Repair of pumps, motors and other equipment, as necessary.
(f) 
Performance of any and all manual fieldwork as assigned and that may be necessary, including excavation of ditch areas, installation of pipe and fittings, installation of meter pits, valves, etc.

Following proper training, operation of equipment such as the sewer jet, compressor, jackhammer hand tools and safety equipment.
(h) 
Fulfill on call responsibilities as directed and scheduled on nights, weekends and holidays, as necessary.
(i) 
Other duties as assigned.
(j) 
One operator shall be appointed as the "Chief Operator." The appointee must hold valid T-2, W-2 and C-2 licenses at the time of appointment. This designation shall encompass the following additional duties:

Coordination and collection of all samples as necessary.

Heavy Equipment Operator for Water and Sewer Utility.

Appointment. The Mayor, with the advice and consent of the Township Council, shall appoint the Heavy Equipment Operator for Water and Sewer Utility.
(2) 
Qualifications.
(a) 
At least two years of experience in operating and maintaining one or more types of gasoline- and diesel-powered construction equipment such as a bulldozer, front-end loader, crane, backhoe, etc.
(b) 
Knowledge of the equipment to be assigned and the specific limitations in performing a variety of tasks.
(c) 
Knowledge of accident preventive procedures for operating assigned equipment.
(d) 
Successful completion of a background check, including credit check, criminal history check, driver's license check and postoffer/preemployment physical, including drug screening.
(e) 
The ability to perform work independently and expeditiously under a variety of circumstances.
(f) 
The ability to read, write, speak and understand the English language sufficiently to perform the essential functions of the position.
(g) 
The ability to maintain intense concentration, alertness and an exceptional degree of visual and physical dexterity and coordination.

Qualifications. The Administrative Secretary shall be chosen on the basis of her administrative abilities and qualifications with special regard as to education, training and experience. Five years' experience in a similar capacity is required.
(3) 
Vacancy. Any vacancy in the position of Administrative Secretary of Water and Sewer Utility shall be filled by appointment by the Mayor, with the advice and consent of the Township Council.
(4) 
Duties and responsibilities. The Administrative Secretary of the Water and Sewer Utility shall report directly to the Director and have the following duties and responsibilities:
(a) 
Preparation of agenda items related to Water and Sewer Utility matters for consideration by the governing body at regular and special meetings.
(b) 
Recording of meetings and preparation of the official minutes of meetings for approval by the governing body.
(c) 
Administer and record oaths of office, as necessary.
(d) 
Receipt and distribution of all mail and correspondence to the appropriate personnel for the Water and Sewer Utility.

Maintenance of all Water and Sewer Utility official records, including but not limited to minutes, ordinances, resolutions, personnel records, correspondence, maps, maintenance and performance bonds, insurance certificates, contracts, directives and other documents.

Computer Network Administrator.

At least years of work experience as a network administrator or in a similar position, including three years of experience in diagnosing and correcting computer hardware and software problems.
(d) 
Must be Novell certified and must have extensive experience with Novell network systems.

Ability to communicate effectively in verbal and written form and to interact effectively on a daily basis in a work setting with employees and vendors (software and hardware.)

Identification and correction of computer software and hardware problems for any and all Department-owned computer equipment.
(d) 
Review of equipment and written recommendations to the administration prior to the purchase of any computer hardware or software by the Department and annual written recommendations, to the Director, of equipment and software necessary to address the Utility Department's computer needs.
(e) 
Design and daily administration of the Department's telephone system, including cellular phones.
(f) 
Design and administration of the Utility Department's web page on the Internet.
(g)
