GENERAL REFERENCES
Licensing of businesses — See Ch. 130.
A. 
The Town of Georgetown recognizes that a Town's residential areas are a source of civic pride to homeowners, home renters and home buyers alike; and
B. 
As a matter of public policy the Town Council aims to preserve, enhance and perpetuate the economic value and the residential character of the Town's neighborhoods, in part by regulating garage sales/yard sales, and that such preservation promotes and protects the health, safety, comfort, economic investment and general welfare of the people living in Georgetown.
C. 
This chapter specifically seeks to achieve the following goals:
(1) 
To protect residential areas from the permanent encroachment of commercial uses.
(2) 
To limit the proliferation of unsightly signs and signage structures.
(3) 
To protect the aesthetic qualities of neighborhoods.
(4) 
To ensure the harmonious and orderly operation of garage sales/yard sales in residential areas.
A. 
Yard sales are permitted within the municipal limits of the Town of Georgetown under certain terms and conditions as herein set forth.
B. 
The term "yard sale" means and includes such terms as "garage sale," "basement sale," "carport sale," "moving sale," "rummage sale," "flea market sale," "estate sales" or any other type of residential sale of tangible personal property, such as, but not limited to, household items, clothing, tools, toys, recreation equipment or other used or secondhand items normally found in and about the home and advertised to the public.
A. 
Yard sales may be held by the owner or bona fide resident of a lot or parcel of land. Residents of multi-unit dwellings must obtain permission of the property owner. Trespassing on parcels not owned or leased by the individual operating the yard sale is strictly prohibited.

B. 
Yard sales shall be permitted during the hours of 7:00 a.m. until dusk. Items for sale must be moved inside at dusk.
A yard sale may be advertised to the public by means of newspapers, radio, television, cablevision, handbills and signs. In the event an applicant chooses to advertise a permitted yard sale by means of signage or handbills, the following restrictions shall apply:
A. 
No more than two signs may be placed upon the property where the yard sale is to be held.
B. 
Signs and handbills cannot be placed on utility poles, public property including rights-of-way, nor may signs be placed on private property other than the site where the yard sale is to be held. Handbills may be posted on private bulletin boards or inside places of business with the consent of the owner.
C. 
A sign is limited to four square feet or less and shall not be illuminated or animated.
D. 
A sign may not be displayed more than one day prior to the commencement date of the sale and must be removed immediately following the conclusion of the sale.
Any charitable or public service institution, association, club, body not organized or conducted for private gain shall be exempt.
The following individuals shall enforce this chapter: the Town Manager, any duly sworn police officer, or the Code Enforcement Officer. Said enforcement officials shall have the authority to cease the operation of any yard sale which blocks or obstructs vehicular traffic; or in any way causes or creates a hazardous driving condition; or in any way causes or creates conditions which are detrimental to the public peace, health, safety, or welfare; or is otherwise conducted in violation of this chapter.

Any person violating any provision of this chapter shall pay such fines as set out in Chapter 1, Article III, General Penalty.
