The following regulations shall be a part of the contract between
every owner of property furnished water service directly by the Village
and said Village hereinafter called respectively, the "consumer" and
the "Village." All persons now receiving, accepting and paying for
water service from the Village, or who may hereafter make application
therefor, including any tenant(s) of such person, shall be considered
as having agreed to be bound by the rules and regulations as contained
in this article. The Village reserves the right to make such changes
in these rules and regulations as it may from time to time deem advisable.
Applications for water service, for the use of water or for
any modification or repair of water facilities shall be made in writing
at the Village offices, on forms provided therefor, and the fees therefor
paid, by the owner of the property or his agent duly authorized with
power of attorney. The application fee for water service shall be
set forth by resolution of the Board of Trustees in the Master Fee
Schedule as same may be amended from time to time. The owner of property
applying for any water service pursuant to this chapter is referred
to herein as the applicant.
As used in this article, the following terms shall have the
meanings indicated:
CONSUMER SERVICE LINE
That portion of a water service line comprised of the supply
pipe with appurtenances extending from the curb box to the inside
of the wall of the building or premises supplied.
FIRE SERVICE LINE
A water service line which runs directly from the Village
main to a fire suppression system or standpipe system at the building
or premises supplied, and which may include a branched consumer service
line just prior to the fire suppression or standpipe system. Fire
services lines are not typically served by a curb box, and are not
metered.
STREET SERVICE LINE
That portion of a water service line comprised of the supply
pipe with appurtenances extending from the water main in the street,
and including the individual service shutoff valve located typically
in the area between the structure or use served and the traveled way
(the "curb box"). From the point of such individual service shutoff
valve the service line shall be considered the responsibility of the
consumer. The size of the street service connection is defined as
the diameter of the pipe between the tap in the main and the individual
service shutoff valve.
WATER SERVICE LINE
A water line with appurtenances which provides municipal
water to a property or premises, running between the Village's
water main and the point of use.
A. All water service lines shall be laid in a separate trench on solid
footing at least 18 inches laterally distant from any other underground
facility. The placing of water service lines in the same trench as
that occupied sewer pipe, gas pipe, or other utility lateral connections
will not be permitted except by special written authorization of the
Water Department under extraordinary circumstances, including cases
where solid rock is encountered.
B. All water service lines shall be laid as to be at all points at least
four feet below the surface of the ground and at least four feet laterally
distant from any open excavation or vault, and such conditions shall
be maintained as long as such water service line is used. Water service
lines shall be installed in a straight line from the main in the street
to the building and shall be at right angles to the main or the front
street line of the premises if the main is in an unusual location.
Where this layout is not feasible because of solid rock or other considerations
which the Water Department considers significant, permission may be
granted to lay the line according to some other form of generally
accepted good practice. If permission is granted to lay the line from
the main to the building by a route other than a straight line at
right angles to the water main or front street line, the owner shall
furnish to the Water Department a plan certified by a professional
engineer or surveyor, showing the exact location of the water service
line as installed with dimensions to a sufficient number of fixed
points so that the line can be readily located at a future date.
C. Water service lines shall be laid for a minimum of two feet at a
right angle to the Village water main.
D. All labor, material and equipment to install water service lines
shall be the responsibility of the applicant.
E. All ditching or excavating for a water service line shall be to a
depth of four feet, and no backfilling or covering of a water service
line shall be done until the completed water service line has been
approved by the Village.
F. Tapping and making connections to the mains or water pipes of the
Village or to privately owned pipes supplied with Village water must
in all cases be done by employees or agents of the Board of Water
Commissioners. If connections are made on any private line by other
than Water Board employees or authorized representatives, without
the permission of the Board of Water Commissioners, the same shall
constitute a violation of these regulations and shall be sufficient
cause for cutting off the supply of water without notice.
A. Charges for street service lines and fire service lines as set forth
by resolution of the Village Board of Trustees in the Master Fee Schedule,
as same may be amended from time to time, shall be paid by the applicant.
All labor, material and equipment to install a street service line
or fire service line from a Village water main to the point of use
shall be the responsibility of the owner.
B. All new and replacement street service lines and fire service lines
shall be Type K copper tubing and shall not be less than one inch
in diameter. A street service line or fire service line larger than
two inches shall be ductile iron water pipe.
C. Tapping of a Village water main for the insertion of a corporation
cock for street service or fire service lines shall be performed by
employees or agents of the Village. The applicant shall be responsible
for the installation of the street service line or fire line which
shall not be less than one inch in size. Connections to a Village
water main larger than one inch shall be accomplished by the use of
a split sleeve and valve. The consumer shall obtain the required street
opening permit, perform all trench work, install all piping, and remain
responsible for all backfilling and repaving incidental to the installation
of the street service line or fire service line.
D. The Water Department and Building Department may maintain a list
of private contractors who are preapproved to install street service
lines or fire service lines. All costs and charges in connection with
such services are to be negotiated between the applicant and contractor
directly and paid by the applicant. The Village shall have no responsibility
whatsoever for the performance by or cost and charges of any such
contractor. The applicant shall release and indemnify the Village,
its departments, officers and employees from any acts or omissions
of such contractors, and any claim, damage, loss, cost or expense
incurred as a result of the engagement of such contractors. It is
agreed that the said list is provided for the convenience of applicants
only.
E. Only one street service line or one fire service line will be allowed
for each building or group of buildings in a single property or holding,
except that the Water Department may allow, or may require, one or
more additional street service lines and meters and/or one or more
fire service lines, if, in its judgment, unusual physical conditions
or demand characteristics warrant them. The applicant, in such cases,
shall pay the additional charges at the prevailing rates prescribed
for the various sizes of street and fire service lines.
F. A street service line shall have an approved shutoff valve at or
about the property line of the premises being served thereby; and
an approved pressure-reducing valve and strainer shall be installed
on the street side of the water meter unless otherwise authorized
by the Village.
G. The Water Department will, at its expense, maintain and repair the
section of the street service line from the corporate cock to and
including the curb cock and curb box. Leaks which may develop in a
street service line through no fault of the owner of the property
served shall be repaired by the Village.
H. If a property owner desires to have its street service line or fire
service line enlarged, replaced, or renewed, because of lack of pressure
or for any other reason, it shall do so at its sole cost and expense.
I. The following shall apply with respect to abandoned water service
lines:
(1) A street service line or fire service line considered to be abandoned
by the Board of Water Commissioners shall be shut off at the Village
water main after notice to the owner of the property served thereby,
and all expenses incurred, including the cost of opening the street,
shall be paid by the owner of the premises.
(2) In the event that a building or structure having a street or fire
service line is demolished and torn down, the said water service lines
must be shut off at the Village water main, after notice to the owner
of the property served thereby, and all expenses incurred, including
the cost of opening the street, shall be paid by the said owner of
the property.
(3) Any new structure erected on said property shall be serviced by completely
new water service lines.
A. All new and replacement consumer service lines shall be Type K copper
tubing and shall be not less than one inch in diameter.
B. On a consumer service line of two inches and under, an approved bronze
globe valve of equal size to such service line shall be installed
on each side of the water meter.
C. On a consumer service line larger than two inches, an approved bronze
fitted globe valve shall be installed on the street side of the water
meter; an approved bronze check valve shall be installed on the premises
side of the water meter; and a test bypass shall be installed around
the water meter. The test bypass shall not be less than 3/4 inch in
size and shall be of brass pipe and fittings, and shall include a
test water meter of equal size and an approved globe valve on each
side of the test water meter.
D. Only plumbers duly licensed in Westchester County, New York shall supply labor or material in connection with the installation of consumer service lines, and the work performed by them shall strictly conform with these regulations and with Chapter
252, Plumbing, of the Village of Elmsford.
E. Consumer service line replacement and alteration.
(1) The maintenance and renewal of all supply piping from the outlet
side of the curb stopcock is the responsibility of the property owner.
If the Water Department shall determine that a consumer service line
is in need of repair or that an entirely new line shall be constructed
as a result of leakage, corrosion or other cause, the consumer shall,
upon notice and order from the Water Department, make such repairs
or installations as are required. In the event of failure on the part
of the consumer to initiate the making of such repairs within three
days after said notice has been given, the water may be shut off until
the requirements of the Water Department have been complied with.
(2) Requirements at and ahead of meter. No change in a consumer service
line shall be made after the meter has been installed except by permission
and authorization of the Water Department. No lateral branch or fixture
shall be placed on the street side of the meter. A stop cock or valve
shall be placed in the service pipe near to and on the street side
of the meter. A stop and waste cock shall be set on the outlet side
of the meter. The property owner shall be responsible for the proper
operation and or replacement of inoperable stop valves for the removal
and service of the water meter.
F. All pipes from the curb cock to the building shall be left exposed
until the pressure is on the line and it is inspected by the Water
Department and Village Plumbing Inspector.
G. No connections shall be made in a consumer service line between the
water meter and the Village water main.
A. A fire service line for private fire protection purposes may be secured
from the Village upon application by the owner of the property involved.
A drawing showing the proposed location of all valves, pipes, hydrants,
sprinkler heads and other appurtenances to be installed shall be submitted
with the application.
B. The cost of installation of fire service line, including an approved
type of check valve located in a pit or vault, if required, shall
be borne entirely by the applicant.
C. No connection shall be made at any time between the fire protection
system and the regular water supply on the premises or any other supply,
regardless of source, unless specifically approved by the Water Department.
A fire service line is exclusively for fire protection purposes, and
the use of water from this service for any other purpose whatsoever
is prohibited except that upon approval duly issued by the Water Department
and Building Department, a consumer service line may be permitted
to branch off to serve the building or premises so served subject
to all requirements for consumer service lines herein. Any violation
of these provisions shall be sufficient cause for discontinuing such
service until reasonable assurance is given that the offense will
be discontinued and not repeated.
D. Each property owner, other than the owner of a one-family or two-family
residence, shall pay an annual service line charge for each unmetered
fire sprinkler system, unmetered fire standpipe system and unmetered
fire hydrant installed at the premises. The annual service line charge
for a connection of four inches or smaller and a connection larger
than four inches shall be as set forth by resolution of the Village
Board of Trustees in the Master Fee Schedule as same may be amended
from time to time. Service line charges for fire sprinklers, fire
standpipes and fire hydrants shall be payable quarterly and shall
be billed to the property owner quarterly.
A. No water service line to any premises shall be installed or maintained
by the Water Department unless the water supply is protected as required
by New York State regulations and this Code.
B. Service of water to any premises may be discontinued by the Department
if a required backflow preventative device is not installed, tested,
and maintained; if any defect is found in an installed backflow preventive
device, it is found that a backflow preventive device has been removed
or bypassed or if unprotected cross-connections exist on the premises,
services will not be restored until such conditions or defects are
corrected.
C. The Water Department Foreman and/or his designated representative
shall notify the owner, or authorized agent of the owner, of the building
or premises in which there is found a violation of these regulations,
of such violation. The Water Department Foreman shall set a reasonable
time for the owner to have the violation corrected. Upon failure of
the owner to have the defect corrected by the end of the specified
time interval the Water Department Foreman may, if in his judgment
an imminent health hazard exists, cause the water service to the building
or the premises to be terminated, and/or recommend such additional
fines or penalties to be invoked as herein may be provided.
In all cases where the water has been shut off for any justifiable
reason whatsoever, it shall not be turned on again until a fee as
set forth by resolution of the Village Board of Trustees in the Master
Fee Schedule as same may be amended from time to time is paid to cover
the cost of cutting off and turning on the water service. If it is
found that the water has been turned on without payment of the above
charge, it shall be lawful for the Board of Water Commissioners to
cause the tap to be withdrawn, and it shall not again be inserted
until all unpaid water rents and charges have been paid and, in addition
thereto, the reasonable cost of withdrawing and replacing the tap.
A property owner wishing to discontinue the use of water when
the property is temporarily vacated must provide the Board of Water
Commissioners written notice of at least 24 hours, upon the receipt
of which, the water shall be turned off at the curb. Such discontinuance
shall require a special meter reading, and such notice shall be accompanied
by a fee for removing and draining the meter as set forth by resolution
of the Village Board of Trustees in the Master Fee Schedule as same
may be amended from time to time. To recommence service to said property,
the property owner must reapply for water service and a new meter
will be required to be installed at the property owner's sole
cost and expense. The bill for water rents will be a charge against
the property, and the owner will be responsible for the use of water
up to the time of such special meter reading, and the owner must again
file a written request to have the water turned on.
Where water is wastefully or negligently used on a consumer's
premises seriously affecting the general service, the Water Department
may discontinue the service to such premises if conditions are not
corrected within 24 hours after giving the consumer written notice,
or, if an emergency exists, it may discontinue service at any time
without notice.
The Board of Water Commissioners shall be notified in writing
upon 24 hours' notice prior to an owner performing any test to
measure the water used.
No person owning or occupying premises receiving water service
from the Village shall make, or allow to be made, any connection or
cross-connection, either of a direct or of an indirect nature, between
his piping system and a water supply from any other source, or install,
or allow to be installed, any fixture or appliance, or waste or soil
pipe from which water may flow, be siphoned or be pumped into any
piping connected to the Village water system.
In cases where boilers or other appliances in a premises depend
upon the pressure in the service line to keep them supplied with water,
the owner or occupant shall place suitable safety devices as approved
by the Building Inspector to guard against the possibility of collapse
or explosion when the water supply is interrupted. Likewise such owner
or occupant shall protect water-cooled compressors for refrigeration
systems by means of high-pressure safety cutout devices and shall
provide means for the prevention of the transmission of water hammer
or noise of operation of any valve or appliance through his piping
to any adjacent premises. Failure of the owner or occupant to provide
such safety devices shall in no manner make the Village responsible
for any resulting damage.
The Village shall not be liable for failure to supply water
to any consumer if the supply of water shall fail for reasons and
causes beyond the control of the Board of Water Commissioners; neither
shall the Village be liable for any damage occurring on any premises
resulting from variations in water pressure in the Village water mains
or for the cutting off and restoring of water service, whether or
not previous notice has been given. The Board of Water Commissioners
reserves the right to control the amount of water supplied in the
event that the supply of water becomes short for any reason whatsoever.
The Water Department shall have the right to shut off the water in
the mains temporarily to make repairs, alterations, or additions to
the plant or system, but the Village will not be responsible for damages
resulting directly or indirectly from any interruption of the water
supply.
A. Except with respect to water service lines, the Water Department
will operate, maintain and, where necessary, replace all existing
mains and appurtenances, fire hydrants and other facilities within
the territory of any street or any easement that is under the jurisdiction
of the Village, except that repair of damage to hydrants and other
facilities, resulting from the collision or any other external cause,
shall be paid for by the person causing damage.
B. New mains and appurtenances will be furnished and installed by the
owner or developer of the premises to be served at his own expense,
and as approved by the Water Department.
A. No unauthorized person shall open or close any valve, hydrant or
curb cock, meter or other fixture or appurtenance connected with the
water system of the Village. The Water Department shall control all
mains, taps, gate valves, street service lines, curb stopcocks, curb
and gate valve boxes, and meters and may, whenever such facilities
are operated or interfered with in any manner which is in violation
of these rules and regulations, discontinue the water service to the
premises involved, which action shall be in addition to any penalties
provided herein.
B. No person shall, except with a permit from the Water Department,
allow contractors, masons, or other unauthorized persons to take water
from his premises by operating any valve connected with the distribution
system.
A. Fire hydrants are for the sole use of the Water Department and the
Fire Department of the Village of Elmsford, except under special circumstances
and with permission of the Water Department. Tampering with any fire
hydrants or the unauthorized use of water there from is a violation
of this article.
B. No person except authorized employees of the Board of Water Commissioners
and members of the Village Fire Department shall be permitted to take
water from the fire hydrants or standpipes for any purpose whatsoever,
without first having obtained a permit from the Board of Water Commissioners
so to do.
C. In cases where no other supply is available, permission may be granted
by the Water Department for temporary metered use of a hydrant. Permits
for the use of hydrants for filling sprinklers, sweepers, sprayers,
and other equipment apply only to such hydrants as are designated
for such use. Such permit shall be granted upon the payment of a deposit
as set forth by resolution of the Village Board of Trustees in the
Master Fee Schedule as same may be amended from time to time against
damages to the hydrant and for the water consumed, plus an amount
equal to the prevailing fee established by resolution of the Board
of Trustees in the Master Fee Schedule as same may be amended from
time to time for the size of the water meter used. Such deposit shall
be in the form of cash or certified or official bank check. Such deposit
shall be refundable upon the satisfactory liquidation of any charges
for repairs or services and for any water consumed which result from
use of the hydrant. The Village reserves the right to apply any such
charges to the deposit before making a refund.
D. If a property owner or other party desires a change in the location
of a fire hydrant, he shall bear all costs of such change. Any change
in location of a fire hydrant must be approved by the Village Board
of Trustees. Any such change shall be coordinated with the Village
Fire Department.
E. There shall be no liability upon the part of the Village with respect
to any fire hydrant located on private property.
For the purpose of the supervision of these regulations, the
Foreman of the Water Department of the Village shall have jurisdiction
and the charge and supervision over all the works and property under
the control of the Board of Water Commissioners. He will receive and
carry out all orders of the Board of Water Commissioners, and he is
authorized and required to enforce all orders, ordinances and regulations
of the Board. He shall have control of all employees and laborers
employed upon the work under his charge.
The owner or authorized agent of the owner responsible for the
maintenance of the plumbing systems in the building or premises, who
knowingly permits a violation to remain uncorrected after the expiration
of time set by the Water Department Foreman shall, upon conviction
thereof by the court, be required to pay a fine not in excess of $500
for each violation. Each day of failure to comply with the requirements
of these regulations shall constitute a separate violation.
The Water Department, with the approval of the Board of Trustees,
shall determine the charges and rates in special cases to cover unusual
conditions or types of service not contemplated in these regulations
or in the rates and charges set by the Board of Trustees for regular
service. No consumer will be allowed to supply water for any commercial
purpose, and no owner or occupant shall use water from other premises,
unless specific permission has been obtained in each case from the
Water Department. The Department has the right to require, during
a temporary period of emergency, that a consumer allow it to connect
an adjacent premises to such consumer's piping, but in such case
allowance will be made for any excess water registered on his meter.
