Any and all ordinances or proposed
ordinances originating from the Parks and Recreation Department of
the City shall be reviewed and approved by the City Parks and Recreation
Commission and submitted to the City Council for their review and
final approval.

The following terms, phrases, words
and their derivations shall have the meaning given herein. When not
inconsistent with the context, words used in the present tense include
the future, words in the plural number include the singular number,
and words in the singular number include the plural number. The word
"shall" is always mandatory. The word "may" is suggestive.
AUTHORIZED
Any City employee or other person or organization authorized
by the Parks and Recreation Director.
CITY
The City of Washington, Missouri.
PARK
A park, reservation, playground, recreation center, or any
other area in the City, owned or used by the City, and devoted to
active or passive recreation.
PERSON
Any person, firm, partnership, association, corporation,
company, or organization of any kind.
VEHICLE
Any wheeled conveyance, whether motor-powered, animal-drawn,
or self-propelled. The term shall include any trailer in tow of any
size, kind, or description. Exception is made for baby carriages and
wheelchairs, and vehicles in the service of the City Parks.

A. It shall be unlawful for any unauthorized
person to:
1.
Disfiguration And Removal. Willfully
mark, deface, disfigure, injure, tamper with or displace or remove,
any building, bridge, tables, benches, fireplaces, railings, paving
or paving materials, water lines or other public utilities or parts
or appurtenances thereof, signs, notices, or placards, whether temporary
or permanent, monuments, stakes, posts, or other boundary markers
or other structures or equipment, facilities or park property or appurtenances
whatsoever, either real or personal.
2.
Restrooms And Washrooms. Fail to
leave the restrooms and washrooms in a clean and sanitary condition.
No person over the age of four (4) years shall use restrooms and washrooms
designated for the opposite sex.
3.
Removal Of Natural Resources. Dig
or remove any soil, rock, stones, streets, shrubs, or plants, down
timber or other wood or materials, or make any excavation by tool,
equipment, blasting, or any other means or agency.
4.
Erection Of Structures. Construct
or erect any building or structure of whatever kind whether permanent
or temporary in character, or run or string any public service utility
into, upon, or across such lands.
5.
Injury And Removal. Damage, cut,
carve, transplant or remove any tree or plant or injure the bark,
or pick the flowers or seeds of any tree or plant. Nor shall any person
attach any ropes, wire, or other contrivance to any tree or plant.
A person shall not dig in or otherwise disturb grass areas, or in
any other way injure or impair the natural beauty or usefulness of
any area.
6.
Climbing Trees, Etc. Climb any tree
or walk, stand or sit upon monuments, vases, fountains, railings,
buildings, fences or upon any other property not designated for such
purposes.

A. It shall be unlawful for any person to:
1.
Pollution, Discoloration Or Contamination
Of Waters. Throw, discharge, or otherwise place or cause to be placed
in the waters of any fountain, pond, lakes, stream, or any other body
of water in or adjacent to any park or any tributary, stream, storm
sewer or drain flowing into such waters, any substance, matter or
thing, liquid or solid, which shall result in the pollution, discoloration
or contamination of said waters.
2.
Refuse And Trash. Dump, deposit or
leave any bottles, broken glass, ashes, paper boxes, cans, dirt, rubbish,
waste, garbage, refuse, or other trash on or in park properties, except
in the proper receptacles where these are provided. Where receptacles
are not so provided, all of the aforementioned rubbish and waste shall
be carried away from the park by the person responsible for its presence,
and properly disposed of elsewhere.

A. It shall be unlawful for any person to:
1.
Fail to comply with all City ordinances
and applicable provisions of the State motor vehicle traffic laws
in operating equipment and vehicles in all City parks.
2.
Close, barricade, or block any streets
or roads within park boundaries without obtaining prior approval from
the Director of Parks and Recreation and the Chief of Police. In the
case of special events such as fairs, rodeos, demolition derbies,
etc., the sponsor of such event shall coordinate the traffic flow,
temporary parking areas, and closing of streets with the Director
of Parks and Recreation and the Chief of Police. After the above-mentioned
plan is approved by the Parks and Recreation Director and Chief of
Police, the City Parks and Recreation Commission shall give final
approval of such plan and activity.
3.
Fail to observe carefully all signs
which are posted for proper control of the parks and to safeguard
life and property.
4.
It shall be unlawful for any person
to drive or ride any vehicle upon any walkway or other area, paved
or grass, except those designated as roads or parking areas by the
Park Board during such times as the Park Board shall permit.
5.
Park a vehicle on other than an established
parking area or on temporary parking areas established by the Director.
6.
Operate a motor vehicle on a pathway
or trail designated for hiking and/or bicycle use only.

A. It shall be unlawful for any person to:
1.
Fireworks And Explosives. Bring or
have in his/her possession or set off or otherwise cause to explode
or discharge or burn, any fireworks, torpedo, rocket, or other fireworks
or explosives of inflammable material, or discharge them or throw
them into any such area from land or highway adjacent thereto. This
prohibition includes any substance, compound, mixture, or article
that in conjunction with any other substance or compound would be
dangerous from any of the foregoing standpoints, except under the
sponsorship of organized groups and with the permission of the City
Parks and Recreation Commission and approval of the City Council.
2.
Fires. Build or attempt to build
a fire except in barbecue pits and other areas as may be designated
by the Director.
3.
Closed Areas. Enter an area posted
as "Closed to the Public"; nor shall any person use, or abet the use
of any area in violation of posted notices.
4.
Games Of Chance. All games of chance
must be in accordance with Washington City ordinances and State laws.
5.
Going Onto Ice. Go onto the ice of
any of the waters except such areas as are designated as skating fields,
and provided a safety signal is displayed.
6.
Loitering And Boisterousness. Sleep
or protractedly lounge on the seats, or benches, or other areas; or
engage in loud, boisterous, threatening, abusive, insulting or indecent
language; or engage in any disorderly conduct or behavior tending
to breach the public peace.
7.
Exhibit Permits. Fail to produce
and exhibit any permit from the Director or his/her designated agent
upon request of the Director, park attendants, auxiliary police, or
Police who shall desire to inspect the same for the purpose of enforcing
compliance with this Chapter and other park rules.
8.
Interference With Permittee. Disturb
or interfere unreasonably with any person or party occupying any area,
or participating in any activity, under the authority of a permit
issued by the Director or his/her designated agent.
9.
Dogs. Allow any dog in his/her possession to be at large on park property unless properly restrained. Words and phrases shall have the meanings ascribed to them as set forth in Section
205.140 of the Washington City Code.

A. Is shall be unlawful for any person to:
1.
Vending And Peddling. Expose or offer
for sale any article or thing; nor shall he/she station or place any
stand, cart, or vehicle for the transportation, sale, or display of
any such article or thing. Exception is here made to any person acting
by and under the authority of the Director.
2.
Permanent Signs. Paste, glue, tack
or otherwise post any sign, placard, advertisement or inscription
whatever; nor shall any person erect or cause to be erected any sign
whatever, on any park lands.
3.
Temporary Signs. Leave any sign,
placard, advertisement, or inscription longer than a period of twenty-four
(24) hours after a special event, as heretofore mentioned in this
Chapter, is over. If any of the aforementioned items are left longer
than the set period, the Director shall have the authority to have
the above items removed.
4. Athletic Field Advertising. Advertising banners are allowed on athletic
field fencing for a fifty dollar ($50.00) fee, per banner per season,
subject to an approved application by the Parks and Recreation Department.

A. It shall be unlawful for any person to:
1.
Designated Areas. Swim, bathe, or
wade in any waters, lakes or waterways in any park, except in such
waters and at such places as are provided therefor, and in compliance
with such regulations as are set forth or may be hereafter adopted.
Nor shall any person frequent any waters customarily designated for
the purpose of swimming or bathing, or congregate thereat, when such
activity is prohibited upon finding that such use of the water would
be dangerous or otherwise inadvisable.
2.
Certain Hours. Frequent any waters
or places designated for the purpose of swimming or bathing, or congregate
thereat, except between such hours of the day as shall be recommended
by the Director, and approved by the City Parks and Recreation Commission.
3.
Designated Areas. Bring into or operate
any boat, raft or other watercraft upon park waters except at places
designated for boating by the Director.
4.
Boat Motors. Use any motors on any
boat, raft or other watercraft upon any park waters except the use
of electric trolling motors. Nothing herein shall be construed to
prohibit the operation of model boats upon any park waters.
5.
Operation Of Boats. Navigate, direct
or handle any boat in such manner as to unjustifiably or unnecessarily
annoy or frighten or endanger any person.
6.
Prohibition During Closed Hours.
Launch, dock or operate any boat of any kind on any waters between
one-half (1/2) hour after sunset and opening hour the following morning,
nor shall any person be on, or remain on or in, any boat during the
closed hours of the park.
7.
Life Preservers. Remain on or in
any boat unless a Coast Guard approved life preserver is provided
for each occupant of the boat.
8.
Fishing Laws. Fail to observe the
State fishing laws. In addition, the daily limit for harvest of channel
catfish for anyone fishing in any pond or lake upon City property
is three (3) and the daily limit for harvest of all species of bluegill
for anyone fishing in any pond or lake upon City property is ten (10).
9.
Equipment. Use any net, trap, gig
or other device other than use of hook and line to obtain fish from
park waters.
10.
Frogs. Use any gig, net, trap or
other device to obtain frogs from park waters.
11.
Hunting And Firearms. Hunt, trap
or pursue wildlife at any time. No person shall use, carry or possess
firearms of any description, or air rifles, spring guns, bows and
arrows, slings or any other forms of weapons potentially inimical
to wildlife and dangerous to human safety, or any instrument that
can be loaded with fire blank cartridges, or any kind of trapping
device except the use of bows and arrows at archery ranges as established
by the Director. Shooting into park areas from beyond park boundaries
is forbidden. This provision shall not apply to any programs presented
by the Parks Department.
12.
Picnic Area Availability. Violate
the use of the individual fireplaces, shelter houses, tables and benches
which follows generally the rule of first-come, first-served.
13.
Duty Of Picnicker. Leave a picnic
area before the fire is completely extinguished and before all trash
and other refuse is placed in the disposal receptacles where provided.
If no such receptacles are available, refuse and trash shall be carried
away from the park area by the picnicker to be properly disposed of
elsewhere.
14.
Camping. Camp or sleep in the parks
and other than in designated areas recommended by the Director and
approved by the City Parks and Recreation Commission. No person shall
camp or sleep overnight at any park unless first obtaining a permit,
not to exceed six (6) consecutive nights, from the Director of Parks.
The permit shall be displayed in a place visible to all representatives
of the City. Camping includes all tents, shacks, shelters or special
vehicles to be used or that could be used for such purposes.
15.
Horseback Riding. Ride a horse except
on designated bridle trails as recommended by the Park Director and
approved by the City Parks and Recreation Commission. Where permitted,
horses shall be thoroughly broken and properly restrained, and ridden
with due care and shall not be allowed to graze or go unattended,
nor shall they be hitched to any rock, tree or shrub.
16.
Games. Roller skate or play street
hockey unless said games are confined to those areas specifically
designated as such as recommended by the Director and approved by
the City Parks and Recreation Commission. Nor shall any person take
part in or abet the playing of any games involving thrown or otherwise
propelled objects which would endanger the safety and welfare of the
park users.
17.
Model Airplanes And Airborne Devices.
Use, fly or otherwise cause to become airborne on or over any park
property any model airplane, helicopter or similar airborne device,
if such device is operated by some type of electric, gas or other
self-contained motorized power, whether such device shall have been
unprogrammed, pre-programmed or controlled by a remote controlled
device of any type.

A. Except for unusual and unforeseen emergencies,
parks shall be open to the public every day of the year during designated
hours.
B. Opening and closing hours of all City of
Washington parks, except the Rotary Riverfront Trail and Burger Park,
shall be 6:00 A.M. till 12:00 Midnight, unless participating in any
activity approved by the Director of the City of Washington Parks
and Recreation Department. Rotary Riverfront Trail and Burger Park
shall be open from sunrise to sunset unless participating in any activity
approved by the Director of the City of Washington Parks and Recreation
Department. Sunrise and sunset shall be as determined by the Astronomical
Applications Department of the United States Naval Observatory for
Washington, Missouri. Any organization, group or individual who sponsors
an activity lasting after 12:00 Midnight shall get prior approval
from the Director of the City of Washington Parks and Recreation Department
for said activity and shall provide the Director of the City of Washington
Parks and Recreation Department with a list of participants where
practical.

A. The Director and any authorized park attendant
shall have the authority to eject from the park any person acting
in violation of this Chapter.
B. The Director and park attendants shall,
in connection with their duties, diligently cooperate with the Police
Department to insure the enforcement of the provisions of this Chapter.
C. Any person violating any of the provisions
of this Chapter is guilty of an ordinance violation and upon conviction
shall be punished by a fine not to exceed five hundred dollars ($500.00)
or by confinement in the City Jail for a period not to exceed ninety
(90) days, or by both such fine and imprisonment.

B. Reservations
For Facility/Activities And Payments. Reservations for facilities
and sign ups for activities must be made in person. For reservations
for facilities a deposit of one-half (1/2) the rental fee must be
made at time of reservation and balance must be paid prior to date
of reservation. If an activity, payment must be made at time of sign
up.
C. Cancellation.
Cancellations must be made sixty (60) days prior to event to receive
a refund with the exception of weather-related cancellations. The
Parks Department must be notified the following business if reservation
was not used due to weather. Renter may request a different rental
date. If date is not available, a refund will be given.
D. Liquor
Laws. All State laws must be adhered to.
E. Insurance
Requirements. The City of Washington will follow the guidelines of
their insurance company when requesting insurance for activities scheduled
by users.
F. Hours
Of Use. The Washington Parks and Recreation Department shall be authorized
to establish reasonable regulations relating to time, hours and days
for rental use.

A. There is hereby established the Friends
of the Park program, the purpose of which is to improve the City of
Washington parks and trails.
B. Any person desiring to become a member
of the Friends of the Park may do so:
1.
By contributing not less than five
thousand dollars ($5,000.00) annually; or
2.
By donating goods and services of
a value not less than five thousand dollars ($5,000.00) annually.
C. Any person who is a member of the Friends
of the Park shall be entitled to use of the City of Washington parks
and trails, excluding athletic fields, with a fifty percent (50%)
discount of the user fees set forth in Section 265.110of the Code
of the City of Washington, Missouri.
D. For purposes of this Section, the term
"person" shall include any person, firm, partnership, association,
corporation, company or organization of any kind.
