A. The
Zoning Administrator shall be appointed by the City Council, who shall
also be one and the same as the "Code Official". The Code Official
shall be an "at will" employee. The Zoning Administrator, officer
or employee charged with the enforcement of this Title, while acting
for the jurisdiction, shall not thereby be rendered liable personally
and is hereby relieved from all personal liability for any damage
accruing to persons or property as a result of any act required or
permitted in the discharge of duties. Any suit instituted against
an officer or employee because of an act performed by that officer
or employee in the lawful discharge of duties and under the provisions
of this Code shall be defended by the representative of the jurisdiction
until the final termination of the proceeding. The Zoning Administrator
or any subordinate shall not be liable for costs in any action, suit
or proceeding that is instituted in pursuance of the provisions of
the ordinance; and any officer of the Department of Zoning, acting
in good faith and without malice, shall be free from liability for
acts performed under any of its provisions or by reason of any act
or omission in the performance of official duties in connection therewith.
His/her administrative functions shall include, but not be limited
to, the duties as prescribed below.
1. Provide necessary forms and applications;
2. Issue land use permits upon demonstration of the applicant's compliance
with the provisions of this Title and with proper authorization from
the City board so designated to review such permit applications or
upon instruction from the City Council or from a court of competent
jurisdiction;
3. Issue certificate of compliance;
4. Issue any permits authorized by the City Council or Board of Adjustment;
5. Identify and record information relative to non-conforming uses and
structures;
6. Provide assistance in zoning changes and amendments to the ordinance
text or map;
7. Maintain files of applications, permits and other relevant documents;
8. Make an annual report of his/her activities to the City Council,
to the Planning and Zoning Commission and to the Board of Adjustment.
