The Darien sewerage utility deregulated in 1995 when the Village
became a user of the Walworth County Metropolitan Sewerage District.
As a user of the Walworth County Metropolitan Sewerage District, the
Village shall be considered as having agreed to be bound by their
rules and regulations which may, from time to time, be amended.
Village of Darien Ordinance No. 153, adopted August, 1995, adopted
by reference. Walworth County Metropolitan Sewerage District's
Ordinance No. 82.001, dated 5-4-1982 and Village of Darien Ordinance
No. 217, adopted by reference Walworth County Metropolitan Sewerage
District's Ordinance No. 96-001 dated 6-11-1996. This adoption
included the incorporation of the operating rules and procedures of
the Walworth County Metropolitan Sewerage District. Excluding:
A. Item 1, delete Article III, entitled "Annexation of Territory," in
its entirety, since this issue will be addressed in the Village's
connection agreement with WalCoMet;
B. Item 2, delete Section 507 of Article V, entitled "Connection Fee,"
in its entirety, since it is not applicable to the Village;
C. Item 3, delete Article IX, entitled "Sewer Service Charges," in its
entirety, and replace with the following:

The Darien Sewage System includes all street laterals, main
and intercepting sewers, and structures by which sewage or industrial
waste is collected and transported to the Walworth County Metropolitan
Sewerage District Lift Station. This shall not include plumbing inside
or in connection with buildings served, or service sewers from a building,
to street lateral.

Unless the context specifically indicates otherwise, the meaning
of terms used in this chapter shall be as follows:
BOARD
The Village Board of such Village.
SUPERINTENDENT
The superintendent of the Darien waterworks and sewerage
system or his or her authorized deputy, agent or representative.
VILLAGE
The Village of Darien, Walworth County, Wisconsin.

All persons now receiving sewer service from the Darien sewerage
system or who may hereafter make application therefor, shall be considered
as having agreed to be bound by rules and regulations of the Darien
sewerage utility.

User classifications are as follows:

A. Application for service may be done in writing or by phone if no
plumbing permits are required.
1. The name of the property owner;
2. The billing name and address bill should be mailed to.
B. If a plumbing permit is required, a legal description of the property
to be served.
C. If a plumbing permit is required, a list of the number and type of
plumbing fixtures to be connected.
D. An application for disposal of industrial waste shall include in
addition, the following:
1. Estimated volume of waste;
2. Variation in rates of discharge;
3. Characteristics of waste; and
E. The applicant for service agrees to follow the Darien "Design Standards
and Construction Specifications."

The Village will set the rate annually based on the anticipated
billing units expected in the upcoming year. This rate will be set
by dividing the annual budget by the expected billable flow, during
the Village's normal annual budget cycle. The annual rate will
be noticed to users on their domestic water bills.
This flow related user charge rate will include the cost of
the Village's operation, maintenance, equipment replacement,
and debt as incurred directly by the Village or billed by WalCoMet.
The rate will be evenly divided among all users to assure a proportionate
distribution of costs.
