A. The
term "hospital" as used in this Section means any
premises, building, or institution maintained for the medical treatment
or physical care of the sick, aged, or infirmed, such as those ordinarily
called hospitals, sanitariums or nursing homes.
B. It
shall be unlawful for any person to operate, conduct, or maintain
a hospital in the City of Berkeley without a license. Application
for such license shall be made upon such forms as the Director of
Finance may prescribe, and shall contain a statement of the location
and bed capacity of such hospital.
C. The
Chief of Police and Health Department shall examine the premises and
verify the accuracy of the statements contained in the application
upon the report of the Chief of Police and Health Department, if the
application is found to be correct, the Director of Finance shall
issue such license upon the payment of the license fee as prescribed.
D. If
no license is obtained by any person so operating or maintaining a
hospital on or before January thirty-first (31st) of any year, he/she
shall be deemed delinquent, and the license fee shall be increased
ten percent (10%) per month or part thereof that such delinquency
shall continue thereafter. If any person begins the operation of a
hospital after June thirtieth (30th) of any year, the license fee
for the balance of the year shall be two dollars fifty cents ($2.50)
for each bed so maintained therein.
