This chapter shall be known as Local Law No. 1 of the year 2013
and be titled "Parades and Gatherings."
The purpose of this chapter is to preserve and promote the safety,
health and well-being of persons and property in the Town of Marilla
through the licensing and regulation of public parades, gatherings,
demonstrations or assemblies in the Town of Marilla.
No parade on Town roads and property, public gathering, demonstration
or assembly within the Town of Marilla, on any street, highway, sidewalk,
square, park or other public place, to which the public is invited
or has access to, shall be held unless authorized by a written permit
approved by the Town Board of the Town of Marilla and issued by the
Town Clerk. The regulations specified herein shall not apply to any
concert, parade, public gathering, demonstration or assembly sponsored
by the Town of Marilla.
No permit shall be approved until a public hearing has been
held before the Marilla Town Board to consider such application. At
least 10 days' notice of the time and place of such hearing shall
be published in the official newspaper of the Town of Marilla.
No permit shall be issued until the applicant has executed,
acknowledged and delivered to the Town of Marilla an agreement to
indemnify the Town in connection with liability and claims arising
from and in connection with parade, public gathering, demonstration
or assembly. Such agreement shall be in a form as approved by the
attorney for the Town of Marilla.
There shall be a fee of $10 for such application for permit;
however, the Town Board shall, where appropriate, request that a bond
be posted as a condition of approval for issuance of the permit.
Any violation of any provision of this chapter shall be deemed
a violation punishable by a fine not to exceed $250 or by imprisonment
for a period not to exceed 15 days, or by both. Each day that a violation
of this chapter is committed shall constitute a separate offense.
