The public cemetery lying on the west side of North First Street
and owned by the City is hereby named and designated as Resurrection
Hill Cemetery.

The Sexton shall be appointed by the Mayor, with the approval
of the Board of Aldermen. The Sexton shall be authorized to perform
services hereunder only after the Sexton, or an entity designated
by the Sexton, shall have executed a contract with the City that has
been approved by the Board of Aldermen which contract establishes
the compensation and term for the Sexton's services in compliance
with this Chapter.

Any person desiring to purchase an individual grave or grave
lot in any cemetery owned by the City shall apply to the Sexton for
such grave lot who shall issue to the City Clerk a deed showing the
lot to be sold and upon payment by such individual to the City Collector
the sum of five hundred dollars ($500.00) per grave or seven hundred
fifty dollars ($750.00) for two (2) burials in one (1) space as the
purchase price and all sums received by the City Collector shall be
strictly accounted for and deposited to the credit of the Cemetery
Fund. Such fund and other funds established in this Chapter shall
be separately accounted for by line item or accounting, within the
General Fund or other fund and accounted for in the manner established
for other special escrows of the City; provided that no separate bank
account shall be deemed necessary for any such account.

The Mayor shall issue a deed prepared by the City Clerk for
a grave or lot or any part thereof upon payment of the purchase price
for the same shall have been paid to the City Collector.

A. An owner of a grave or lot in any cemetery owned by the City may
transfer ownership of the grave or lot either by gift or by sale to
another party. No transfer or assignment of any grave or lot, or any
part thereof, or any interest therein, by any grave or lot owner ("owner")
shall be valid, unless a court order or other law otherwise directs,
unless and until the following steps are completed:
1.
The owner shall submit to the Sexton a notarized affidavit (or
use a form as may be prepared by the Sexton):
a.
Stating the intention to dispose of the grave or lot and the
name of the proposed purchaser or recipient of the grave or lot;
b.
Stating that the owner holds legal title to the grave or lot;
and
c.
Attaching the owner's deed for the grave or lot.
2.
The owner shall pay, to the extent permitted by law, a fee of
twenty-five dollars ($25.00) to the City Collector to partly defray
the City's costs in transferring the deed.
3.
Upon determination that there are no unpaid fees related to
the grave or lot and satisfaction of the requirements above, the Mayor
shall cause the old deed to be voided and placed in the public record,
and shall issue a new deed prepared by the City Clerk to and in the
name of the new owner.
4.
The Sexton shall record the transfer in the register of graves described in Section
135.060.
B. The
new owner of the grave or lot may be buried in the grave or lot only
if the new deed has been issued to the new owner at least one (1)
working day prior to the scheduled burial. Nothing in this Section
is intended to alter any existing contractual or property rights.

Persons in destitute circumstances living within the City desiring
a free grave site shall apply to the Mayor therefore; and the Mayor,
in his discretion, may, upon proof of financial hardship and with
the approval of the Board of Aldermen, issue and deliver to such person
a deed to a grave site without charge.

The Sexton shall keep a full and accurate register of all burial
places and graves sold or designated as free, showing the section,
lot, grave number and the name of the person purchasing or receiving
the same. All changes incorporated into such records shall be communicated
to the City within thirty (30) days within the date of such transaction
or interment and a copy of such records shall be maintained by the
City Clerk for public inspection.

Fees for cemetery services shall be paid to the City Collector
in the amounts forth in the table in this Section. Any such fee shall
be divided into two (2) parts, with the first part being transferred
to the Cemetery Fund for maintenance and other costs of the City relating
to the Cemetery and the second part being paid to the Sexton or an
entity designated by the Sexton for the charges relating to performing
the service. Fees shall be paid to the City Collector in advance unless,
for any reason, the City Hall is closed, whereupon fees shall be remitted
on the next business day that City Hall is open. The Sexton shall
perform the service consistent with the regulations established herein.
The minimum services provided by the Sexton and included within the
grave opening fee shall include the digging of the grave, marking
or surveying of the grave location, the closing of the grave site
in addition to such other items as may be required by the City. The
Sexton shall maintain a minimum of eighteen (18) inches of cover over
the burial container at the shallow end of all newly opened graves.

The Sexton shall oversee the maintenance of all City cemeteries
so that they are maintained in a good condition and the grounds thereof
mowed and cleared of undesirable vegetation. The Sexton shall also
perform all grave openings and such other duties established herein.

It shall be unlawful for any person to trespass on the grounds
of the City cemeteries by digging a grave or by burying a body therein
or otherwise excavating or disturbing the grounds, gravestones or
improvements without first obtaining the approval of the Sexton.

It shall be unlawful for any person to hunt upon the grounds
of the City cemeteries.

It shall be unlawful for any person to excavate or work on any
grave or lot in the City cemeteries without first obtaining the permission
of the owner thereof and the Sexton.

A. The
cemetery rules for the Pacific City Cemetery and Resurrection Hill
Cemetery are hereby established to read as follows:
1. Alcoholic beverages prohibited.
3. Commercial trucks and vehicles licensed over twelve thousand (12,000)
pounds prohibited without authorization.
4. Cemetery hours. Open 7:00 A.M., close 8:00 P.M.
year round.
5. Cemetery directory available at Pacific City Hall and Pacific Scenic
Regional Library.
B. These
rules shall be posted at the Pacific City Cemetery and Resurrection
Hill Cemetery.

A. All
interments within any City owned cemetery shall incorporate and utilize
a concrete or steel liner with lid in which the casket will be placed.
Said liner shall be approved by the City Cemetery Sexton prior to
interment and the City Cemetery Sexton shall provide specific requirements
for said grave liners and the same shall be approved by resolution
of the Board of Aldermen.
B. All
cremated or infant interments within any City owned cemetery shall
incorporate and utilize a container approved by the City Cemetery
Sexton, in which the remains shall be placed. The City Cemetery Sexton
shall provide specific requirements as to the type of approved container
and the same shall be approved by resolution of the Board of Aldermen.
