Every animal or fowl except domestic pets, which shall be found
in violation of any of the provisions of this Chapter in the City
shall be promptly captured and impounded by the Animal Control Officer
and/or Police Officers of the City.

A. Any
animal or fowl impounded under the provisions of this Article shall
be kept, fed and watered while in the pound, and immediately upon
the impounding of any such animal or fowl the poundmaster shall notify
the owner or agent thereof in the following manner:
1. If the owner or his agent resides in the City, and is known to the
poundmaster, he or some other member of his family shall have personal
notice, oral or written.
2. If the owner or his agent is known to the poundmaster, but is a non-resident
of the City, notice in writing or printing shall be sent by mail or
private conveyance to such owner or agent.
3. If the owner is unknown, notice shall be given by written or printed
notices posted at the City Hall and at least two (2) other public
places.

The notice provided for this Article shall contain a description
of the animal or fowl impounded hereunder and the date of impounding.

Any animal or fowl impounded under the provisions of this Article
may be released to the owner thereof or his agent by paying the City
all charges incurred by reason of such impoundment; provided however,
the payment of such charges shall not bar prosecution against such
owner or his agent for the violation of this Code.

In the event the owner, or his agent, of any animal or fowl
impounded under this Article shall fail or refuse to redeem the same
within three (3) days of such impoundment, the poundmaster may sell
the same at public auction after giving three (3) days' notice of
such sale to the public; provided however, every sale under this Section
shall be made subject to the owner's right of redemption within three
(3) months.

All money received as a result of the sale of any animal or
fowl impounded under the provisions of this Article shall be paid
over by the poundmaster to the City Treasurer and deposited in the
General Fund of the City.
