The City Marshal, as provided in Section 85.551, RSMo., shall
be the Chief of Police, whom shall be appointed to serve a term of
one (1) year unless sooner removed for being found guilty of misbehavior
in office or other cause during such term.

The Chief of Police shall live within a five (5) mile radius
of the City limits of Richmond, Missouri.

The Chief of Police, in the discharge of his/her duties, shall
be subject to the orders of the Mayor only. All other members of the
Police Department shall be subject to the orders of their superiors
in the Police Department and the Mayor only.

A. If
a vacancy exists, for whatever reason, in the position of Chief of
Police, the Mayor, with the advice and consent of a majority of the
City Council shall appoint a Chief of Police as soon as it is expedient.
B. In
the event that the Mayor and City Council deem it advisable, the Mayor,
with the advice and consent of a majority of the City Council, may
appoint an Assistant Chief of Police to serve a term of one (1) year
unless sooner removed for being found guilty of misbehavior in office
or other cause during such term. Before making such appointment the
Mayor should consult with the Chief of Police and consider his/her
suggestions to such appointment.

The Mayor, with the consent of a majority of all of the members
of the City Council, or the City Council with a two-thirds (⅔)
majority vote of all City Council members, shall have the authority
to suspend, demote or discharge the Chief of Police and Assistant
Chief of Police for misbehavior in office or other cause during the
term of his/her appointment. The Chief of Police and the Assistant
Chief of Police shall have the right of appeal to the City Council
and shall be granted a public hearing. An appeal must be initiated
within forty-eight (48) hours of the suspension, demotion or discharge
action. The decision of the City Council shall be final. If the decision
is in favor of the Chief of Police or the Assistant Chief of Police,
he/she shall be paid all wages lost as a result of the suspension,
demotion or discharge and shall be reinstated with full rights unimpaired.
