No license required by Section
210.250 shall be issued without the owner's first presenting a certificate of immunization against rabies for a dog, which certificate shall be obtained from a licensed veterinarian. The certificate shall be dated not more than sixty (60) days prior to the time application is made; or, if such application is made after March first (1st) within any calendar year, the certificate must be dated within the calendar year in which the license is issued.

In the event a dog or other animal required to be licensed pursuant
to this Chapter is being treated by a licensed veterinarian and cannot
be immunized against rabies, the owner of such animal may present
a statement from such licensed veterinarian that the animal is then
under treatment and cannot be immunized without jeopardizing such
animal's health and that such animal will be immunized by such veterinarian
prior to being released from such treatment. On timely presentation
of such statement to the City Collector, the time for application
for a license shall be deferred until such animal has been immunized.

A. Reporting Animal Bites. All persons, employees, agents and
officers of hospitals, medical clinics, medical centers, veterinarian
offices, animal hospitals or other health personnel in the City limits
shall be required to report to the Animal Control Officer or Police
personnel of the City any suspected bites by animals which may have
occurred within the corporate limits of the City. Any individual,
officer, agent or personnel of the aforesaid organizations shall be
required to solicit facts from the victim or the victim's family as
to the facts surrounding the suspected animal bites. This report to
the Animal Control Officer or appropriate Police personnel shall be
made within twenty-four (24) hours of when the information first became
available to said person.
B. Penalty For Failure To Report Bites. Any person, officer,
agent or other personnel of any health organization located in the
City limits who fails to report a suspected animal bite upon a human
being as required by this Section shall be subject to a fine of not
less than one dollar ($1.00) nor more than five hundred dollars ($500.00)
and for a commitment to Jail of not less than one (1) day nor more
than six (6) months plus any court cost incurred.

A. Every
animal exposed to rabies shall be immediately confined by the owners,
who shall immediately notify a public safety officer or Animal Control
Officer of the animal's exposure. The owner shall immediately upon
request surrender such animal to any public safety officer or Animal
Control Officer for confinement in a licensed veterinary hospital
of the owner's choice, in the local vicinity of the City, or surrender
such animal for a minimum period of ten (10) days. All costs of confinement
shall be assessed against and paid by the owner.
B. No
person shall kill a known or suspected rabid animal or an animal exposed
to rabies, nor remove such an animal from the City limits without
permission of the Public Safety Department, except when it is necessary
to kill such animal to prevent its escape or attack of any person
or animal.
C. The
location of the remains of any dead animal known or suspected to have
been exposed to rabies prior to death shall be reported to the Public
Safety Department, and the remains shall be surrendered to the Public
Safety Department for laboratory examination.
D. Any
animal that has been bitten or scratched by another animal that is
known to be or suspected of being rabid shall be immediately confined
in such place as may be directed by the Director of Public Safety,
who shall have authority to promulgate rules and regulations concerning
the confinement of such animals. If the animal that made the bite
or scratch is determined to be rabid or evidences positive signs of
rabies, such animal that was bitten or scratched will be kept in such
confinement for a period of six (6) months or destroyed and its body
surrendered to the Public Safety Department or otherwise confined
or disposed of as may be directed by the Director of Public Safety.
E. The
Director of Public Safety shall have the authority to immediately
destroy any animal which is determined to have bitten or scratched
a human if the Director determines that destruction of such animal
is necessary to determine whether such animal is rabid, and the Director
of Public Safety shall have the authority to promulgate rules and
regulations concerning the handling and disposition of such animals.

It shall be the duty of the Mayor, when in his/her opinion danger
to the public safety from rabid dogs is eminent, to order all dogs
be confined for a period not less than thirty (30) days or more than
ninety (90) days. Any dog found running at large during such period
shall be impounded and unless reclaimed by the owner shall be killed
after five (5) days.
