No person shall kindle or maintain any fire or authorize any fire to be kindled or maintained on or in any public street, alley or road.

A. 
No person shall kindle or maintain any open bonfire on any private property without first obtaining a burn permit. After a permit is acquired, the following restrictions will apply:
1. 
Location restriction.
a. 
The location is not less than fifty (50) feet from any structure and adequate provision is made for fire control.
b. 
No open burning will be permitted in close proximity to structures with wooden shingles.
2. 
Bonfires.
a. 
Size and duration. An open bonfire shall not be more than five (5) feet by five (5) feet by five (5) feet in dimension and shall not burn longer than three (3) hours. The maximum size and duration of an open bonfire shall not be increased by the code official unless it is determined that fire safety requirements of the situation and the desirable duration of burn warrant the increase.
b. 
Material. Fuel for an open bonfire shall consist only of seasoned dry firewood and shall be ignited with a small quantity of paper. The fire shall not be utilized for waste disposal purposes and the fuel shall be chosen to minimize the generation of air contaminants.
c. 
Permit. All permits shall be requested by and issued to the owner of the land upon which the open bonfire is to be kindled.

A. 
No permit will be required to burn waste vegetation that originates on the property. If an approved incinerator is used, the listed location restrictions can be modified to not less than fifteen (15) feet from any structure.
B. 
The definition of an approved incinerator shall be regarded as enclosed when, during the time combustion occurs, only apertures, ducts, stacks, flues or chimneys necessary to provide combustion air and permit the escape of exhaust gas are open.

Only untreated wood waste products from construction or demolition may be burned. These may be burned either for the heating of a building or in an air curtain destructor as required by State law. Prohibited burning includes, but is not limited to, tires, rubber products, asbestos-containing material, hazardous material, styrofoam, plastics, petroleum-based products, treated wood and other refuse.

All open fires shall be constantly attended by a competent person until such open fire is extinguished. This person shall have a garden hose connected to the water supply or other fire extinguishing equipment readily available for use. Open burning after dark is not allowed. Land clearing operations must have a permit from the Missouri Department of Natural Resources. Open burning after dark for land clearing will require a permit from the Poplar Bluff Fire Department. Special circumstances for open bonfires may be allowed with a permit as set out in Section 203.040 above.

The Chief of the Fire Department may prohibit any or all fires when atmospheric conditions or local circumstances make such fires hazardous. The code official shall prohibit open burning that will be offensive or objectionable due to smoke or odor emissions. The code official shall order the extinguishment, by the permit holder or the Fire Department, of any open burning that creates or adds to a hazardous or objectionable situation. The Fire Department will not extinguish a permit holder's controlled burn unless the complaining party signs a burn complaint form.

Failure to obtain a burn permit where required will result in a fine of twenty-five dollars ($25.00) for the first (1st) violation. Further violations will be decided by the court.

To the extent there is a conflict between the provisions of Sections 203.030 through 203.090 and the provisions of the Building Officials and Code Administrators, the provisions of Sections 203.030 through 203.090 shall govern.
