There is hereby created in and for the City a Commission to
be known as "The Planning and Zoning Commission".

A. The
City Planning and Zoning Commission was established by ordinance the
fifth (5th) day of February, 1962 and conforms specifically with Sections
89.320 and 89.330, RSMo.
B. The
Commission shall have the following zoning powers and duties.
1. To review applications for conditional use permits:
a. To hear and make recommendations to the Council upon applications
for conditional use permits specifically listed in the district regulations
of this Chapter. The application will be submitted in writing to the
zoning coordinator indicating the conditional use wanted. A legal
property description and plat or drawing must accompany each application.
The application shall be accompanied by a non-refundable fee of twenty-five
dollars ($25.00) to cover the approximate cost of this procedure.
The Commission shall fix a reasonable time for the hearing of the
request, give fifteen (15) days' notice to the public and decide the
same within a reasonable time. The applicant or his/her representative
must be present at the hearing. Before recommendation of such a conditional
use permit, the Commission may impose such conditions as will in the
Commission's judgment ensure that:
b. The establishment, maintenance or operation of the conditional use
will not be detrimental to or endanger the public health, safety,
morals, comfort or general welfare.
c. The conditional use will not be injurious to the use and enjoyment
of other property in the immediate vicinity for the purposes already
permitted nor substantially diminish and impair property values within
the neighborhood.
d. The establishment of the conditional use will not impede the normal
and orderly development and improvement of surrounding property for
uses permitted in the district.
e. Adequate utilities, access roads, drainage and/or other necessary
facilities will be provided.
f. Adequate measures will be taken to provide ingress and egress so
designed as to minimize traffic congestion in the public streets.
g. The conditional use shall in all other respects conform to the applicable
regulations of the district in which it is located and the Commission
shall find that there is a public necessity for the conditional use.
2. To report on and make recommendations on amendments in accordance with Section
405.370 of this Code.

The Planning and Zoning Commission shall be composed of twelve
(12) members, including the Mayor, a member of the Council selected
by the Council, the City Engineer or similar City Official and nine
(9) citizen members appointed by the Mayor and approved by the City
Council by majority vote.

The term of each of the citizen members shall be for four (4)
years, except that the terms of the citizen members first (1st) appointed
shall be for varying periods so that succeeding terms will be staggered.

The Council may remove any citizen member of the Planning and
Zoning Commission for cause stated in writing and after public hearing.

Any vacancy occurring in the membership of the Planning and
Zoning Commission shall be filled for the unexpired term by appointment
in the same manner as provided for original appointments.

The citizen members of the Planning and Zoning Commission shall
serve without compensation.

The Planning and Zoning Commission shall elect its Chairman
and Secretary from among the citizen members thereof. The term of
the Chairman and Secretary shall be for one (1) year with eligibility
for re-election.

The Planning and Zoning Commission shall hold regular meetings
and special meetings as they provide by rule, shall adopt rules for
the transaction of business and shall keep a record of its proceedings.
Such records shall be public records.

The expenditures of the Planning and Zoning Commission, exclusive
of grants and gifts, shall be within the amounts appropriated for
the purpose by the City Council.

The Planning and Zoning Commission shall have such powers and
shall perform such duties as are imposed upon it by the provisions
of this Code of Ordinances, State law and City ordinances and resolutions.

A. All
applications to be considered by the Planning and Zoning Commission
shall be put on the agenda and then require:
1. A workshop session to debate and record comments concerning the application;
and
2. A voting session to make the determination of passing a recommendation
onto City Council to accept or deny the application.

There will be a mandatory two (2) week period between the workshop
and voting sessions to allow the information presented in the workshop
session to be analyzed by the Commission. This rule may be suspended
by a majority vote of the Commission members present at the workshop
session in which the item is initially considered.
